Hello alll

Today my bike was parked up in a carpark while i was playing tennis.
I heard my alarm go off and turned to see my bike on the floor with the rear of a 4x4 looming over it.

I ran over to it just as a women of about 40, with 2 kids got out of the car. Before i even had a chance to breath she announced that it wasn't her fault because the bike was not parked in a parking space and then tried to explain to me how carparks work. I said to her all she had to do was glance in her mirror and she would have seen it, to which she replied it wasn't in a visible place and something about not being in a parking space again.

So i picked it up and started checking for damage but a few seconds later she drove off out of the carpark! Probley just thought, kid on a bike, meh nothing important.

A friend managed to get her number plate as she made her escape so ive reported it to the police and they have said they will do what they can and i should ring them in 2 weeks, but im wondering what am i supposed to do in the meantime. I haven't got her insurance details so i can't ring them, so i suppose i ring my own and give them the number plate?

The police told me it would be her fault no matter how i was parked so hopefully there shouldn't be much dispute on an insurance claim.

Anyway the damage is, front nose fairing and screen has been bent inwards where it was squished against a tree, so i can't see the speedo properly now. A broken side stand, an oil leak from the gearbox (i think it hit a root from the tree) and a few scratches on the exhaust and fairing.

Any help or experiences would be nice, i'd especially like to know if the policeman was right and that it doesn't matter where i was parked as the bike was stationary.

No really, she was bang out of order. People who are inept should be forced to take a seperate test to drive a large 4x4 IMO.

She has left the scene of an accident, serious offence. She'll get what's coming to her no doubt.

She's definitely in the wrong and leaving the scene like that won't exactly go in her favour either!

In the meantime, get her address from her reg number (ask someone who has that access on here), go round and put a baseball bat to her knees making sure that her kids witness it all Thumbs Up Wink

You need to get her details somehow and approach her. She might want to settle outside of insurance, but looking at the damage (you'll want full repairs, rather than cheap bodges!) it's going to be an insurance jobbie

Did you get anything from the police to say you had reported a "hit & run" and the vehicles reg details. Ifso surely you can approach your insurance company with a view to them getting in touch with her insurance company to claim from?

FWIW the law changed a good few years back so you're still liable for an accident in a car park (before it would have been classed as private land, so only accident on a road covered).

I mention that just in case anybody else mentions it.

TBH depends on how much damage in terms of cost to repair versus how much your excess is and the possible hit on any No Claims Discount.

Ideal solution would be to get her address and ask for cash as it will also knock her no claims (but if a company vehicle probably wont be bothered).

You can apply to the DVLA for a person's details is you have good cause (example given is somebody always parking iacross your drive). I think you may have to pay though - still, something to look into.

That's just crap and I can't believe you kept your cool - I really hope that you get it sorted.

As for Joe's comment - people are what they are, not what they drive! I drive a 4x4 and I'm female and I certainly hope your comments don't apply to me, as you're well off the mark!

Just FYI I rode down to the beach today and was cut up by a Dad with his kids in the people carrier only to watch him nearly mow down some pedestrians on a crossing when he went straight thru' a red light. I pulled up alongside him up the road a bit and asked him if he realised he'd shot a red and he just shrugged his shoulders. Ignorant tossers come in all shapes and sizes!!

Ah yes i got a reference number didn't realise i could give that number to my insurance and let them deal with it though.

I don't think getting in contact with her and asking for the cashino to repair it will help though as she seemed adamant it wasn't her fault.

Yeah thats what i thought. That my insurance and no claims and stuff wouldn't come into it if it was decided that it wasn't my fault

What insurance do you have? Fully comp then tell your insurance company about it and pass on the crime log number and her reg number, make sure you have independent witnesses. They pay for the bike to be fixed and then hunt her down to get their money back.

Third party? Forget the insurance company they couldn't care less and they will probably increase your premium even if you don't make a claim. Straight through to the legal aid department. Again, tell them what happened, number etc, etc.

Police? Phone back in TWO WEEKS!! Ridiculous. They should have been round her house within the hour.

That is very rare. Due to the differences in male and female brains, women have worse spatial awareness, so sticking them in a 4x4 rushing around with kids playing up in the back is a fucking joke and they should be off the roads. But...credit to you for not being the same, as the general consensus is that these types of drivers are an accident waiting to happen.

Men driving people carriers are generally aggressive drivers that think that their bigger than average cars gives them priority on the roads, they are wankers and should also not be on the road.

Is it obvious that I have a vendetta against road users in this country? Very Happy

Surely this is a failure to stop, surely that means an arrest and interview at the station. You can bet if she had done the same to a 40 year old business mans audi they would be taking this much more seriously or if you had damaged her car.

If you have legal protection pass on her reg and your crime number to the insurance company and they should sort it all out for you.

How could it be failing to stop? Did she throw herself and her kids out of the car as she drove past?

Leaving the scene of an accident, as stated above. The Police will interview her and most likely she will claim to have been scared by the nasty biker and fled for her and her childrens safety.

Only if you want to risk something going wrong and having a claim that you'll have to pay out an excess for, though - depends how much you need the stuff fixed etc.

I work in a school. Mums come and go in these things all the time. I have my bike parked within eyesight and keep a firm eye on it whenever a 4x4 gets close.

Make sure you take lots of photos, record all the evidence you have, etc, and play things by the book.

As already noted if you get your insurance company involved you will probably get your premium increased.

I was hit by a woman in an old VW Beetle whilst in my car last year.
She admitted it was her fault so i thought great no problem.

Letter turns up from my insurance company telling me my premium is going up !
Phone them and was told that because i'd been involved in an accident i was a greater risk.
FFS i was T-Boned on a juntion by a stupid cow who just didn't look and so now i'm a greater risk. Bollocks.

Didn't matter how much i argued and the guy even agreed it was just a money making scheme but no way out.

Chase the police up today then every day until you get an answer, you should have said you could smell alcohol on her breath. Wink

I would let your insurance know as well and get them to chase her insurance. If she wants to settle out of insurance tell her feck off she had her chance & its going to cost her for a few years.

Keep onto the police about it and hopefully with a bit of luck she will get penalty points on her licence

AC20 - Failing to give particulars or to report a accident within 24 hours - 5 - 10 points.

They will probally send her to court!

Used to work for a big insurance company...

If your involved in an accident (vault or non-vault) your premium WILL be effected and usually goes up...sucks but there not there too be nice....always fins a way to screw you
