Renting Issues

Rented a field for animals near where we live, made a rental agreement with the landowner signed by both parties.

The agreement states that 30 days notice will be given in the event of the landowner wanting the tenant to vacate for whatever reason.

We gave 30 days notice to leave, due to various issues, that would give us until the end of July.

They have suddenly tonight had a change of moods and we have just been given 5 days notice, claiming that the rent is behind.

I realise that proper legal advice should be sought. But was hoping someone might be able to clarify a bit.

Basically it is my thinking that because they have breached the contract then we are no longer bound by any of its terms, and it becomes null and void?

The idea being that we will just pay to the day we leave (rather than the full month), settle the utility bills, forfeit the deposit and be done with it.

The contract is a piece of ill-written shite anyway, and the letter issued to us is handwritten badly on a scrap of paper. These aren't intelligent people we are dealing with.

I did the same to the landlord in the last place I rented (paid up to the day I left, rather than the full month) when he started turning into a cunt even though we issued him with the correct notice.

Wait til the end of the month as you planned, pay them what you owe and leave then with the animals. Trying to evict tennant in property is the most impossible and drawn out task going, so imagine tennants for a field (which homes animals) is the same, usually tennants have all the rights.

Oh and do everything in writing, so anything you pay them or tell them, or hear from them has to be backed up on paper. Also no reason you should forfeit your deposit, you've stuck to the contract presumably so you're entitled to it back.

Personally if I was you I would do whatever you need to do to secure the safety of your animals! This is assuming that you are renting the land for your animals from the landowner who has just decided to go for the 5 day end of lease

What was the payment arrangement? A month in advance I'm guessing which is why if you've not paid your July rent on the 1st July they are claiming you are behind. There is probably something that says what happens if rental is missed or late and it's probably a default to their terms. Also, guessing there is no deposit involved. Land rental varies to property rental iirc.

Given that it's all gone down the pan, just make sure you can get access to the animals and they don't do anything stupid like padlock gates etc to stop your access and claim trespass. It's all a bit of a pain but I'm thinking if you end up damaging fences to get to your animals they will then counter claim with repairs to fencing.
