basically i sold my moped a couple of days ago and sent of the logbook y'day , i get police coming to my house saying the bike was found in a car park damaged. Well firstly the bike needed work done to it before it was taken on the road in the first place which I told the buyer so possibly the police think it was recently damaged I dont know. Anyway I'm worried.. as even though the bike was sold it still in my name till DVLA register it in the buyers name, and I assume I am liable for whatever the buyer does with it. I told the cunt it wasn't really road worthy and needed work so will I get done for it being ridden?

Hope you gave a reciept....

Just tell the police you sold the bike on, whatever date and that you have already sent the V5 off to DVLA. That should have the date you sold it on, so you are covered.

I would also point them in the direction of the new owner. Wink

yes I did tell them where he lives and no recipte damn it, but what im confused on is that Yes I sold it on that day and sent the log book off BUT obviously DVLA aren't going to receive it instantly.. and they found the bike the same day I sold it

Theres not much advice you can give, once the dvla get the v5 they will send the new owner it and he will be liable for whatever is going to happen.
If the police try to get you to pick up the bike refuse.

He is liable for the scooter from the minute he signed the v5.

I am guessing you filled in the V5 completely? So when it finally reaches the DVLA, it will have the date of sale on it signed by you and new owner. This will be enough to verify what you have already told Police.

No longer your problem bud. The bike now belongs to the new owner and the new owner is the one who has made the offence of having a defective/un-road worthy motorcycle on the road...

yes I completed the V5 WITH the buyer (the sod could hardly write I had to tell him basically everything the form said too) im just worried about if they could do me for selling an un-roadworthy vehicle even though I did let the buyer know this and even escorted him home with the bike, but then again it could be a case of his word against mine

Don't mention about you escorting him home, say you didn't see him take it, and it was advertised as not road worthy.

why shouldn't I mention I escorted him home..? and I didnt advertise it as that police can find out these things... I advertised it saying that 'as far as I know such and such work needs to be done to it' but I wasn't to sure about the specific needs of the bike which I told the seller

You are no longer the registered keeper of the bike and as far as you are aware the new owner has taken the bike home to complete the work that you say as far as you know needs doing...

as soon as the guy signed the paper and gave you the cash, it stopped being your problem
