PostPosted: 13:08 - 03 May 2009    Post subject: Opinions on a bike purchase gone sour Reply with quote

So I've not been having the best of luck with my SP1 and a couple of days ago it decided to develop a fairly big water leak somewhere around the left radiator. Since the manual is almost as useless as my mechanical skills I can't get the nose cone off to figure out where the waters coming from unfortunately so I won't know for certain on that one or possible engine damage till next week when I can get it into a workshop. What I did find was that the fan on said left radiator clearly hadn't turned in years, it was ceased absolutely rock solid.

Now that was the final straw for me, this bike has had a of little issues up until now and I've shrugged them off thus far, now as much as I love the bike, it's just getting too expensive to keep ontop of it all, in the 10 weeks I've owned the bike I've spent not that far from a grand on parts and workshop time on it and the only reason it's not more is down to the new power commander I ordered never turning up. It's not like I've neglected the thing (At least I don't think so Smile )

Add ontop the amount of pretty substantial stuff that was misdescribed and I think it's pretty far into piss take territory.

Problem is, 2 and a half months down to the line, what can I do? I don't want to storm into the dealer, chuck the bike on the floor and demand my money back as A) The bike is awesome when it works & B) I know retail first hand, I hate it when people do that to me and I wouldn't do it to over people.

I'm thinking along 2 lines here, either get them to sort the cooling system and potentially the motor out of there own pockets and I'll waive all the other issues and deal with them myself, or failing that, just tell them to credit me a fair amount of money and I'll just buy a different bike.

Am I looking for too much or being too soft?

For the curious, heres a rough list of issues as I spotted them..

No Power commander (I ordered one myself a month ago, still waiting on delivery)
No Blueprinting
No Ohlins fork internals

Multiple wiring issues, mainly with the immobiliser but also a rotten block handling the indicators and dash (I ended up having the immobiliser rewired after it stranded me)
Prehistoric brake fluid (Near complete front end overhaul and freshen up, new pads, new fluid, stripped and cleaned calipers for my peace of mind)
Notchy head race bearings (Not replaced yet)
Seized rear brake lever (Stripped, cleaned and sorted)

And now of course the cooling issues and dead fan.

Oh and to top it all off, whilst I've been sweating it about mechanical issues on it I remembered last night that I hadn't actually recieved the V5 replacement for it yet, so I go to grab the tear off slip to make sure I phone up the DVLA on Tuesday and get that sorted and lo and behold, the original slip that the dealer should have posted is sat inside my folder too Neutral

I'm honestly wondering if the screw my old Futura's rear tyre picked up on the way to PX it in for this SP1 was actually a warning sign Laughing

How have you managed to spend nearly £1000 on repairs since you bought it? Surely any major issues ought to be covered by the dealer under their warranty obligations.

The biggest 2 expenses were the brakes (I had all the fluids changed within a couple of weeks of having the bike to be safe) and the PCIII usb, the rest consists of tidying up odds and ends in the workshop as well as goodies such as stompgrip and a nicely hidden dual scottoiler. It's not so much a grands worth of faults, more to highlight the fact that I don't feel that I've neglected the bike.

*edit* I sorted the work myself as to be blunt and possibly rather unfair, I don't have a huge amount of faith in the dealer's own workshop tbh.

So was the bike advertised as having a power commander, a blueprinted engine and ohlins forks?

I must admit that I would be well pissed off if a new bike had cost me that much in 10 weeks but as above surely there should have been some sort of warranty from this dealer? It sounds terrible but it from your story it seems as if you're getting mugged. Im sure thats not the case though, get down there and see what they say.You cant keep going on like this mate Wink

I seem to recall in your old thread the bike was advertised as having a PCIII and on closer inspection it was PCII? Or no power commander? You should have complained there and then for a free Power commander. Should still try your luck, sometimes you HAVE to be an arsehole to get your moneys worth. I am such a cunt I was tight-fisted enough to get a throttle cable +fitted after the original corroded 2 weeks after I bought the bike.

The power commander deal was very vague, that came up when I was asking about the blueprinting, if I remember rightly I added something along the lines of 'Oh so it'll have a power commander fitted right?' and I got a slightly mumbled yeah, between the time I test rode it and actually brought it, I had asked if they could suss out what power commander it was but that sort of got brushed under the carpet and given how smitten I was with the bike overall, I didn't press the matter nearly as much as I should have. I did mention it to them when I popped the tail open a few weeks later that it didn't have one for sure, and they offered to sort me a good deal on getting one in there but in the end I decided to get that sorted myself.

if brought froma shop then ask them either to put these parts in as per sales agreemenet ( u did get everything written down on the slaes slip didnt you ?) or ask for refund as not as advertised.

as for other stuff - and dealer worth his salt would have serviced the bike before he put it up for sale so possible miss sale here.

Well I think out of the problems that you have listed then the dealer should be sorting some of them out or have sorted them out under their warranty. The ones that strike me as being down to the dealer are the water leak/seized fan, the wiring issues that you have suffered and the seized rear brake lever.

I would say that the notchy head race bearings and the overhaulling of the front brakes are more of a matter of opinion as to whether they needed doing, ie they aren't faults as such just upcoming work through wear and tear. The dealer is under no obligation to do this prior to the sale or under any warranty unless you and he struck a deal about these issues when you bought it.

This brings me on to the bit about the Bluprinting, Power Commander and the Ohlins Fork internals. I'm not 100% sure where all of this comes into the deal and what should have been done and what shouldn't have been done, but generally speaking unless you get these 'extras' that they are supplying in writing when you do the deal then you are leaving yourself wide open to being disappointed by them.

