If a wheel fell off your vehicle whilst driving it shortly (1 month or so) after being worked on by a garage in order to get it through an MOT. What would your position be?

Is there a claim to be made for mal-practice against said garage?

I guess it would depend on what work had been done. If it was unrelated to the wheel then probably not, however if they had repaired it and it had then failed the I guess it would be a different mantter.

I'm not sure. Depends how the wheel seperated from the car. If the wheel nuts came loose, then they might be able to wriggle out of it by saying that you should check the wheel nuts on a weekly basis or something.

If the hub detached from the car, then that is either that they cocked up, or it was a pre-existing condition.

I'd bet on the wheel nuts. Usually however, when wheel nuts are loose, the car makes a godawful noise for ages before the wheel totally detaches itself. Alternatively if the nuts were REALLY loose, then the wheel would have fallen off before a month of driving could be completed.

A weird one, something that could only happen to you Goose! Wink

from recollection, when i last had tyres changed on my pickup, which was ages ago, on the invoice it said to check wheel nuts 24hrs or XXX miles later unsure of miles, but with everything i assume its whatever comes first, so basically it think the blame would be shifted onto you as you failed to check them, reality is who actually checks after having wheels refitted in the real world,

As for having a claim i think you are clutching at straws, but i could be wrong.

If it happened on the same day, then you would be in with a chance.
After 1 month. Not a hope in hell as how could you prove that no one else had tampered with the nuts.

One would expect that if something was loose, you would have noticed that it was not driving as it should.

Same thing happened to my transporter! I had a knocking noise from the front left, I did ignore it a bit, but then I got it into the garage to be checked. My neighbour is a mechanic and works for a firm so he took it in. He said he took the CV joint apart and regreased/booted it and all sorted.. drove fine for a while then the knocking returned! then one morning on the way to college I hit a big pot hole and next thing I know I'm skidding towards the side of the road at 40mph with no steering Laughing

I couldn't really do anything about it to be honest, I tried to claim with Colas about the pothole but they said it wasn't deep enough to be classed as a defect Evil or Very Mad and the neighbour done the job fairly cheap for me so it's my own fault really.

But I guess if you put your van in for work to be done and they did not do that work which contributed to the wheel falling off, then yes you should claim.

Went out to my van on Thursday morning to find 3 of the wheel nuts missing had to make a quick trip to our local Ford dealer for 3 new ones
Bloody idiots had pinched them all from front drivers side wheel
Guy at garage thought it would be kids messing and if I walked up the road would probably of found them.
Could of been a bit dangerous if I had driven at normal white van speed though hence now have a crime number so they are looking for them.

No but if it makes the police aware when the little B******s do it to someone who fails to notice and they get hurt I will know I did my bit to try and get the police to do something

You really think some kids came round to your house with a wheelwrench or a very long ratchet/breaker bar and took 3 wheel nuts off one of your wheels? Happen to any other vehicles in the road, then it might be plausible, but just sounds like you lost 3 to me.

Not from our Ford garage and I watched them being put on at the last service a couple of weeks ago and yes it has happened to others up and down the street and on cars as well.
Seems to be the latest craze around here.
Kids are just so mental today.
Glad the bike is in a secure lock up or I dont know what they would do to it.
