Ive posted this on pepipoo but just incase you guys can help at all.

My friend was issued a parking ticked this morning in a pay and display carpark in falmouth univercity, under the "reason why charge was issued" section the reason given is as follows, "No road tax displayed".

The car in question is fully taxed, and while the tax wasnt displayed it was because the holder fell off of the windscreen the previous night, the tax disk was in the glove box.
The fine has been issued by Premier Parking Solutions and "The charge payable is £100 if this parking charge notice is paid within 7 days the fee will be reduced to £50 after this time the full amount is due and payable."

Is there anything that can be done to avoid paying this fine, it wouldnt be so bad if the car wasn't taxed but it is.


If you guys can add anything to help it would be great, i know there are a few people who know a bit about this.

Failure to display a current excise licence is an absolute offence so you are screwed on that account.

Didn't know parking wardens could ticket becasue of it though!

Maybe so, but i never display my tax on my bike.

If its a private car park which it sounds to be as its ran by premier parking solutions it will be their wardens running it, so if thats the case which id guess is quite likely they cant ticket you for no tax, real traffic wardens can tho now i think.

Ignore it. Tickets issued by private companies like that aren't fines, just invoices. They might send a dodgy letter or two, but they won't take it any further.

do you study at Fal?
I'm second yuear broadcasting, and i've left my car up there for an hour later than the ticket let me and nothing hapened. Thought they were fairly lax compared to last year's owners.

I would say that its bordering on a scam and that they have no legal right to issue you a ticket at all. Just ignore it or tell them to go to hell. Thumbs Up

Completely unenforcable. Bin it.

(by unenforcable, I mean they'd have to take you to court, and they ain't gonna cos if they lose they'd pretty much destroy the entire scam parking industry)

It looks rather unenforceable.

As it looks like it was issued on private land where there is no requirement to actually have let alone display VED and it appears to be a University I would be inclined to write to the Bursar and ask exactly when the University was authorised by Customs and Excise to collect penalty charges on behalf of the Crown as that is what they are 'suggesting' they are doing and that would be fraud without the correct authorisation. I would also point out that I would be reporting it to the Police as a possible fraud.

While private parking attendants cannot issue fines for non-display of VED, (they don't have the authorisation) that ticket isn't signed properly anyway.

Feck them off. Tickets issued by private parking companies are only worth the paper they are printed on to the company issuing them.

Just thought, as well as the Police I would report it to Customs and Excise. C&E have such ridiculous powers these days they could cause the University and the Parking company some real problems.

As Pup says, in addition there is a period of discretion nowadays to take into account people ordering tax through the internet, as this would be within this period should your friend done so for the start of the month then "failure to display" would not apply.

Only if the tax started from the 1st may 2009, but sounds like it was already taxed beforehand.

True, but the company issuing the "fine" wouldn't know that.

As it was they are trying to fine him for "failure to display" anyway. Something they do not have the power to do.
