If I have a bike, and it needs to be castrated to 33bhp, I'm not pushing it to the scene of its damnation, am I?

What's the law about this - same as MOT?

Legally I don't think you are supposed to, but you would be incredibly unlucky if you actually got pulled over and then you got checked for it and despite the fact you were on your way to do that you got done for it.

Personally I haven't had any of my bikes restricted, and never had a single problem be it with insurers or the law.

Wouldn't be insured anyway, as an insurer would want a copy of the restriction certificate or would certainly ask whether it was restricted, to which you'd have to answer "yes" - which means you've lied.

At worst.....which would mean at least 9 points, and presuming you have had your licence for less than two years means it gets revoked.

Or you could get a friend to ride it there for you.

Ok granted that is what could happen, but realistically what are the odds of him getting pulled? If he keeps to the speed limits and rides very sensibly uses a clear visor so on and so on, what realistically is the chance the police will pull him?

I mean I remember once when riding a bike without restrictors, my exhaust had snapped at the head earlier in the day.. The suspension was shagged the tyres were past their best. Also I had a dark visor on despite the fact it was cloudy and rainy. The police cars I passed didn't bat an eyelid.

I'd ride to the thing; yes its a risk and yes there is a chance of getting fucked over but its a risk I'd be happy with.

Edit: Oh yeah and the bike had a smaller than suggested plate.

Begs the question why bother passing your test, insuring it, going to the hassle of restricting it, maintaining it, MOT'ing it, taxing it etc really. How about getting on it after 4 pints of stella? How far do you go?

For the sake of getting a mate to ride it to the garage, is it really worth losing your licence for and having to do it all again?

Ride the damn bike to wherever you are going to get it restricted, I rode my bikes unrestricted, was stopped numerous times during my two years, cops dident believe i was restricted, guess what i produced a letter to the desk officer saying i was...

So many fear stories of road-side dyno's etc, the fact that you are posting a thread asking if its ok to ride there tells me you are probably not a twat, even if you did get stopped, and by traffic police that know about bike laws they cant prove it by the side of the road (have never known of anyone to get this mythical road-side dyno), just be polite and continually state it is restricted...

No, you're taking it to mean something out of context, in response to ncrn's post. I've not said that at all, I've just said that if you're going to ride illegally, how far do you take it before it's unacceptable and the risk gets too high - not that they are comparable. What is comparable is the end result, which pretty much ends with losing of a licence for the sake of a gamble, which isn't that hard to make alternative arrangements for and not have to take the chance.

Ok i did misinterpret your comment in that case,

There are good gambles and bad gambles, as has been said, his chances of A) getting stopped, B) Getting stopped by an officer that has any idea of bike restriction laws, C) Them bringing out a roadside dyno to "prove" he is unrestricted all seem very remote possibilities when put together,

If he was asking should he just ride the 2 years without restriction then maybe i would agree it is a bit of a risky gamble, but one, presumably short trip i think is a reasonable gamble with a good expected value...

Not everyone has a mate who rides who also has insurance that they can use to take his bike for him. I'm guessing if he is sensible enough to be getting it restricted he isn't going to ride the bike like he has a lead weight wrapped around his wrist, nailing it through thirty zones and taking all sorts of unreasonable risks.

And to be totally honest riding it (sensibly) to a garage to get the bike choked is nothing in comparison to anything you have listed there. Especially drinking and riding no matter the bike size or what you have done to it is totally inexcusable as you are out of control, if you are in control of what you are doing and smart and safe, then I don't see a problem with taking it to the garage.

If your that worried - cant the garage pick the bike up?

Most will for a small fee, perhaps even free if your on friendly terms with them and as your getting work done they, they might look on it as a chance to befriend you so you go back there in the future.

Not true, my insurance company never asked for a copy of the certificate.
Haven't even got one as I bought a used restriction kit, just a receipt from the garage who fitted it.

I have claimed against my insurance company twice in the past, and both times the bike's were more powerful then my licence would allow. Both times the insurance company paid out and were non the wiser..

At the end of the day it's up to you, is it worth the risk..

I have just over a month left of my restriction and ive never had a problem (im not restricted). The thing i will say is that if you ride it there full power then get it restricted and then ride it home, by the time you get home i'll bet you'll want to turn around and get them taken out again, i dont know what bike it is but im sure the difference will be pretty gutting when you feel it.

Plenty don't care. After all if you answer that it isn't restricted then they wouldn't insure you. Better not to ask until they have the money and want an excuse to delay / avoid paying out.

As RTA insurer you're paying out for TP property damage and/or injury regardless of whether you're not paying out for the insured vehicle's damage via repudiation or otherwise. For the sake of £150 worth of premium I don't think an insurer is really too fussed about all this "yay we've got some dough in the kitty" when the likelihood is any incident is going to cost you more than the premium just in administration fees let alone the solicitors fees that are invariably attracted when attempting to repudiate a loss that's contested.

I know they still have to pay out 3rd party losses. But it gives an excuse to delay (more time for money to be in their bank). It appears very few actually do bother to ask anything about restrictions, let alone ask for proof (not surprising as there is no legal requirement for any proof).

Can't delay a TP claim because you're thinking of repudiation/voidance of the policyholder's insurance due to non disclosure - it has no bearing on proceedings and there's MIB guidelines about such things that are constantly monitored against.

With the rate of interest like it is at the moment, it's not like having money in the bank is even a consideration.

There is no legal requirement to ask, but since you'll have said you're on a restricted licence and the certificate of motor insurance will always state "provided that person is licenced to ride the vehicle" this is all that is needed.

I can't really see the argument for it to be the responsibility of the insurer to ask and not for the policyholder to tell, and I can't really see what benefit it would be to the insurer to turn a blind eye at any rate

That assumes they change their policies all the time, rather than using policies written when interest rates were more than a factor of 10 times higher.

Possibly because they do not care and / or do not see it as relevant to the quotes they are giving. Why ask a question if you do not care about the answer? I do not see it as the responsibility of the insurer to ask if they do not regard it as relevant.

If I was you I'd just make sure the garage carrying out the work has your name, reg number and ETA in the diary. If you do get stopped give the copper their phone number. Any copper worth his salt wouldn't take any further action.

I rode my Gixxer for 2 years unrestricted and despite the numerous times pulled over I was never asked if it was restricted.

Also my insurance company never asked for any type of certificate but if yours do, you do not have to provide a certificate from FI International, any dyno graph or similar paperwork will prove that your bike is restricted (be it by throttle stops/ECU etc etc)
