Fact or Myth

Can anyone please clear up the following question?

I have use of some private land for offroading.
To gain access to and from the land I have to unload my bike from the van and push it 200 yards along a public footpath in a small village.

I was told that If I remove the chain from the bike and refit it once I am on the private land the police would be unable to prosecute me for any motoring offences because the drive wheel of my bike was permanently disconnected from the engine.

Am I leaving myself open for prosecution?

To be pushed on a foot path it must be unable to start and no means to start it...this means it doesn't count as a motorbike and you are OK. if you remove the spark plugs, so that it can't start, you would be OK to push it on the path. You can't sit on it or straddle it in either case...you've just got to push it.

Thanks Jamie, that sounds very logical and a lot less hassle than removing the chain.

Is your reply an informed accurate one or should I speak to the police themselfs.

i was told when i got caught pushing my bike along a foopath (pemross road/tamar bridge) that it was illegal basically as its classed as using motorised vehicle where prohibited or something along those lines.. I didnt get done for it.. they were more interested in my numberplate and its slogan ("yeh i know im a f***ing idiot")


Im sure if you where pushing it along (helmet/engine off) and you got seen by the old bill nothing would happen.. and anyway 200yd's isnt long. you would be on that path for like literally 2 minutes and being in a villiage being actually caught is so slim. And also if you have to use that route to gain access to private land then how else are you meant to get to it..

Asong as you aint riding on it I cant see the old bill even rasising an eyelid to be honest.. why dont you visit the local plod and explain the situation.. im sure they would be fine with it..

they would either be fine with it or they will say there fine with it then watch you and wait till your pushing it then arrest you scrap the bike and do you for bank robbery.

Thats rediculas you can not get done for pushing a motorcycle, to get done for "using" a motorised vehicle on a public foot path you have to be "using" it i.e. engine running or you sitting on it pushing/coasting it along.

The same thing with pushbikes technicaly you can't ride them on the footpath (unless its also a cycle path) as you are supposed to be on the road but you can push them on the foot path.

Pretty sure you can.
However the issue is more that a police-person would have to be in a really really bad mood to do you for it or a complete arsehole. In which case, they'd probably do you for doing a one-handed wheelie at the same time, or something.

Hi

As I understand it the "remove spark plug", etc, suggestions are just myths. It being a motorised vehicle it must be insured, etc, for use on the public highway (including being parked, let alone pushed), and that path probably counts as a public highway.

From memory, from a legal perspective even removing the engine would not remove this requirement.

While it would probably take a real pain of a copper to enforce it, there is also the issue that they might be forced to enforce it by some local busybody who wants to stop you riding a bike in the field you have persmission to ride it in.

my mate got done for this and the police told him that the bike needs to be carried at least 6inches off the ground Confused

The same laws that allow you to ride across the pavement on to your driveway.

i got caught pushing along path id they pull up they ask what your doing and see if engine is warm if not your ok if it is im not sure but if you remove plugs then you are fine weather warm or not.
