Well last year in March I got knocked off my 125 (which is a write off) when I got SMIDSY'd when it was a green light for me Rolling Eyes

Anyhow, I have 4 witnesses and she's down as 100% at fault as she was charged with Driving without due care and attention and her insurance company have already sent me one cheque which only came up to £300. They also mentioned it was the "agreed settlement" even though I didn't agree to anything. We sent the cheque back as it was not enough. Got a letter a couple of weeks ago saying thanks for the letter dating "October 2007" and that the £300 was only for the bike (which is more than I thought I would get for it tbh as i's a piece of shit Chinese crap). Other thing is that I will be claiming for my gear lost (helmet, leathers, etc) and a holiday to Austria (snowboarding) that I couldn't really enjoy due to my back hurting a lot.

Now my grandad said we could aim for around £5k (he is a lawyer but I think that's too much) and after ringing up my insurance company to tell them everything they just said "well what do you want us to do?" Rolling Eyes Meh.

Basically I'm asking for help on who to give a ring to and who you've had experiences with and if you'd recommend or not. A couple of people have said Citizens advice but I'm wondering if there's any actual Bike expert lawyers (seem to remember there being one).

Her insurance company said I need someone to represent me to ask what I want or something along the lines and since it's a pretty much shut case I want to gain as much as possible.

Typical payout for whiplash is £3k, so I guess that would be a reasonable amount to accept. The lower the figure you ask for, the easier and quicker you will find them paying it out.

You do need a lawyer by the sounds of it. Do you not have legal cover with your insurance? This is precisely what you pay that for.

As it isn't a big money claim and there isn't a liability issue give any lawyer a ring. Remember that if you are claiming for injuries you need medical evidence.

Medical evidence? Like how? I was given a big A3 (I think) sheet that explained everything and was told to hand it when I went to the hospital and I did. Doctor checked my back out etc and just told me to rest and take it easy.

Oh ok, I was kind of aiming for around £1-1.5K but I'll see how things go. And apparently not. I swear I remember having legal cover but honestly can't remember now. I do have legal cover with my current insurance but obviously can't use that. Can't I?

Hello mate
As you had no experianced answers yet just thought I would keep you company.
Did bike insurance have no legal protection with it; this can be a differant company so would have to contact them?
If in a Union at work sometimes they can help with legal matters, especially if on route to work when happened.
Any other legal cover with house insurance maybe.
If not then maybe worth a chat with solicitor, normally can get 30 mins at small fee, and as only be letter based claim might be worth it and he can claim his fee back from them.
Maybe AA/RAC can give you some direction.
Hopefully someone will see this and have experiance.

You've seen a doctor about your back so that should be all evidence you need. Nice easy case. One of those no win no fee lawyers would defo take it on.

I'm a full time student so no union really but I missed a few days of college. No legal cover or anything apparently.

This should have been reported to the insurance company immediately. They would then have arranged for an independent GP to review your case. As your accident was seven months ago, the extent of any injuries is impossible to ascertain.

As for compensation for "not really being able to enjoy" your holidays, you won't get a penny; you'd only be able to claim if you'd actually had to cancel the holidays.
