If you compare it to recent sentances administered for arguably more provocative crimes, possibly not.

However taken in isolation I would say he got everything he deserved.

Its ridiculous... That bike theiving gang that was convicted about a year ago got about four months apiece and this guy gets three months for speeding? WTF Evil or Very Mad Evil or Very Mad Evil or Very Mad

We always hear about rapists etc only getting trivial sentences compared to their crime and yet this guy gets three months for speeding!

but i think the but much deserved what he got, and just to add on.

a year ago police caught a major gang of motorcycle thiefs opperating on the south cost, they found over 200 bikes waiting to be shipped abroad (gone in 60 seconds style) in a warehouse in poole. although they never got mr big...the thiefs each got 2 years

It's impossible to compare crimes of murder, robbery, nicking a packet of Crisps from your local Co-Op against one another.

In English law a decision is made (rightly or wrongly) on the basis of the facts of the case, not what so and so got for a similar offence last week (or so they would have you believe!).

The world isn't mad (maybe just in need of slight pscho-analysis Wink ) it's the pratt who was doing 100+ in a 40 zone who's the idiot.

I agree that doing 116 in a 40 is mad, but all I'm saying is that the Judges and JP's are all moaning about prisons being overcrowded, and they put people in there for motoring offences! Whats next? prison for not having road tax? for having a defective brake light?

The trouble with motoring offences is that they are too easy to prove. Its easy for the judges to say "Yeah we caught this guy at a measured speed above the limit" but its hard to say "This guy raped this woman" etc. So they go for the soft option.

Did the car driving bloke hurt anyone? who is to say that he was not completely safe at 116mph, and another driver is unsafe at 40?
Its entirely possible.

I have heard of muggers who use weapons get off with lighter sentences than that - and to me that is not justice.

Its just an easy way to make the courts look effective.

Did you know that more people were jailed for motoring offences last year than for burglary? How screwed up is that?

(and that only includes speeding and careless driving Shocked )

Makes you think though, there are some 40 limit roads I know which I can happily do 130+ on Confused Neutral

My 'world is mad (pscho-analysis)' comment was supposed to be slightly ironic - Apologies if it was misinterpreted.

I would reiterate however that it's impossible to compare one crime against another (you're mugging example). Morally and Ethically it can be argued that a rapist/mugger/murderer should get more than someone who was going fast in a car but legally (and this is the issue) it will never happen as each case is taken in isolation.

There's no argument for doing 116mph in a 40mph zone whether you're in control or not so comparison against someone doing the required limit is not an option. You cannot be in control of your surroundings nor other people's actions so in this case to say that you could be in control at that speed would be pure illusion.

Internet 'discussion' is a real nightmare 'cos it's so open to misenterpretation and I certainly wouldn't want to fall out over something as inconsequential as a tw@t speeding excessively in his Daddy's car. Us Triumph owners have gotta stick together Wink

Yet I've seen Police doing simular speeds, although they are trained. But they still can't do anything if someone walks out in front of them when they are doing 100+mph.

I think what this person did is bad, but I don't think it deserves prison time. I beleve that punishment should take into account the harm caused, in this case none.

Don't worry Steve, what I said also had an element of irony.

I haven't fallen out with you, maybe you misenterpreted what I said. Anyway, I wasn't saying that each crime should be compared to one another on the same terms, rather that the punishment should be scalable when talking about deterrent.

There should be more of a deterrent against burglary than speeding, there's no doubt about that - but why is this not the case? I think that Judges and JP's need to sort out the punishment for burglary etc BEFORE they harp on about speeding. I'm not comparing speeding with burglary, just as you can't compare fraud and mugging.

The point is that the crimes that people are worried about, violent and invasive ones, should have priority for space in prison, rather than white collar crime and motoring offences. If we had infinite prison space and money to pay for it all then I'd say "Yeah lets lock up people for doing over 100mph in a 40" but being that we don't, and we never will, I think we need to conserve prison space for the gangsters and drug barons.

There's no use filling up the prisons with people who are easy to catch rather than the people who ought to be there is there?

Incidentally, if I disagree with someone it doesn't mean that I have fallen out with them! I disagree with a lot of people, but I can see their point of view. Don't take it so personally! Smile Smile Smile

I read in the paper yesterday about a motorist who mounted a kerb and killed a 12 year old girl. Prison? No. A few hundred pound fine and a ban. Wheres the justice there?

if you do 116 in a 40 limit then you deserve it!
i'm all for relaxing the pressure on speeding but come on at that speed if anything happened thats it!
i hit a twat pedestrian last year who walked out in front of me in pitch black without any high vis gear on and not paying any attention to what he was doing at 28mph or there abouts and it nearly killed him.
he had a compound fracture on his thigh bone,broken nose,cuts to his face and broken fingers.
i came away with a broken headlight unit,cracked front fairing,side protectors did there job so no side damage,bruised thigh and plums thats it i would hate to think what would of happened if i was going any faster!

To be fair you can, for example a car jumps a red light and hits you. But I think if someone crosses the road without paying attention they should pay for the damages.

Yes, but you're being allowed in the road then aren't you. Just walking out in a normal bit of road is still fucking stupid.

And if you're crossing the road, even if the crossing hasa green light for you, it is fairly sensible to check if a 40ton lorry is heading your way. Yes you may have right of way, but I don't think that'll do you much good once you're flat. Rolling Eyes

I like the idea in principle but I don't think it'd work out. For example, as a pedestrian you cause an accident that causes someone to write off their brand new 360 Modena. It'd be a tad harsh for you to be expected to pay back £100k. Perhaps if there was some sort of government fund paid for by tax payers?

It is practical. They can get insurance. After all say someone does have a 360 Modena which is self insureed and writes it off due to the stupidity of a pedestrian, why should the owner loose £100k while the pedestrian gets away without paying anything.

To be honest their house insurance probably covers them anyway.

Something like 80% of accidents involving a pedestrian are the pedestrians fault.
