Just hit a Merc 300

Well i was coming home after seeing this bird at 4 am and cut a long story short i was coming down a hill and saw these red lights spinning i was like what in the world is that then went through a dust cloud and then saw this wrecked merc and then before i had time to react i was on the floor hit the car doing about 60 kmph i hit the passanger door and slid down to the front of the car over the bonet and on to the floor ,the driver came back like 20 mins later with the owner of the car and i got taken away in the ambulance
My question is because in spain on bike the only insurance is 3rd party only so will his company pay for my bike or was it my fault ?

how was it my fault it was pitch black no street lights he didnt have any visable lights at the time when the car was spinning i saw red lights but they soon went and then dust cloud car floor

The car was spinning, you hit the floor, then 20 minutes later the driver came back? Doesn't make much sense to me. Are you saying after his car stopped spinning and after you had crashed into it the driver went away for 20 minutes? Or are you saying that he was away after crashing yet his car was still spinning when you hit it?..

wtf? A spinning Merc and a dust cloud that apparently just came out of nowhere? How the fuck could you not see something going on before you ploughed into the car?

If you couldn't see because it was 'pitch black' (don't you have a headlight? with full beam?) then you shouldn't have been going so fast in the first place.

the merc was spinning it stopped. the driver then got out and then fuked off in another car came back 20 mins later

i left a big enough gap i didnt even see the car yep i had main beam on but he was spining on the hardshoulder /dirt and then swerved back on to the main road and stopped then i hit the car

I had a similar experience to you whilst travelling down the A1(M) a few years ago - i saw the taillights of a car in front appearing to go into a spin.
Unlike you, i'm not a retard, so i slowed down and managed to avoid crashing into the (now) stationary vehicle.
There's a lesson in there somewhere for you.

No im not blind the lights are just useless on my ped i didnt see the car untill i was like 5 m away from it i only saw the lights rear lights spinning didnt know it was a fekin car the lights were very dim it was like 2 very small LED s

the car was spining as i got within 5 m of it it stoped then i hit it the driver got out i was on the floor another car pulled up and he got in fuked off and came back 20 mins later

You drove through a dust cloud towards dim red lights which kept apearing and disapearing as it spun (wont even ask why you didnt see the equavalent spins of the headlights) to hit a stationary car.

A second car pulls up almost immediately and whisks the driver off, whilst you are sprawled over the bonnet, after hitting the passenger door (how did that happen lol)

Just sounds all a bit sus.

And if you can only see a car 5m away why were you travelling at the dizzy death defying speed of 30mph?
