The story Skip to the end for the question Wink

A while back i was riding along on my dtr125,when a lad i know come alongside me on his ped trying to talk to me.e.t.c.
So in the opposite direction was a cop car who promptly turned around when he seen the lad along side me.

The "ped boi" fcked off as he is banned,no insurance e.t.c. so i carryed on as they chased him.
Couple of minutes passed and they were soon behind me with the blue lights going,so i pulled over (me thinking,no big deal,i was'nt speeding and was as allways totally legit).

I was then told because i did'nt give the lads name they would give me a section 59 even though i did nowt wrong.

So anyway some time later,i was riding on a unused off road track (which used to be called walker wheels, and was a place everyone could pay to ride their bikes on the land but ended up shutting down)
I seen a copper near there when i was on my way to the land, and asked him before i went on if it was ok to have a play on there, and he said "if i dont see you on there it's nothing to do with me" so i thought he was basicly saying, yes you can but i cant tell you ya can..
So next day i was back there and the same copper come along with another cop,and took my bike off me,giving me another section 59.
------------------------------------------------
So that's the story...
So what happens now that i have 2 section 59's? does it reset itself so im not allowed another one before i get my bike took off me again? or is it i step out of line again they take it straight off me?

As far as im aware, all the cops need is some member of the public saying i was riding like a tit/popping wheelies, regardless of wether i did or not, they can give you section 59's for it ?

I know theres at least one cop on here,so id love some advice on this..
Thumbs Up

Cheers
Dave

Sounds like you found an arse of a copper.

I would go to the station, make a complaint against him, formally.

See if anything happens.

I did m8,and since then he pulls me everytime he sees me,as does most of the coppers(or at least they did until i sold the dtr)

Its just a matter of time before he finds out what im riding now,and it starts all over again.

And yes he is WELL known around here for being a twat.
But when he give me what i thought was his permission to go on the land i thought he might have been ok.

I just know when he does pull me again and know what im riding,he will be trying to nik me for the least little thing again.

Section 59, another piece of dumb-ass nazi legislation that has the feck abused out of it on a daily basis by criminal pigs. Make a formal complaint against the scumbag. It won't stick but it stays on his record, and if he gets too many it will be held against him.

Get a solicitor and apply for legal aid, make a proper complaint of harassment.

Write to your local MP, fook it write to downing street as well, make as many references to this coppers name as you can, contact the local press, drag his name through the mud, if he ends up sacked he deserves it for not doing his job properly and acting a bully.

I have no idea on the legalities and formalities of it all but that is the route I would be taking.

When i made a complaint about him,the bloke i made the complaint to just said,it sounded to him like the cop told me i was not allowed on the land,i just took it the wrong way (bullshit)

Then said about him stopping me all the time,he was within his rights to stop check anyone they see fit,and that he would look into it to see if the blokes got a grudge.

Never heard anything more of it,and it all happened before xmas.

Some say, once you get 2 section 59's they take your bike/car off you, then it goes back to being allowed 2 again before it's took off you the second time?

Some say they stick with you for good...
Really confusing, and the cops couldnt/wouldnt give me much info about the section 59 law

First section 59 warning is just that, a warning.

Get caught again within 6 or 12 months (forget which it is, do some Googling to find out) and they can take your vehicle off you.

Good luck if you're trying complaining about it, but I'd say you caught bang to rights.

They reckon it was me riding along side him,and i could'nt prove any different.
They were just being cunts with me because i didnt give them his name.
I told the bloke i complained to,but they had to take the officers word for it(not suprising).

It doesn't matter who's word they choose to take, you are still entitled to lodge a formal complaint.

But that's what they usually do, take advantage of your lack of knowledge of the law and give a bunch of BS to make you think you're not allowed to make a complaint.

Get your arse back down the station and demand to make a formal complaint against this scumbag pig. If they still give you BS tell them you will be getting your dad to deal with it directly to the IPCC via a solicitor.

I did actually make a formal complaint at the time,i had to go into the interview room and he wrote all the info down.
I never heard any more of it,so im guessing it done nothing to the cop.

Id look a bit of a dick if i said im telling my dad about it,im 28 years old Laughing ,but yeah i know what you mean, cheers for the info hetzer Thumbs Up

Id also be demanding any physical proof of the offence you have commited, possibly any cars you remember that were infront or behind you could possibly find the owner if their local for a witness statement.
From what your telling us, the police didnt find you till after they had went after the kid, did you try make the point that if another biker pulls up beside you, dosnt mean you know them?
Id also look around the area you were, and where you got stopped, maybe see if there are any security cameras about, and get in touch with the local council, as if im correct your legally abliged to obtain footage that has you in it. even if it is only the small section showing you.

I still don't understand how you can get a section 59 for having somebody ride alongside and talking to you and then not naming this person. Even if you said you 'refuse' to name him, how is it section 59? Especially as you surely said you 'didn't know' who the other biker was...

Now I really don't get it. Confused

They said it was basicly reckless driving.but for some reason i got a section 59 for it.

I said i didnt know him at first and that it was just some guy riding along.
But when they had me in the back of the cop car,the lad rang me to make sure i wasnt gonna grass him up,so they knew i knew him but i refused to tell them who he was.(i've known him for years, went to school with him)

Well I would not have answered the phone, or you could have answered and said I am busy with the police at the moment, I will ring you back later.

Then you could have just stuck to not knowing him.

The reason you didn't hear the outcome is most likely because the scum didn't file the complaint with the IPCC (common illegal practice of theirs). You should have chased it up.

Make another formal complaint against the original pig for the original criminal offence he perpetrated against you, then make another against the head of the station for criminally failing to correctly handle your original complaint.

Never even heard of a S59 i'll be honest, but thought this a good enough opportunity to give a slightly nicer view of the pols for once.

On saturday i was out for a mates 21st, it allwent pearshaped (terrible planning and no one listened to me Rolling Eyes) so anyhew eventually i got asked by some semi comatose girl huddled on the floor to borrow my phone. This is in a big leisure park with a history of violence and general nastiness (stevenage). I leant it to her and told the other guys to find the rest of the group and i'd wait with her abit.

It soon emerged her phone was knackered, she didn't have money, was obviously pickled silly and lived a fair few miles away. Ever the problem solver i ran through her options, which werent many but one involved pleading idiocy with the meat wagon across the road. Hell, embaressment/night in the cells beats hypothermia or rape. Anyhew i eventually dragged her over there, and had to argue with the copper a fair bit to take me seriously, little gobshite. But eventually he said thanks and i left them to it. Having been drinking viciously for 5 hours and wasted 20 minutes talking to her, i was desperate for a slash, so went for a wee piss in the bushes nearby.

Just as the flow starts, 4 coppers wander by with some idiot they had collared who promptly points out i'm pissing. One copper splits off and smugly points out i've just landed myself a £60 fine. I say;
'To be fair mate, i'm going in the bushes AND i've just done my good samaritan shit for the night dropping off a stranded drunk girl at the riot van by X club...'
Copper;
'Alright, i didn't see anything' and didn't even break gait, just left Thumbs Up

So for once there was a nice bit of discretion shown by the fuzz Thumbs Up

Just thought i'd share that one. As for your situation, punch him in the tits Thumbs Up

I once pissed through a gap in the doors of a bed shop when drunk, it used to be Halfords in southend near the hogs head, there was a bed by the door and a gap inbetween them, my mate was home on leave from the Army and we were steaming drunk and decided it would be a good idea.

We took turns, it was funny, we covered the corner of a bed, but thinking back I feel a bit sorry for the poor sod who had to open up.

Yep you guessed it, not a copper in sight. Thumbs Up Mr. Green
