Yes another bloody ebay thread, but I know allot of you guy's are very clued up in this department so thought it would be worth my wile asking.

I sold some Alpinestars Leather Track Pants on ebay, the description read;

Now the chap who bought them has received them, and emailed me saying they are too small. Now unfortunately for me although the funds he sent me are showing in my account they are not available (I believe this is because it is the first time I have used Pay Pal and the money will not be available until the buyer has confirmed he has received the goods as described?).

My Pay Pal account reads: Payment status - On Hold.

Now my question to the chaps and chappets of BCF is where do I stand now?

From your description it seems fairly cut & dried - the only grey area i can see is the 'will fit 32'.
(I'm not even going to mention that you can't spell 'waist' correctly)

However, eBay/papypal seems (currently) notorious for siding with the buyer - so they may honour his dispute (I assume he has opened a dispute).

My argument would be that the size is clearly stated in the advert, the fact that they don't fit him is not your concern - i've seen plenty of size 20 fat birds shoe-horned into size 8 clothes, so perhaps he's trying to convince himself that he's still a skinny and not a fatty (like myself).

If the buyer is somewhat Paypal savvy he will of said they're not as described (even though they are), in which case Paypal will tell him to return the goods at his cost within 10 days and provide a tracking number. He will then get a full refund including the postage costs that you paid.

Paypal make every effort on behalf of the buyer, and bollocks all for the seller.

I personally find bike gear notoriously difficult to get the right size in, to the point of giving up on many occassions and just walking out of the shop! I'd certainly never risk it on Ebay...

I'm a size 11 shoe yet need a size 12 bike boot, and even these can sometimes be too tight. I'm an XXL in most other normal stuff but end up buying 4XL or even 5XL in bike gear - so annoying!

Due to this I'd say it's the buyers own risk and therefore he should just give the money and resell the item himself if he doesn't want it. However since Paypal/Ebay can be complete gits in giving the seller their money, it may be worth offering the buyer his money back minus any P&P costs so you aren't out of pocket. Reason being you've given more than enough info on the size of the trousers for him to have made a judgement wether they'd fit him or not...

What is a payment hold for an eBay item?
It’s when PayPal temporarily holds a payment you receive for an item you sold on eBay. The amounts held will appear as Pending in your PayPal account until we release the funds. You still have access to all other funds in your PayPal account.

When will PayPal release the payment hold for an eBay item?
Your funds will be released after 21 days. We may release funds earlier when one of the following occurs:

The buyer leaves you positive feedback on eBay
3 days pass after we confirm the item was delivered*
If you receive a dispute, claim, chargeback, or reversal on the transaction subject to the eBay item hold, we may hold the payment until the problem is resolved, even if the claim, chargeback, or reversal occurs after the hold is released.

Why would PayPal hold one of my payments?
To increase marketplace safety, we may hold payments that seem risky. Here are some common reasons for holding payments:

You have been an eBay member for less than 6 months, and you sell an item for more than $100, or
You have an eBay feedback score of less than 100, and you sell an item for more than $100, or
You have a Buyer dissatisfaction percentage** 5% or greater than 5%, or
You have an average Detailed Seller Rating (DSR) of less than 4.5, or
You have received fewer than 20 Detailed Seller Ratings in the last 12 months, or

Resolve all disputes, claims, and chargebacks quickly
I’m a new seller. Will payments I receive be held?
If you are a seller with an eBay feedback score lower than 100, but you have a record of good performance, you’ll receive payments instantly in most cases.

* We can confirm delivery if you ship the item with UPS, USPS or FedEx and either use PayPal shipping labels or upload tracking information from the transaction details page. This applies to transactions within the United States. If a payment is held, it appears as Pending in your PayPal account until it is released.

Sorry, I presumed he had already initiated a dispute as they were not to his liking. I'm not to up on them witholding funds as you are a new user (wtf?).

Anyways, I'd just email and him and ask him to try the damn things on, if he's happy release the funds, if he's not happy explain to you why not. Does indeed sound like a numpty IMO.

I have a feeling it is Paypal witholding the funds, not the buyer.

I had it when I sold a mobile phone - as these are high fraud I had to wait the 21 days before the funds were released and I could post the item.

As previously stated,don't expect help off ebay,i had a guy enter a bidding war on my old Audi TT wheels,outbid the other guy at last few seconds and within minutes of winning told me he didn't want them as he'd been told they wouldn't fit his car(which they would have done as they'd been on the same car previously) and hoped the other guy would take a second chance offer,naturally the other guy thought i'd had someone bidding them up and told me to f**k off,I then demanded that the winner pay my listing and sale fee for messing me around and opened a dispute,he also told me to f**k off,ebay still made me pay the fee's,and i'm still stuck with the wheels!

I think if you're new to Egay and PayPal then they sometimes want you to confirm you're bank account before they allow payments to be received into PayPal. This also removes some of the transaction limits and generally makes things easier.

I recently had to upgrade my PayPal account from personal to premier to receive a payment of only £35. Took 2 minutes on t'internet.

if he dosnt your only option is to wait out the 21 days for it to be released as your a new user, but if deciedes to make one in meantime, he will have to return the goods at his expense but then with the tracking number paypal will refund him the whole cost he paid you including postage.

So if you buy something of ebay even if it's 100% as described you can return it at your cost and get your money back if you don't like it?

through paypal yes you can technically, even if the ebay description says no returns. Under paypal disputes its stuck through as a not as described unit, and then you have loads of choices of why its not as described, so he could just put incorrect sizing or something, or find a tiny bit of thread showing and call that damaged goods if he were picky enough.

See thats the issue with ebay now, as ebay and paypal are the same company and work together, you cannot list a auction without paypal being in the payment options, and if you do right no paypal in the auction they will remove it, been there done that too, wouldnt refund my listing fee's either the slags Rolling Eyes Laughing
