I was hit by a car at a petrol station whilst sitting in my car less than an hour ago. I had driven in behind him when he drove to a pump that was shut. He stuck it into reverse and drove straight into me. Fortunately I was in the car and not riding the bike.

Now the fact the front bumper is all cracked isn't what is annoying me. My car, a Peugeot 205 - a GT no less lol Wink - cost me 40 quid a couple of weeks ago. No, what's annoying me is the offending driver refusing point blank to give me his details. I gave him three chances and he refused. I admit I was a bit sarcastic when I asked him if he failed to see me due to the Baby on Board sign in his rear window. I enquired if he had been drinking and he got a bit annoyed lol.

I've contacted the Police* and someone from their "Call Handling Team" will follow up with the garage tomorrow and check if their CCTV recorded it.

If the driver hadn't been a cock and given me his details I honestly wouldn't have bothered as I have far more pressing (and life-changing) matters to be dealing with. But he has caused me hassle and he will be made to pay.

I took a picture of the car and Police* have confirmed it was a hire car (most likely a company car).

This is the second time this has happened. Last year a car drove into the back of me when I was on the bike and drove off. Again the Police did nothing and I had to pursue it through the MIB.

If my insurance company (Admiral) are as slow as both Honda and Yamaha Insurance then I need to go about finding the driver myself, via the hire/lease company if need be. Is there an online resource or do I just have to write to the DVLA?

Cheers,

Graeme

PS. The Police Officer who phoned me back took issue with me asking her to attempt to find the driver because it wasn't their job to go "chasing random cars". Remember that the next time you get pulled for something innocuous.

there is nothing in it for them, hence why they are not bothered.

if the driver would have been doing 35 in a 30 he would have been chased to the other side of the uk for their wages.

did you get the number of the car? then post it on here Laughing

I had someone do the same to my Volvo at the exit barrier for a multstorey carpark, he'd buggered the barrier/ticket up somehow, put it into reverse, we saw his reversing lights came on so I parked my hand on the horn and he still drove straight into me....I was in a Volvo V70 if he didn't see that how the hell would the bastard have seen someone walking behind him.

There was no damage thankfully so didn't ask for his insurance details but he too was in a company car I presume as it had the Enterprise sticker on the back, company car drivers really don't care. Some of the worst drivers I see and get cut up by while on the road are usually in 08 plate everday cars, I would bet my ass they're virtually all company cars.

If you know the lease company it came from (sticker in window or a banner on numberplate) then ring them and they should be able to give you the details they may make you jump through a few hoops first.

Threaten the hire company with court action to release the driver's details. He was involved in an accident and should be made to face the consequences.

A couple of years ago an old duffer reversed into my missus, and though he gave us his details he refused to give us the insurance details. Turns out it was his missus' car and he had "just borrowed it".

We gave our insurers all the details we could, I then rang the police who advised us that "there was nothing they could do as no-one was hurt". My wife had a pedestrian as a witness and when I explained the situation in full to their credit the police said "give them 24 hours then call us and we'll sort it" and they did.

A month later their insurance contacted us apologising for their client's attitude and acknowledging responsibility. The duffer had to go on re-training or face points and a fine.

My advice stick it through your insurance, get them to get the CCTV and do the running around.

Had a Strathclyde Police Constable on the phone this morning. They won't take any action until I have gone to a Police station with all my documents. He informed me that neither my insurance company nor I can request CCTV (not sure if that is correct). I intend to follow it through and as I said to the Constable, if it does no more than get two officers out from behind their desks then so be it.

Will contact my insurance company shortly but the attitude of the Police has appalled me. Not disappointed me though as my previous dealings with the Police have all been negative and I fully expected this level of response.

You can go and request the cctv from the petrol station,
iirc its to do with data protection and you being in the tape.

When my brother got reversed into at a petrol station, they took a while to give it to us as they had to edit everyone else out, but we got the 2-3 mins footage we needed for insurance.

How is that unreasonable?

