Yeah, they cant get it right, this time its me who is suffering.

Right, I held an A2 licence from 31/10/2004, Due to an accident on the 5/8/05 which left me with three points which were put onto the licence on 04/10/2006 this left me with 6 points, under new drivers act I had my licence revoked.

I reapplied and recieved my provisional, passed my car test on th 1/12/2006. Now I recieved both categories and questioned this with the DVLA. They said it was because I had passed a test and I was entitled to drive and ride a bike.

So now after 1 year and 6 moths holding this A2 licence again, passing my 33bhp restriction they have sent me a letter stating I have no longer been allowed this category due to a DVLA mistake and they hve taken the category off of the system.

This happened to be the day before I sold a car and bought an R1.

So no licence, no vehicle, and awaiting the return of my car licence. What do I need to do.

Surely I cant be expected to do a CBT before doing my test again?

Can anybody help with this? I would rather not have a bike for a couple of years than have to go through CBT, theory and practical as I just cant afford it after spending £3k on a bike.

Any advice appreciated. Cheers.

Sorry to say this but afaik you will have to start from scratch, cbt - theory - test.

Might aswell sell the r1 and do it now before the october test comes in, might aswell have a licence and no bike than bike and no licence.

Hate to say it, but perhaps if you hadnt of been caught speeding (if the other 3 were speeding), or if you hadnt of been at blame for the accident (else you would have never received points from it) you wouldnt be in this mess.

What goes round comes around.

Confused

So a man take sit on the chin that he was wrong, pays the fine and takes the points and then after passing a car test he gets both licences back, rings the DVLA to check and they say A OK.

So he deserves for be screwed over by incompetent scum who can't get anything right?

Please point to me where "what goes around comes around" actually applies? Seriously... Confused

As I understand the new driver act, they are wrong.

You pass a test, you get all the categories back.

IMPORTANT: Do NOT send them your licence back without first having had a certified copy made of it. Otherwise they will "loose" it and deny all knowledge of you ever having had a bike licence in the first place.

You should also apply for a copy of your motorcycle test pass certificate. You ought to be able to get this from the test centre you went to but they will need the date you passed to find it. They might make a small charge for this.

Send them a letter detailing your exact history chronologically and tell them you have documentation to back it up. See what their response is.

Send them no originals of anything without having a CERTIFIED copy first! They WILL go missing.

To make a certified copy, take a photocopy then get a "person of standing" (doctor, vicar, magistrate, headmaster etc.) to write "I hereby certify this copy is a true likeness of the original." sign it and add their name address, position and date.

I think banks can do certified copies too.

DO NOT UNDERESTIMATE HOW INCOMPETANT THE DVLA CAN BE. Do not underestimate their ability and readiness to sweep their mistakes under the carpet by strategically loosing information and retrospectively modifying databases then denying all knowledge.

Took them 12 years and 6 different licences to spell my surname correctly.

Yes you do but when he got his licence revoked he did not have his car licence, only his bike. He took his car test and passed and DVLA gave him his bike entitlement back too. This is why he rang up and questioned it because he knew they had made a mistake.

For what it's worth I just simply ignored the letters saying to send my license back, they reissued my license and have never mentioned reclaming the old one again.

This is exactly right.

You should never have got your bike entitlement back when you passed your car test, but because you did it's a bit off for them to take it away again some 18 months down the line.

Don't know if it will get you anywhere but it may be worth escalating your complaint. https://www.dvla.gov.uk/contactus/if_things_go_wrong.aspx

However, as Stinkwheel said when they started missing categories off updated licences there was no right of appeal, if you didn't have proof you had to re-take your test.

Quick question sort of on-topic -
If they do 'loose' any document and you need to send them the certified copy can you have a certified copy of a certified copy?

Or would it just be prudent to get more than one certified copy (although you might be charged for each one by the likes of a bank).

Just musing as they could just keep 'loosing' documents and you end up with no copy.

On the other hand if it were just to confirm an entitlement (maybe not applicable in this case but maybe for others) couldn't you just keep the original and send a certified copy?

