Ok I have never had to do this with a private sale before so I am asking for a polite way of telling him the bike is shite he is a lying cvnt (trying for karma) and I want my money back.


Needs to be polite hence the thread.


Problems with bike.

1) tyre valve broken.
2) petrol cap comletely broken and bodged.
3) radiator leaking rusty water like a good un.
4) Now wont start (problems in workshop section)
5) just got log book back and realised its an import (general bike chat)


Now I should have gone round the bike a bit more than I did before I handed him the cash, that was my fault and I was prepared to put up with the small problems as such. But I get the log book back to me today and she is an import which i am assuming means the MPH clocks are replacements which means the milage he told me and shown on clocks will be wrong, I would have no problem buying it if it was mentioned. I noticed he only got the bike in november which screams to me he tried finding a mug punter (enter me Embarassed ) to take the problems away from him.

I aint a happy bunny now with the log book coming through today and I am going to his house tonight as I cannot find his phone number online.

The bike was in advertised in a bike shop window and the bloke at the shop read the ad out on the phone to me. When I rang the bloke in question and asked him a few questions like ....."anything wrong?...........Runs fine?...........Anything I need to know? He gave me all the right answers and told me everything was fine nothing was wrong. Hence me not looking over the bike properly and just assuming that a geezer who lived in the same town would be honest as he knew I could be at his house in 10 minutes.

Yes I know I am a prick for getting caught up in the drama of being back on two wheels and just wanting to buy it.

Any suggestions.

Why does it need to be polite if he's obviously been deceptive in selling you the bike and taking cash off yours hands??

Im not sure what the law is regarding private sales, but i always thought that caveat emptor applied here in the uk

If thats the case is there anything you can do?

Guvs got the right idea. Polite is the way to go...at first.



If he starts being a cock, knock him the fuck out, ride the bike into his living room, smack his wife's arse, tell his kid/kids they're adopted, burnout in the front room (if the bike is capable), steal whatever is in his front room to make your money back and leave a love letter that cant be traced, just to add a dash of humour to the situation.



Make a comprehensive list of everything thats wrong Guv, then split that into stuff that really isnt on, as in, what would really validate you taking it back.

Take it round and be nice...yet train subtly at how to make yourself imposing and scary whilst being completely pleasant. Thumbs Up

Hi

Private sale, so you have no real legal recourse unless he was dishonest when answering your specific questions.

The issues you have are (except for it not starting) pretty minor and obvious, and with the starting it may well just be something simple. Until you have a look no way of knowing.

Basically your will be relying on the sellers good nature to give you the money back.

Yeah I see your point which is why I was going to put up with the small problems I said about.

But to be fair, the answer of yes to the question is it rideable is a downright lie when the tyre valve was broken I didnt notice and all looked fine. I never thought too much of it as I assumed he would not have noticed, the leaky rad with shed loads of orange water stains on the rad was not noticeable as the rad had obviously been washed before I got there, so nothing to notice there, till I got it home and it started leaking again and now wont stop so he must have known about that.

The petrol cap, well i didn't look but he still should have mentioned it.

All this I was going to put up with, until I find out its an import, he should have told me when i asked if there was anything I needed to know.

He just said it was all fine had tax and MOT (it does) and I would have no problems with it at all it all runs very well.

Obviously not the case.

imho you're not gonna get very far with this one. Especially since you've had it a week and it was running during that time.

If I sell something, I get a twitchy sphincter for the first day after the sale, after that it's up to them. After all they could have ragged the tits off it and knackered it themselves.

But yeah, go talk to the guy. If he's reasonable he might offer something like 'get someone to look at it' for you.

You've no chance IMO.

If he was the sort of bloke to give you a refund when politely asked, he's the sort of bloke who would not sell you a bike he knowingly knew to be dodgy.

He will only give it to you (the money that is) if he feels he MUST, i.e. is threatened. I'm not suggesting you do that, since I wouldn't and it would have potentially bad consequences for you.

Try it on though, but I think you will end up more pissed off than you are now, and are you sure you can keep you're cool if he just tells you to fuck off?

Take a shit in a bag and post it through his letterbox (sans bag).

And next time don't trust them, especially when its a 20 year old bike!!

It's a bit shit when things like this happen,but it sounds to me like you just rushed into buying it,took the sellers word for everything...e.t.c.(Silly barstuard)
And you rode it home did'nt you?
As far as the sellers concerned it was useable when you took it,not his fault if it has developed a fault in the 2 week you've had it.

I would go to his house,explain the things wrong with the bike,and tell him your not happy with it,if he starts to act like a dick,tell him you will get the filfth involved.
If he still is'nt bothered,then you have no choice but to give up on it.(or turn to anger Laughing )

Wouldn't really care about it being an import to be honest, especially on a 15 year old bike (and the clocks could be original depending on where it was imported from).

As to the valve cap, I have had them split with no effort at all (had both on a pair of wheels for the FZR split last year, yet both appeared fine prior to splitting).

Overall it looks in pretty clean condition. Better than I would expect for £350.

FWIW and slightly off topic but maybe useful as a lesson learnt. A few years ago I had a bash at knocking up a bill of sale/receipt.

Intended for sellers but might be useful to buyers (bring your own receipt, suitable worded and get the seller to sign it). As said private sales can be iffy w.r.t. the law and your rights. However, I always think something is better than nothing. At least that way there's maybe the small claims court (or whatever it's called now - on the basis that if a signed bit of paper says it's ok and it's not).

BTW these aren't intended as 'legal' documents, I don't pretend to be a legal expert (but would love their salary Very Happy). They're just something to cover your ass.

If you buy a bike for £350, the chances are it's going to be a shitter.

Take this one on the chin; you've barely a leg to stand on legally - and trying to push for money back could turn sour.

No not at all, I am fully aware that I have no leg to stand on really and truly, but he is a cheeky cvnt so I am gonna be a cheeky cvnt, if I get nothing then I get nothing, I aint gonna go kicking his door in or threatening him. But at least I will have somewhere new to do burnouts at 2 in the morning.

I never expected it to be perfect, I was going to put up with the small problems. Again its all written above all you need to do is READ.
