Hi All,

Been Summonded To Court For This Offence

" Deputy Chief Constable Clive Wolfendale, North Wales Police. On 02/01/08 At 4.10 Pm

You Drove A Motor Vehicle, Namely A Yamaha DT50 J*** LCM On A Road Namely Bromfield Park Otherwise In Accordance With A Licence Autharising You To Drive A Motor Vehicle Of That Class ( No L-Plates) As You Have Accumulated 3 Points On Your Provisional Licence Previously You Are Now Being Summonded To Court On 09/05/08 at 10.00AM"

So With Three Points Already On My Licence What Can I Expect The Outcome To Be?

Cheers For Any Advice.

Phil

3 points for each missing L plate. As you are on a provisional you have up to 12 points before its revoked. insurance may be painful.

New drivers with full licences - not provisionals.

It seems harsh to give points for each missing L plate rather than just charging you with riding without plates.

Likewise I personally don't see why you get away with more points on a provisional than on a full licence.

I'm sure things were more simple "back in my day" Smile

You don't. New Driver Act states that if you get 6 or more points in the first 2 years of riding then your licence gets revoked. Because it is only revoked there is no ban so you can apply for a new provisional the moment you leave court and as soon as you pass one driving test for a catagory your licence is covered by then you get all of your entitlements back.

Everyones licence has the same 12 point ban threshold

But if you total 6 points or more in the first two years following passing a full entitlement then you are reduced to provisional status until you prove, by taking a test in a vehicle you were qualified in, that you are safe as a road user.

it says you are being prosecuted for riding not in accordance with a licence by not having L plates. Not that you are being done for both missing L plates as two offences if that makes sense. Unfortunately for you not in accordance with a licence is a more serious offence and also means your insurance is more than likely invalid as your insurance will have a clause saying that you are only covered whilst you are riding "in accordance"

I wouldnt be surprised if its a ban to be honest

Simple, if your on a provisional your getting more points, if you've passed your first car/bike etc test within the last two years your gettin it revoked, then you re-apply for a provisional and take your theories and test again.
