just looking for some opinions really. I know my mate is a complete twat and i know you will all say that but i was just wondering if this was right for the police to do. Ok well here is what happand.

My 1 friends moped broke down about 300 meters from his house so my other friend gave him a lift down to the house to get his dad out. Well anyway about 100 meters down this road the police turn up and stop my mates. Ask him if he has insurance and tax etc. But he didn't have his tax displayed. So the police starts saying how my mate will have his moped seized etc. They carried on talking and the policeman then said that my mate will be done for no tax no insurance and he didn't have his l plates displayed. He has been section 59'ed and the police man said that the moped will also have a section 59 on it or something.

Is all that right or?

Well if it was only 300m why didn't he just walk. Not insured for pillions, no lisence. Deserves his bike taken away IMO.
But L plates 3 points and 60 quid fine, each. Tax, could probably do him for failure to display. Insurance void because of pillion I think.

Cheers for the reply mate. Have spoke to him and his Mum has took his keys off him and locked the bike away herself until everything has been dealt with. She also said if the Police want it they can have it.

Does he actually have tax and insurance?

If so, it may well be not too bad.

Did he, judging by the reactions of some people, run over a herd of kittens in front of the policeman? If so, expect a harsher penalty.

He can argue the case that tax disc get stolen a lot on motorbikes/peds which is why he chooses not to display as he gets charged each time it gets taken to get a new one.

I fhe was carrying a pillion then he can be done for riding without being in accordance with his licence. Which would void his insurance normally.

He might need to get a letter from his insurer stating that if he'd had an accident then the third party damages would still be covered (there's a technical name for the letter but I can't remember at the moment)

How can they do him with having no insurance if he is insured? Fair enough, he didn't have his tax displayed, had no L plates and was carrying a pillion illegally. He was right to be stopped and it's fair that he gets punished. However, I wouldn't have thought they could do him for no insurance if he's insured...

They are possibly arguing that the insurance is invalid because it wasn't being ridden in accordance with his licence

although to be honest I'd expect them to do him for riding not i accordance with his licence and unlawful pillion at three points a pop.

Have a look over the endorsements page - if they wanted to screw him they could push for enough points to put him completely off of the road - just for the one incident.

But the point is, stealing a tax disc of a bike is much much easier than stealing a tax disc of a car. All you need is a tool from any shop or sometimes you can just take them out. You can argue the case especially with the fact that most police cars now have ANPR which check if the vehicle is taxed or not.

I'm pretty certain when that law was made to display tax, ANPR wasn't available. At least nt very easily hold of at all.

I have seen plenty of people arguing this.
It is also naughty in the eyes of the law to do 71mph on a motorway, but most police wouldn't actually do you for it.

Spot on Molotov, the fine still exists as a method of exotorting money out of the motorist when they have systems in place to cover it anyway.

Their defence is usually that traffic wardens need to know, to which I reply give them a computer that can talk to the tax database.
