From a mate ... what do you consider more worthy of a stiff sentence ...

1) The Jag driving peer jailed for 12 weeks in response to killing a man while texting in the outside lane of motorway

https://news.bbc.co.uk/1/hi/england/south_yorkshire/7909510.stm

or

2) The biker jailed for 15 months in response to 130mph ride

https://news.bbc.co.uk/1/hi/uk/7556837.stm

Except:

Quote:
Mr Justice Wilkie made clear the texting incident had no bearing on the fatal collision.

The texting was a completely separate incident to the crash - please read the article.

Now which is more dangerous, riding at 130mph on A class roads or doing 60 on a motorway?

Yeah my initial reaction reading the headline and seeing that he was a Lord was the same "HOLY MOTHER OF DAILY-MAIL THAT'S A SCANDAL".

But then I read the actual article and the sentence is really just for dangerous driving (i.e. texting) not for causing death by dangerous driving.

But still

It should be: which is more dangerous; riding at 130mph but concentrating or driving at 60mph while texting? No one died as a result of either, but I would say texting is much more dangerous.

But even so, we don't know the full details of the biker case. He might have pleaded not guilty, pissed about and generally wasted court/police time even though he was blatantly guilty, meaning the court was inclined to throw the book at him.

Which really means that they couldn't prove the texts were involved in the crash but it's very possible that the text he was writing was not sent so there's no evidence of it.

That is true. I was involved in a crash where the driver was texting (was the passanger of the other car in the accident) and we seen him on the phone a second before the accident and i've done 130mph (on private roads officer Middle Finger ) and wouldnt class it as to dangerous as long as its done safely and under the right circumstances.

For all we know he could have just dropped his phone so wasnt looking at the road Laughing

Point is i think each case should be reviewed individually.

From what I've heard the Lord hit a drunk driver who had already had an accident and whos car was stationary on the carriageway on an unlit stretch.

No case to answer in my book.

Sorry is this the Special Bus for moral outrage?

A rider got 6 months for 130mph with his 14 year old son (wearing no gear other than a helmet) on the pillion because he stated it had just started to rain.

Which is when are the roads greasiest and an accident is most likely to occur.

There is a real culture of "it's not fair that the biker got punished because such and such got away with something else" which is just all a bit playground really.

He knew the risks, he did the act, got caught and will now pay for it.

Thing is that this event has nothing to do with either of the cases you just mentioned, each was an event in their own right.

Thats just nit picking in that a Helmet is the only legal safety device required when on a bike you could wear a helmet and ride in your underpants if you wanted, sometimes I go night shopping in my sleeping gown helmet and slippers.

You can do what you like, you are a grown adult and from your general posting are mentally competant enough to make your own decisions. However he was responsible for the safety of a minor.

At the end of the day, whether you agree with it or not, speeding is still an offence. No matter how much you are concentrating and how safe you think you are being, it is still illegal and should you decide to break the speed limit you have to face the consequences. We all do it and it's frustrating to get caught but you have the final choice about whether to speed or not. You don't have to do it and if you don't have enough self control to decide not to speed then bleat about getting caught then you don't deserve a license and you should lose it! Wink

Yes there are 'apparent' inconsistencies in sentences that are issued for different crimes and that should be addressed.

Actually, I think you'll find speeding is a 24/7 offence.