Confused

Unfortunatly not. You get all the categories back when you the test to gain any full licence that you had prior to them being revoked.

Details are here in paragraph 4.

Doesn't detract from the fact that he has actually passed both tests in the past, so surely he should have both licenses regardless of the pass date being before or after the license being revoked. That's totally wrong IMO. I would've thought he could pass a car test, receive the car entitlement and automatically obtain the bike because the bike was what he had before the license was revoked?

Hi

I agree, and think the whole law is a badly thought out mess (not unusual with recent laws). However the legislation does state that you will get a full licence back when a test is passed which "is a test of competence to drive any vehicle included in any class of vehicles in relation to which the revoked licence was issued as a full licence.". Basically only get your full licence back when you pass a test for one of the revoked groups you had a full licence for.

All the best

Keith

Faddius, as it happens mate my L plte fell off in front of a police officer, and when I was side swiped and nearly killed it turned out that I had been too close to the back of a previous vehicle I had overtaken, how I dont know. So climb off your fucking high horse, and what goes around comes around, maybe ye shall have the same fate then eh? One can only hope.

I had already spoken to them on the phone, if I didnt send it back it would just be taken off of the database. Just happens I told them I had lost my licence so they would send me a shiny new one, less my Motorbike category.

Looks like I will escalate and see if that gets me anywhere. Which it no doubt will not and I will probably end up spending a good £200 min passing my test again.

Its a shit, because I bought the R1 and some new gear and have spent approx £3300 on bike and gear will some consumables, the bike is only worth £2800 from that so I dont really know if it is worth selling or worth just keeping hold of until I pass my test. Suppose there are always going to be bikes about the place for sale.

Only IF you pass a test in a catagory you already had full entitlement too.

If you pass a test in an entitlemetn you didn't previously have then it dosn't count.

Legally speaking he should do the theory, CBT and DAS all over again as that is what should have happened under the new drivers act in the first place.

If he rides without doing that then he is riding without a licence, with all the arse raping that comes with that.

It's not fair, and it aint a circus neither.

If memory serves they weren't accepting certified copies during that whole missing catagories episode they went through a couple of years ago.

don't see what the problem is here.

as i see it.

You had a full bike license
Bike license gets revoked for getting 6points
You pass car test
DVLA stupidly and mistakenly issue a license with full car and bike
You request that bike license is change to allow >33bhp bikes
DVLA inform you, you don't have a bike license due to point 2

IMO fault lies with the DVLA and you, surely you knew that you had lost your bike entitlement by it being revoked, and you'd like to think that the DVLA would have removed the entitlement by it being revoked.

Not sure you need to pass your CBT again, only theory and practical.

He requires the CBT in order to take the practical Bike test, so it will be the full monty.

If they lost the original, I wouldn't let the certified copy out of my sight. I would offer to take it to the DVLA local office for a member of their staff to inspect but it wouldn't be leaving my posession.

for a time perhaps, but they lost my dad's entire driving records off the database and couldn't issue a new license to him. Luckily he had tried out a new scanner for his PC by scanning his license some time before and they used the details off that to put him back on the system.

You're not having to do anything that you shouldn't have to do, are you?

They shouldn't have given you your bike entitlement back, but they did. They've realised they shouldn't have now, so you now have to redo your bike stuff, as you would have done anyway. All you've done is shifted things by 18 months, so I really doubt a claim will succeed!

I am struggling to fathom the reasoning of the DVLA by not letting you pass a test for a new category to get yourself out of learner-status. Most offences that you can get endorsed for are not category-specific, so being forced to do any kind of new test should have the desired effect.

I think some of you are missing the OPs point to a certain extent.

As far as I can tell, as a direct result of the DVLA making a mistake, and then CONFIRMING it as not being a mistake (he rang them, they said it was fine as he'd passed a new test) he has made decisions with financial ramifications.

Simply put. If he'd known that he wouldn't have his bike license (they said he would) he wouldn't have sold his car and bought an R1. As a result he'll now likely be out of pocket.

That said, I'm unsure what can be done, unless you could prove that call where they confirmed their mistake took place.
