I cant find the answer on youtube anywhere.I can find what I done wrong but not what to do about it . youtube have muted two of my videos. I did give credit for the sogs but thats not enough now and to be honest didnt know I needed anymore (yeah thick). But i want to know who to get permission off? who do I email? I know BMG messaged me once saying I could use one of theirs and thats one of the ones that was muted and I cant prove this to youtube.

who do I message? I have a message on the vid saying its owne by wmg the track, do I google them and email an if i do how will i prove to youtube i have permisisson ??

It is more likely to be the YouTube/PRS debacle at the moment, however...

If you're using music that you didn't write and perform, technically that's a copyright infringement. Crediting the music doesn't count for anything, it doesn't give you permission to use it, it's just a courtesy. Indeed, it's not generally a case of 'getting permission', you need to *licence* use of music. That is, come to a financial agreement with the artist based on what you want to use it for and where it'll be heard. This gets more complex when you're looking at a worldwide audience (such as the internet) as the rights are often held by different parties for different countries.

Now, nobody's suggesting that you're going to licence an artist's work to stick on a YouTube video, but the point is that unless you actually know the artist, you're never going to get permission. The vast majority don't give a shit if you use their music on a YouTube vid, but sometimes the labels do and though their links with YouTube will have all their tracks removed. Nothing you can do.

Use music more than 50 years old and there are no copy right issues , but its as everybody above said, I've noticed it lots on youtube.

The irony is WMG or is it BMG think they are protecting their revenues especially for songs from the 1970s and 1980s, but the thing is I would not have bought that track anyway, and in being so spiteful I would never buy from them ever again.

I think really the copy right thing should be 20 or 25 years but then that would really screw up M Jackson who owns all the beatles songs.

Incorrect. After 50 years the performance rights expire but the publishing rights do not. ie. The people who played on the record no longer get any money, but the person who wrote it still does. Off the top of my head, publishing rights are artist's lifetime + 70 years (so they can be inherited, and as you mentioned with MJ/Beatles they can also be sold).

Reducing the payable lifetime of music to 20 years? Impossible to implement - you can't take 30+ years of income away from people with no warning. And why shouldn't musicians earn a living?

Its just that I think that it should be aligned with patent law.

On the point about making a living sure they are entitled to it , but many many other groups in society aren't protected when their living is threatened , there are currently millions of pensioners who have been torched by the low interest rates.

In that such things are not zero sum good , ie somebody taking it does not prevent somebody else from having it. And as before I would never have purchased it in the first place anyway so their arguement is moot. My last CD purchased was Pulp's different class. But then I don't actually download much anyway.

Thanks for all the info I didnt know any of this. Looks like I will have a few silent vids or I audio swap for the crap they allowed which I couldnt do as one vid had 3 used it that where unique like the kitty cat song Laughing And the vids look crap with no music. The other one is used on tourist websites for my local area so I guess its silent now for them.

I have a few vids I have songs in but they havant caught the rest of them yet but I expect they will soon enough.

Thats just crap I cant get permission anywhere and if I did it would cost me , no compromise.

Photobucket wouldnt let me upload something last week as I had a song in it also.

And you can bet that some of those pensioners are old musicians. They had their 50 years of performance royalties for some song they played on in the 1950s and have their savings just the same as someone who put away a tenner every month while working a 'normal' job.

Of course it's incorrect. But you have to appreciate that all the industry 'big cheeses' don't know anything other than selling records. There are a lot of artists out there who are more switched on when it comes to how people consume music these days, which is why you're seeing such an increase in touring - the labels don't generally make anything from that so they're still running around going 'OMG downloads are killing us'. In the ten years I've worked in the business things have already changed immensely, it'll be interesting to see what the next 'angle' is.


Dragonfly - there's plenty of truely free music out there, look up Creative Commons Licence.
