bike siezed 33bhp bods

my ducati got siezed today for not notifying the DVLA it was restricted. They said nothing about dynoing the bike, just that when i come to pick it up i have to have proof of restriction if i want to ride it away.
Also i'm going to be off to court to contest 'not rideing within accordance of my licence'

Ive got a note from a dealer saying the bike is restricted, and the police didnt seem bothered about the restriction they were all laughing at my plate... which they took and wouldnt give back Crying or Very sad

everyone believed me when i said it was restricted, they just seemed to be hung up on the technicality that i hadnt informed the DVLA.

So there you go kids, some coppers do know about restriction, ill keep you updated about how its going.

So legal boffs what can i expect in court?

As far as I'm aware there is no need to inform the DVLA that your bike is restricted. The DVLA merely stipulates that you can not ride a motorcycle exceeding 33bhp. If requested by an insurance company or Police then you most likely have to provide proof (proof can be as little as a dyno print out) that it is restricted. That is it unless the law has changed since I was on restriction.

So either the coppers is having you on or youre making this up.

Get on to the DVLA website yourself if your worried and look up all the laws surrounding it. If you are unable to find this law regarding notifying the DVLA, which I suspect you wont, then get a lwayer immediately as your bike has been illegally conviscated. Unless they test it and then find it isnt restricted in which case it may change things.

Having a stupidly tiny plate is probably what got you pulled in the first place. If you want to get away with illegalities then you need to make yourself as inconspicuous as possible.

Never heard of you having to tell the DVLA about it being restricted. I'd also be querying what power they had to seize the bike. s165 of the road traffic act is normally the main one. But that's for lack of insurance as far as I know.

All sounds a bit dodgy to me.

If you hadn't have had a silly plate, probably wouldn't have happened. Let that be a lesson.

Well yes, it's rather an unfortunate situation, whether it was actually restricted or not.

But the small plate just draws the wrong attention to the bike.

That's why I never understand people who have 1 liner plates. They serve no other purpose than to draw police attention to them. I don't think they even look that good.

It's similar to driving with fog lights on. A cop once told me a story that she's never pulled a car for driving with its fog lights on and not found something else wrong with it. MOT, insurance, tax etc etc.

on the pink thingy they gave me they ticked

'NOT IN ACCORDANCE WITH D/L'

which means?

theyve also issued me with a producer/ fine-points for driving while not in accordance with your licence, which im going to take to court.

the bike had no tax eithier.

if theyve taken my bike when they had no right what can i do? im not too happy about paying the #100 storage fine!

all i said at the side of the orad it was restricted, the rest was yes or no answers to routine things, is it insured etc.

i think they took it because they didnt know wether i was allowed to ride the bike. i.e for all they knew the bike could be kicking out 100bhp.

so were they allowed to take it? was it my responsibility to inform them?
