Precis , swapping insurance details in a ding is normal , but once you call the cops , somebody is going to get done for careless driving and such like =£60 + £10 tax on crime + 3 points.


Looks like even more hit n runs will occur in the future.

I'm guessing the burden of proof for appeals will be on the accused rather than the officer too.

To an extent, as the driver/s (as nothing to stop both drivers involved from being ticketed) could opt to defend themselves in court.

But if they do that they risk a higher fine (as they are trying to make the prosecutions as easy as speeding ones), court costs, etc.

Furthermore you would not have access to the duty solicitor so would have to defend yourself and / or employ someone to defend you. And to make that difficult there are also proposals to stop the defence from charging costs when the accused is found guilty.

The way I read it, you still have to option of taking it to court. The fixed penalty is given as an option if you admit liability. In the same way as speeding tickets.

As long as you can still require the police to attend court and proove their case, I don't have too much of a problem.

In some ways, it might actually be to your advantage. If you've done something blatantly stupid, jumping on the offer of a £60 and 3 points might be the lesser of two evils. As things stand, DWDCA HAS to go to court, where you stand a fair chance of a bigger fine and up to 6 points.
