Parked up outside Tiki's again to day @ about 3:30pm

Tiki got home about 6ish and told me i had a parking ticket.

The Warden only waited 20seconds before issuing the ticket.

It was issued for
Contravention Code 23 On street - Parked in a parking place or area not designated for that class of vehicle £70.00 (e.g. in coach stands, Loading Bays restricted to Goods Vehicles Only| and motorcycle bays)

Jesus christ, what else is supposed to park here?
https://img210.imageshack.us/img210/483/image064tb7.jpg

That darkened patch of tarmac is where my bike was pushed over, its the remains of the 1/2 tank of petrol.

There are no "loading only" signs, no markings on the road to say "no parking".

Im defo gonna contest this, cos the tit who issued it is well out of order.

Post a pic of the parking sign. The yellow line is terminated by the kerb and there is clearly a dropped kerb to allow parking. Unless the sign states to only park in marked bays then I don't see how an appeal will fail, and even if it does then you could try arguing that it is marked on one side Laughing

Appeal it, you have nothing to lose Thumbs Up Thumbs Up

No it'll be theft next, other than a chain fastened around the rear seat, I can't see any security on it?

Anyway, take a photo from the opposite side of the street showing all the signs and road markings. Take photos of all the road signs near the parking area. You'll need them for your appeal.

Might be worth setting the camera to date stamp the photos a few minutes after the ticket was issued?

To be honest it looks like it is a marked bay: it's just kinda triangular... Wink

The end of the restriction lines clearly end at the edge of the parking bay, so unless there are any signs up stating no parking in that area then you should get it thrown out.

Ok, seriously, what other vehicle apart from a bike could sensibly fit into that space! Laughing

Good luck with the appeal, you should be fine, my sister has one going at the moment against a ticket she got in Manchester...now that IS confusing parking up there! Razz

The dropped kerb is to allow pedestrian access as there is another on the opposite side of the road.

Here in worcester ive just managed to get my self out of a car parking fine. I was 2 mins late and the wardon still did me for it, so I wrote a leter saying my watch matches the parking meter (which it does) etc and that i was within time etc. they normally give you a couple of mins lea way. If you look on the ticket its normally a reduced fine if you pay within 20 days etc.

Wardons dont wait because there payed on commision so the second they see you run out youve had it. Ive watched them in the car park behind the college in worcester (where i got caught).

Id wite a letter stating why you were there etc. The argument you should say is as your a bike you dont go too the meter as the ticket will get nicked so you never saw the sign. Either way if you make a fuss over it and protest your causing them hassle and they have hundreds of these matters so if you make a good enough case then theyll let you off. When doing this photocopy the original tickets and hand them with it. Also looking at the picture youve supplied id put that in and mention that the area youve parked in couldnt be used by anything else as its not big enough and not causing harm to others. Hope this has been some help.

protest it, protest it and protest it.

Actually I remember there was a case where it was shown that they issued parking tickets in ADVANCE of the time running out. A woman came back to her car to find the ticket already in place, and when the warden was questioned for the reason he said it was because he didn't think the driver would return in time.
That's well out of line. Thumbs Down

the bay is incorrectly marked and sign posted so the ticket doesn't stand. Appeal on things basis and get the council to prove it is. the council should have a big book full of lines and their use. appeal it in this way will get them thinking and due to them being lazy or stupid you may have it revoked. so many parking bays have been poorly marked out that they are illegal. You have nothing to loose as they can't increase the fine just because you appealed it.

oh they can.

I remeber on the appeal form AFTER i had filled it out it said on the bottom something like:

"If appeal fails you will have to pay £30 within 10 days instead of £25 within 14 days" (obvisoly not in those exact words)

Parking fines are daylight robery, dont us motorist's have a hard enough life as it is. Evil or Very Mad

I know I have mentioned this before, but don't forget the English Bill of Right 1689 states you should not pay a fine or forfeit without first being judged by a jury of your peers.

"Englishmen, as embodied by Parliament, possessed certain immutable civil and political rights. These include"..."freedom from fines and forfeitures without trial"
