heya

Just received a letter through from the London Borough of Barnet, telling me that a PCN is issued to me being in a bus lane in West Hendon Broadway NW9 on 09/10/08 at 09:08.

Now i know for 100% sure that i have not been riding centrally in the bus lane, but i may have just gone over the line getting past the traffic....

what is the deal with this? they say they have video evidence.... reduced from £120 to £60 if i pay within 14 days.

What do i do? because i know i havent been riding in bus lanes as if i own the lane....

any advice appreciated Smile

thanks

So you admit you went into the lane.

I guess it does not matter if its a foot over the line or 3 foot, you are still in the bus lane. Just the same as if you cross a solid white line... Its the crossing that counts.

So nice to know that out in the sticks we don't have this trouble with bus lanes Laughing

Appeal, First ask them to show you the evidence, they should be able to send stills either by post or online, then if they have you appeal anyway, with these things your 14 days is put on hold while your appeal is decided, and sometimes they let you off, worth a punt

Appeal, quoting Boris's pledge to allow bikes on buslanes and for TfL to start the process of changing the roadsigns and lane paintings to reflect this.

ok i have written up a quick appeal... anyone wanna have a read? Smile

Dear Sir or Madam:

I have been riding a motorcycle in London for the past three years, having passed my full test a few months ago and upgraded to a larger capacity machine. I have never received a PCN for riding in a bus lane, as I try my very hardest to adhere to the rules of the bus lane use for buses and cycles only.

I know in my mind that I would not use a bus lane in an offensive manner to the law e.g. in the middle of the lane for an extended period of time, as this would be an insult to the authority of the bus lane laws. In my 20 mile commute to university every day from my home (South Woodford to The University of Westminster, Harrow Campus) I am subject to the somewhat idiotic and observation lacking driving of car drivers that put my life at risk on a regular basis on my journey.

I would not enter a bus lane with the intention of pretending to be a bus or even to try and show off to other cars that I can get round them faster by being in the wrong lane. I cannot think in my mind where I would have done this, and if I have made the accidental mistake in this case then I do not think it should be so punishable as if I would have been riding purposely in the lane to cause an obstruction. After all, the Mayor of London, Boris Johnson is pushing for a bill to allow motorcyclists to use bus lanes, which I am in favour of as motorcyclists do not cause congestion the same way as a car would and to have the free lane would allow safer riding and driving all round.

If possible, I would like to see the video evidence of my contravention so as to set my mind clear as to what I am being charged for. My email address for the video or still images to be sent to is

D*******o@gmail.com

I thoroughly approve of the bus lane law for buses as they have a schedule to keep and I would not have it in my intention to disrupt that. I am sure I would not have caused inconvenience by my actions, as I would not intend to stay in the bus lane for any purpose.

Thank you for your time

D.

Thumbs Up ?

I would have just put "I am not in the habit of riding in restricted lanes. Please provide evidence that I have contravened a bus lane as a PCN's word alone will not suffice."

Sounds pretty good! The only down side is that you've admitted you went in the bus lane, but then again they might be lenient for your honesty.

Seems Barnet are fairly hot on this then, my old man got the same! Was just a £30 fine or something, think if it has pics on signs of buses and pushbikes you could use that as a case of appeal. Especially where your tax disc will say cycle on it.

Cycle is on the tax disc not pushbike, the picture on the signs is a pushbike not a motorcycle.

Easy to see the difference, so no excuse.

It's Bicycle on the tax disk, not Cycle.

Find out exactly where you were spotted, then get pictures of the two signs before the lane starts (one saying it's ahead and the one where it actually starts). Then get pics of the start taper marking and measure it's length. Post them here. If there are any non complient signs or road markings then you appeal on the grounds that the contravention diod not occur.

Most highway authorities have a habit of marking the start taper too short, or leaving signs out altogether making the lanes unenforecable. They still issue tickets though as most people just pay up.

If you go to the TFL website, you should be able to see a couple of b&w still shots of you riding in the bus lane, prior to making the payment. Can try and get off of it, but they generally don't give a toss tbh. I just paid mine within 14 days after seeing the evidence. Sad

bit of an update!!

Ok stay with me on this one..

- Since i bought the bike the DVLA have sent me the v5 back 3 times with the wrong spelling of my last name...

Itzvocitz instead of Itzcovitz

and my road as Laurel Wy instead of Laurel Way.

the letter i received for the PCN of riding in the bus lane has both those incorrect spellings on there... does that help me in any way as its not really addressed to me?!?

Doubt it, as they sent it out to the details DVLA had on file and that will be logged. It's not the ticket office that made the error. . . . May be wrong though.
