Hey,
Just thought I'd share and see if any of you guys can offer any words of wisdom. Stories a bit long so bear with me.

The Story

In 2005 I was involved in an accident with a cyclist. Riding to work one morning in a 30mph zone (and doing the limit I may add!) a cyclist pulled off the pavement and rode into my path. I swerved to the left to try and miss him but ended up knocking him off and and me off my bike.

The cyclist knocked himself out and was taken to hospital, I also went as matter of course. The following morning his wife rang me and said 'He didn't see you'.

The police came out, I was breathalysed, and given a producer. I was given no convictions by the police.

A month later I received a letter from a 'No win, no fee' company stating that I was being sued for personal injuries to said cyclist. In this letter he claimed he was 'Stationary at the side of the road when I rode into the back of him at excessive speed' which is completely a lie.

My insurance took up the case and after 4 years have decided there not paying him anything and as such its gone to court. In fact I'm there tomorrow and bricking it!

Just wondering if there's anything i can do or say? I did nothing wrong but can sense I'm going to loose anyway.

Cheers in advance,
Shaun.[/u]

Just tell the truth I guess and give your side of the story.

Best of luck! Thumbs Up

Are you going to court as a witness for your insurance company? If so, I wouldn't be worrying at all - just tell the truth and then see what goes on. If he does win damages it will be against your insurance company not you.

Hutchysrs50 your a Dumb*ss its quite clear to see you changed it from *lier* to liar after your spelling mistake was pointed out

Edited .04 after mistake pointed out at .03. Idiot.

Yes I'm going as a witness. Insurance instructed solicitor to sort the third party out. I just have to go and give evidence.

Cheers,
Shaun.

I'm not so sure. If the insurance company is bothering going to court then they must reckon he's trying it on and there is a good likelihood of a result in your favour: otherwise they wouldn't be bothering.

Do you have photographs of the crash scene? Should be fairly easy to see that he wasn't at the side of the road from the relative positions of the wreckage...

Hey,
No photos were taken with it being so minor. I just remember him riding in front of me then a few seconds later waking up a bit dazed.
Cheers,
Shaun.

I had something very simular, even in time scale, I went and met the solicitor/ barrister, confirmed all the details on my statement. Then the professionals did their stuff on behalf of the insurance company. If the insurance company are willing to fight it this far then you wont have anything to worry about. No matter what the outcome you will have nothing to pay. You are helping the insurance company keep hold of their money. If you do have to give evidence then just say what happened as you saw it, don't make things up and if you don't know something say so. The fact te police didn't do anything to you at the time means something in your favour. Don't worry about it, easy said than done, but really, don't worry.

Stick to your guns.. Civil court is only based on the balance of probability, not to be confused with criminal court. As long as theirs no evidence its one on one...

Good luck: up:

You probably wont have to do much as the solicitors and barristers will be doing the arguing. As said if your insurance is going all the way chances are they have a good case and said bloke is trying it on for mega compensation,i dont fancy his chances as sometimes it can backfire and he could leave owing the court money.

It's up to them to prove you guilty, unless there are (lying) witnesses, they have no chance.
