Had to happen sooner or later....

...just glad it was like this!

Was a reasonable day up here today, so thought I'd take the NSR along to the power washer, a 2min ride away.

Was only 100yards from the house (still on my street, which is a quiet cul de sac), when a van pulls out as I'm going past it, and he doesn't see me, keeps coming out getting closer and closer to me, I'm slowing down and moving over as close to the kerb as I can until he eventually hits my f****** arm and knocks me off onto verge at side of the road.

The best bit is he carries on driving as if nothing happened!!!

Luckily, it was a van from a local shop, with the shop details plastered all over, so I knew I could find him. Also, I had 2 witnessess saw everything,and I knew them both Thumbs Up

Called the police. Were there in 2mins. Told them what happened, they said they knew where the van lived and were going to speak to the driver. Not heard back but I've to go hand in all my documents within 7 days, which I'll do tomorrow and find out what happened with the driver. I also got breath tested.

I'm not hurt at all, little shaken at the time though. Bikes ok, scratched along bottom of fairing where it was grinding along the kerb for 5 metres or so, so I'm looking to claim that of his insurance at least. Front brake disc also cought the kerb, so looks like it's f***** too.

Typical, riding for almost a year on CBT, then accident 3 days after passing test!!! Is this the famous BCF curse??? That'll be another award then....

P.S. Any advice on insurance claims etc would be appreciated Thumbs Up

Mate i'm sorry to hear about your bike, but you are so so lucky from what you say your not hurt bad, and the bike is repairable and also you have the guy that drove the van, so hopefully you can claim on his insurance and also claim for everything that is scuffed dented or anything, serves the fool right he should have looked and to top it off he ran off Twisted Evil

take these people to the cleaners!

Sorry to hear about it, As far as insurance claims go you should be fine. Get their insurance details and ring them with police report (I think is all you have to do) doesn't sound like you were injured from what you said although I think you should get checked out just in case.

Your money will come through once police lay blame on the other driver, although they may give you it before hand. Best of luck anyways mate hope it doesn't happen again!

He probably didn't even know he hit you.

Least it wasn't serious, and no damage done to yourself.

The company's insurance will probably pay out, especially since you have a couple of witnesses.

They will replace your helmet because without sending it for an x-ray they can't check (and it wouldn't be cost effective they just replace it) as for the rest of your clothes you will need receipts (Well I did) and they said they would come and check them but they never did. They sent me a cheque for them a few weeks later.

It doesn't always happen that way. Simply because the other road user may be reported and prosecuted by the Police, the other side will look to see if there are any contributory negligence on the part of the claimant, this way they can mitigate some of their losses.

The Police will not release copies of the report until the £60 fee has been paid, and if it happened in the Thames Valley area, you are looking at up to 5 months after the case has been closed before a copy of the report is sent out.

I am still waiting for a copy of a report I applied for 6 months ago, so don't hold your breath for a quick turn around.

Look at my thread in submissions on what you need to do after an accident and it will certainly help your cause.

It took me 8 months to get a payout on my accident and that was only on the bike. I claimed for damage to the helmet, leathers and boots, the engineer examined the kit when he came out to look at the bike. I was asked for receipts but as most of the kit was over 2 years old and we had just moved house I didn't have any. I provided the engineer and my insurance company with printouts which included pictures and a price for replacement.

It took them a month longer to make an offer for the kit than it did the bike (they were a bunch of retards though), so eventually it took around nine months in all for a 100% settlement. A lot of insurers will make an offer based on how old the kit is too. So don't expect to get a 100% of the costs back for new items if you do claim. Although I would imagine this would vary depending on the insurer.

Thanks for all the replies!

None of my kit is damaged TBO.

I just want the fairings replaced, I'd be happy with that. And that's only because I'm selling the bike.

I'm totally fine, not hurt at all. Although my right elbow took a whack from the van Rolling Eyes

I'm off to see the Police now in fact, gotta hand my documents in. I want to find out if they spoke to the van driver yesterday, and I want his bloody insurance details!!! Evil or Very Mad

If it is a damage only, there is no legal obligation to provide you with insurance details. It may need a letter of claim from your insurers to the other driver to get these as the Police are not obligated to pass them to you either.

It is only in injury accidents that there is a legal requirement to provide insurance details to anyone with reasonable grounds to so require those details.

Just back from Police station...

...he's been blamed for the accident in the Police report, which is good news.

Cops say his insurance must pay out for damage to bike.

No charges against him though.

Show me the money!

Evil or Very Mad Why are people saying claim for things that haven't been damaged?

If your jacket has armor in and it has taken a knock yes it should be replaced, however the helmet was un affected etc so why try and claim for it.

If you are involved in an accident would you want the other person to start claiming for total random stuff? Nope.

End of the day all it does is put peoples insurance premiums up. Yes you may get new kit out of it etc but in the end it would be fraudulent to get it.

This is not a pop at AcIdBuRnZ, infact its far from it as he actuallys seems like he's doing the right thing and only wants the actual damage made good. Thumbs Up

Just small things like that annoy me, as I've had scum claim for funny things totally not related to the incident before against family members, and also seeing some real scum work the system for all they can get. Mad

Just to quote what I was told on my CBT, If you're ever in an accident always replace your helmet as it could be damaged and you don't know. If damaged the helmet could kill you in another accident if some of the foam stuff is compressed.

As for you're kit if it is damaged claim for it, don't add to the list as Hex said. I'm a good boy I'm only claiming for what I'm missing Crying or Very sad .

Did you concider tooting your horn at him? I know it's hard to think when a huge van is heading towards you, however the horn is there to let people know you are there!