At the end of the day I would guess that the bike is a few years old and you have got to expect to come across problems and impending work that needs doing. Just because it came from a dealer doesn't mean that it is going to be 100% and is not going to need any maintenance for a while. Its the chance you take whenever you buy anything 2nd hand.

Agreed, it's a 9 year old bike so I was fully expecting to have to spend money on it especially given the mileage that I can run up. Up until then I'd had no real beef with the deal, I was a bit disappointed over the claimed work that turned out not to be there but at the end of the day I couldn't care less if it makes 130, 150 or whatever bhp, the blueprinting interested me because it should have meant that the engine was properly setup and utterly sorted. I have no problems with getting the head race sorted out myself, its just a little irking to have the dealer MOT the bike as part of the sale, only to get a workshop advisory on an MOT item a few weeks later.

I've spoken to the dealer as of yesterday and filled them in on where things are at now (Although I noticed the V5 afterwards unfortunately), I'm really hoping it's just going to turn out to be a burst seal or pipe, if that's the case I'll be happy to just get them to supply me a fan and call it a day. Given my luck lately though I can't see that happening tbh Wink

On the bright side, they claimed the blueprinting was supposedly done by GTs in Plymouth, handy as a mate used to work in the workshop, I'll have to see if I can get a written confirmation from them as to if the work was ever done or not.

Can I ask what kind of dealer they are? Are they a franchise or a secondhand dealer? I'm curious on that point, but either way it sounds like the bike they sold you was not fit for purpose, which the law says it must be for a reasonable period of time.

If you have a read of this: https://www.consumerline.org/legislation/?cat=Consumer+Law&item=Sale+of+Goods , it briefly explains what your consumer rights are. You'll notice that in your case it seems like none of the three terms have been met by the seller! It's not of satisfactory quality, it isn't fit for purpose, and it isn't as described.

I don't believe you should be having nearly as many problems as you've had. I work in the motor trade for a prestige franchise and sometimes encounter these sorts of things from the other side of the desk.

I would write a letter to the dealer principal or sales manager explaining that you are unhappy with the bike. List down the reasons you've put in your previous posts. Then tell them what you actually want from them. Too many people write letters just ranting and forget to say what they actually want the dealer to do. Tell them if you want a partial/full refund, replacement bike, or a repair. But they really need to be doing something for you!

Best of luck!

Hard luck mate.

I agree with what JP7 has said, that would definitely be your best bet.

Get an RSV-R Thumbs Up

Good luck!

if it was bought from a dealer, its a warranty job.
go back and say ''its leaking water, fix it for free''.

then say ''oh, by the way, you can also fit a power commander 3, ohlins fork internals as well as blueprinting the engine, cheers.

alternatively, i could have a look at the leak for you as ive stripped a fair few bikes.

Don't think so, from what I gather from receipts and mileage, the previous owner brought it from the same dealer, rode it maybe a 100 miles then shoved it in a garage for 2 years. Given how absurdly the suspension was setup along with the open pipes messing up the already bad fueling, I suspect it just terrified the poor guy tbh Smile

It's the sitting for 2 years that's done it no favours as the state of the fan shows, hence why I went to town on the fluids and brakes, unfortunately it looks like I didn't go far enough Neutral

Cheers for the offer, I'm going to play it by the book for now though, I'll get an official word on what exactly the story is and go from there first.

i would like to take this oppertunity to say that:

>my bike has no fuelling issues
>my bike has nice smooth head race bearings
>my bikes brake fluid is lovely and clean
>my bike has no coolant leaks
>my bike has no wiring issues
>my bikes brakes are not seized
>my bike has a V5 in my name.

SRAD is sounding pretty sweet right now isnt it.
swap?

Today worked out rather nicely in end, my new PCIII finally turned up and the damage on the SP1 wasn't nearly as bad as it potentially could have been Thumbs Up

The mounts on the radiator were damaged meaning the fan was just getting squeezed, apparently a ton of WD40 and some heat to get the blades circular again and that's all good now. I didn't get a clear answer as to what happened to all the liquidy goodness within, but I would assume that with damaged mounts, a hose or clip has likely just worked it's way loose?

Happy days imho Thumbs Up

I don't wish to sound pessimistic but that sounds like a classic bodge has taken place. If they have 'reshaped' the fan with some heat and also unseized it with WD40 then the chances of it lasting a long time are slim. You could also do with a clear answer on exactly where it was leaking water from and how they fixed it.

it would have seized most likely due to lack of use, meaning your bike doesnt need it.

mine only comes on when the engine temp gets to about 110 degrees. its only happened about 5 times in mid summer in heavy traffic.

dont worry about it.

Maybe the leak is one of his pipes to an expansion bottle die to overheating? or build up of pressure etc, probably not, but just a thought.
To get a fan working its stupidly easy, turning it by hand normally fixes it...

This work was done by a workshop down the road and out of my pocket, not the dealer I brought the bike from. The workshop did recommend that I consider getting a new rad at some point down the line, but that the fan shouldn't present that big a deal, given the noise the bike makes, I can't see myself being able to hear a vibey fan tbh Wink

I'll be trying to find out if they did suss out where the water was coming from tomorrow morning for sure though. Sorting the fan is indeed a bodge, but keep in mind that it's been stuck in that crushed position for 2 years at the very least and potentially a heck of a lot longer, if it was dropped before it was painted (the side panels are absolutely immaculate) then that would mean that that fan has been like that for over 8 years Laughing

I'm not really sure what to say to the dealer now though, it'd be nice to wrangle a new radiator out of them but I can't see that happening over broken tabs on a 9 year old bike tbh, I'll probably just give them a bit of stick over the fan and this V5 comedy. At the end of the day I'm just glad its not wound up being anything properly major.

Depends what your dealer is like, if they are twats then you wont get far, dealers round here are very friendly and do alot for their customers, more so than you would imagine.
