Posted: 16:48 - 02 Sep 2008 Post subject: Question: Selling prints of your own photos on ebay |
 |
|
What are the legalities surrounding this?
The reason I ask, is because I have a very large collection of photos, taken by myself, from car shows, gigs, motorsport events and so on. Some of them are pretty good (even if I do say so myself), and I'd quite like to try and make a bit of dosh by reproducing them as A4 prints and selling them on ebay.
Now here's the bit I'm unsure about.
Say for example I wanted to sell a picture that I took of someone's car at a show. Now obviously I'd edit out their numberplate for their own security, but is there any reason I couldn't then sell the image, even though the object depicted within isn't my property?
I know this probably sounds like a stupid question, I mean I could sell a picture that I'd taken of Sears Tower even though that isn't my property, but would there be anything wrong with the car, for example?
Same goes for gigs and motorsport events. Some venues prohibit photography and those that don't sometimes list on their tickets that the sale of images or videos taken on their premesis isn't allowed. I have a bunch of photos from a particular circuit. If I reproduced them, would I be legally allowed to sell them?
Cheers for any help guys and gals Karma cookies awarded for anyone who helps me out. ____________________ TARMAC - Automotive blog *UPDATED 26/3/09 - Abandoned fuel stations to go electric? ~ Buy my eBay stuff!

Jay's right - for example if I took some particularly excellent shots of my favourite rugby team, the rights of those images belong to Bath Rugby, I can't sell them. I can keep them and perve over them as much as I want though ____________________ Avast! Pirates ahoy!

I would say if its of someone elses's car you would want to ask them if they don't mind you selling them. You may have to offer them copies, but you may find that they could sell a few at shows as well... ____________________ Just because my bike was A DIVVY, does not mean i am...... |

Bike/Car magazines.
They take photos of allsorts on the road/carparks etc.
The background cars/bikes with easily readable numberplates?
Im willing to bet the magazine hasnt asked the hundreds of bike/car owners in the background to make money off of their pic (even if it isnt the main feature).
I should know, my bike is featured in one of the Mags, in the background to the 90's Cadwell trackday Numberplate and everything.
So from a legal point of view, in public at least, (despite what community coppers think) you can take a picture of what ya want. And then I would assume, as the picture is yours, sell it.
Only when entering an area controlled by someone else would things get tricky. I wouldnt think a car/bike show would have anything to stop photos being sold. How could they? ____________________ "Oh....it looks like Average Joe's is forfeiting the match!" - "Yeah, its a risky strategy but lets see if it pays off for 'em Cotton." |
