A while back i ran in to the back of a lad i know and was following, he slammed on at an amber light, and eventualy stopped 2 car lengths infront of the line, i had no where to go and ended up hitting the back of him.

Not very hard but enough to knock me off the bike and cause a small amount of damage to his car. anyway, his dad has just rung me up saying he has a reciept for £480 for the damage caused ( a small chunk taken out of the bumper) saying he wants the money or he is going through the insurance.
This happend in march and i was just wondering if he can still claim through the insurance.

im totaly lost on this situation and dont really know where to begin.
So i need some advice pleaseeeeeee

As far as I know he can still make a claim, I think the rule is you have 6 years to claim for damage to property. May be different..

If I were you I'd try and settle this without an insurance company, they will only bump up your premiums.

Surely he can't claim on the insurance because he's repaired the damage, and there's no proof that you hit him any more, unless he has like dated pictures etc.

yeah thats what im trying, but i worked in the garage at a vauxhall dealer near me while my dad worked there and i know for a fact bumpers arnt that much.
i think he is trying to rob me tbh

Very little you can do to get out of it. People don't seem to put the effort into repairing plastic bumpers since they are easier to change and they do cost £300 - £800.

I had someone successfully claim about 14 months after the accident.

Call his bluff and offer him £100, since its all you've got, otherwise let his insurance deal with it.

I would suggest offering what you can, make it clear that its all you can afford.

If he says that its not good enough then Wink it didnt happen Wink

See him try and proove it to the insurance, since your bike im guessing shows no signs of damage, and his car is repaired, and im guessing there are no pictures from the accident, even pictures of the bumper, im guessing similar damage could be caused by hitting a post reversing.

Yes its a cuntish thing to do, but short of serious structural damage i would never go through a friends insurace, even if it means paying them back in bits and not going out for a few months...

Sorry if my writing doesnt make much sence, feeling a bit funny tonight and cant really concentrate.

If thats the case surely the OP could just have a friend say he was at his house or something, when i was in an accident the insurance company refused to accept the testimony of some of the witnesses purely because they went to the same school at the same time as one of my friends who was involved in the accident, dispite the fact that we had no idea who they were, they were a few years above us.

See my reference to the darkside. It is very easy to corrupt information but if 'they' decide to investigate then it comes down to strength of conviction.

To balance things out it comes down to personal morals. If you know you did wrong then you should pay for it. If you know you caused damage but refuse to accept responsibility then your as bad as the rest of 'them'.

Statute of limitation in civil cases (as this would be) is 6 years. I don't think the chaps father can go through insurance now as he's had the work done.

I beleive it differs between companies but normally they have prefered garages where work is carried out or three quotes need to be obtained before work is carried out.

In terms of insurance, its probably out of your hands, your own insurer would tell his insurer to (corporately) fuck right off as its already been sorted.

So... Basically, for your pal's dad to get any money out of you (other than you offering it) would be for him to pursue a claim through the small claims court (or county court south of the border.)

It's a bit cheeky because he's had the work done not having approached you with any options in terms of quotes. You're right to be suspicious, I'd be saying to him (politely) if you'd included me in the repair process I would've felt inclined to contribute to the cost, but since you didn't: piss off.

Why are you trying to weasel out of it? You damaged a person you know's car.

Did you leave your balls at the scene or something. Man the fuck up and pay for the damage.

A couple of my friends had a similar thing, one of them drove into the back of the other one, they went through insurance in the end to sort it out, both cars were damaged badly, the guy behind was looking at 4 grand in parts and labour, he wanted his mates car to be repaired to the best standard possible, even if it meant taking a hit himself.

EDIT: Oh and bumpers are that much. I worked in the distribution to the bodyshop and refinish industry for a couple of months, it really is that expensive for things.

it sounds like you did do the damage and you were at fault.
perhaps as you know the guy he was expecting you to make good.
you seem to have let it go so now the guy has the hump.
if you havnt got the money to pay out of your own pocket then call your insurance and get them to sort it.

as for the people saying "claim it wasnt you" then that really is the mentality of the shithouse scum that will knock you off then drive off.

you ran in the back of someone,sort it out and stop trying to weezle out of it.

oh if you think he is actually trying to make a few quid aswell as getting his car fixed then you really need to go and talk to the guy.
is his car a non standard colour because that could push the cost up alot.

I cant answer for the OP but if i was in the situation i would be just the same.

The guy leaves it for 2-3 months then gets his dad to ring up with a random price, its not like he was given the chance to try and get the work sorted himself, I dont doubt i could have gotten the work done alot cheaper than that, it just takes knowing a few people who work in the right places, this may or may not be the case for the OP but it would have been more fair for him to have been given a chance.

Obviously avoiding going through the insurance would be good, if it was me in the OP's position now, i would be talking to the friend or his dad and finding out exactly what work was done, i would want reciepts as proof of this. I would then speak to a few garages or in my case my friends who would do the work, and see what figure they give for the same work, i would offer this sum as a maximum since if i had been given the option to get the work done that is the price i could have gotten it done for.

Its not a case of being tight and not paying, its just that the option to get it done myself was taken from me.

If it was me i would have offered to get the work done strait away is the only difference between me and the OP

out of interest what is the make and model of the car?

demand a detailed receipt from the repairs, pictures of the previous damage etc before paying if he cant show you any i would just tell them personally to shove it.

if this lad is your friend tell him to get some balls as he should have spoke to you not his dad.

If the light was at amber you should have been prepared to stop by reducing speed, if need be, unless you were tavelling way to fast and to close that is to stop safely in time and if you knowingly approached the lights with the amber in a hurry rather than looking ahead to what the driver is doing then you're at fault if your exit was not clear!
