Hoping people can shed some light on a few questions. Smile

Parking places you're not meant to be, either because of road markings or signs, or because it's somewhere you're just not meant to be like on a roundabout, opposite a junction or dropped kerb, or any of the other places you're not meant to park.

Now, other than the slight risk of parking tickets, wheel clamps or the vehicle being towed away, what happens with insurance if you're parking somewhere you shouldn't be and someone hits you? Am I right in saying you'd never get a penny from their insurance because you shouldn't have been there in the first place?

Purely hypothetical situation, just interested in what actually happens in such cases. Wink

I thought that it doesn't matter whether you were meant to be there or not, they should still have seen you.

A similar example is if you are speeding, and someone pulls out in front of you. the fact that you were speeding means nothing, it's still their fault.

Parking offences were decriminalised within the London boroughs in the mid-90's. Most counties soon followed suit.

This meant the powers to enforce them was handed from dibble to the local council.

In theory, if you were parked on a double yellow line and someone hit the back of you, you should be OK. Bearing in mind you would need to have been unloading at the time.

unfortunately, insurance companies are a law unto themselves and can seem to pick and choose which laws they wish to uphold / ignore.

I don't think that is true.

As far as I know if you were speeding the blame falls on you. Yes they may have seen you but because they are judging you for say 30mph and you were going 40mph they pull out because they would have had enough time if you were going 30mph and then you collide.

Hmmm I should probably come up with a better plan then. Sad

Someone needs to teach people round here how to park though. You don't park around the edges of a roundabout, you also don't park opposite junctions on a narrow road. And you really don't park in the middle of a crossroads as some genius has done tonight.