He's been involved in an RTA that they currently have no evidence for apart from his word. Checking that he's actually entitled to drive a car doesn't seem to be the stupidest idea in the world, does it?

Is it unreasonable to assume that the Police still make home visits to take a statement to minimise my inconvenience? I will happily make everything available to them but resent having to make an extra journey to do so. They could also check their database that my license and insurance are valid. As a recent Traffic Cop Wars episode showed merely having the paperwork is not proof!

No, that's not correct.

In fact you are entitled to request CCTV under the data protection act.

By the way, I've had this happen to me in a car too. Went to pick my mum up from Tesco in her car (brand new at the time). Parked behind a Jag in the taxis-only bit. Next thing, the Jag's reverse lights go on and he started coming towards me.

I swear I flashed my lights and beeped my horn for about 10 seconds straight and yet he still thumped the front of the car with an almighty "CRACK".

I got out fearing the worse, luckily there wasn't even a scratch to either car - Toyota bumpers are strong Very Happy But if there had have been then it would have been a nightmare, both cars parked illegally and tring to prove someone reversed into you is quite difficult.

Apparently he "didn't see me". HOW? A fucking huge red car flashing its lights and beeping its horn two inches from the back of him?

I shook hands with him and let it go. No damage, so not worth the trouble arguing.

By the way, if it was a hire car maybe he didn't know the insurance details?

Perhaps - on the other hand, I'd rather that the police's time was spent in more productive ways than travelling to and from your residence, and checking documents that a lesser member of staff is perfectly able to do. Perhaps they could've arranged to send a useless PCSO round, but I don't see that it's a huge hardship for you to trundle down to your local nick - especially as you've already stated you're only pressing the matter because the guy was an unpleasant mug and you want him to 'pay'!

Indeed - and checking that paperwork exists for you is not proof that the person making the complaint IS you, is it? You need to present the documents in person for identification purposes.

Rather better identification if they come to your house for it Wink .

Really just seems to be an excuse to demand to see the documentation.

All the best

Police need not be involved but the fact the driver failed to give his details in AN OFFENCE, for which in reportable and the Police should then have clicked and become involved.

If I were you I would nip into your local Plod Shop and report the matter and point out that its reportable as the other driver refused to give his details. I would not go home until they have taken details and promised to act upon it.

Sounds like Lazy Police to me.

Sure you will bump (Smile) into that guy again at the petrol station soon LOL

When I was rear ended a couple months (about 200m from our local police station I might add with a police car behind the driver who done it too!) the driver got out their car, hurled abuse at us for stopping (we stopped cos of traffic so gawd only knows what that stupid bint was on about there, think she needs her eye sight checked) only to then storm off back into her car and really give it some beans to drive away. Now I had only just managed to get her plate as she drove off but the police car wanted nothing to do with it and when I went to the station I was informed that there is no legal obligation for anyone to hand over their details after an accident Confused). Still we gave them the plate number but even then we were told straight up that they don't have the resources to chase it up so could be in for a long wait....... great police work i must say. Did ask if she would give me the drivers address and i'd deal with it (with a fuck off huge nail bat) but she declined Sad

They have to give you the details or report it to a police station within 24 hours. Give them 24 hours then go to the police - if they have failed to report it they have committed an offence. If the police don't chase this up, ask them for the of whomever is not doing anything and also the name of the head of the station so that you can address a complaint to them (and write a complaint). If that doesn't get a response, write again reminding them about the complaint and asking for the address of the Independent Police Complaints Commission (and if still no response, write to them).

As for your car, if you go through the insurance company prepare to have it written off, your £40 refunded and for them to take your car away.

You HAVE to report an accident if it is a

- Non Stop
- Damage to road traffic furniture (road signs etc)
- Injury to anyone other than the driver/rider
- Accident incolving vehicle v's any Cattle, Horse ,Ass, Mule, Pig, Sheep, Dog or Goat
or if the other party refuses to pass insurance details

Some Police are taking the pi$$ if they are not getting involved.

Go and get some FREE 1/2hrs legal advice, bet you will be told the same.
