Had a fine for not declaring my vectra SORN. Wasn't sure if I'd done it or not tbh. Checked online a day or two ago and it said I hadn't Rolling Eyes

It was sorned for the 12 months before that, my two other vehicles are taxed, it sits on my Dads drive, so it's out of sight out of mind.

£80 penalty reduced to £40 if I pay in the next couple of weeks. Plus arrears of £32.67.

Bollocks. Yes, I know it's my own fault but bollocks. Wouldn't be so bad if I actually had any money.

You have my sympathy Flip.

Think the 'Beastiality Year Planner' is quite apt for keeping track of when you have to deal with the DVLA. Beastiality is probably in better taste.

If you're going to pay them, just pay the £40.

You don't owe them £32.67 if the vehicle has been kept off the road, they are just chancing their luck that you'll send them more money. You'd only owe them arrears in road tax if you were using it on the road, you haven't been, they can't prove you have so they can fuck off.

The alleged "arrears" dissapears from the picture if you ignore them and they just chase you for the £80.

I got a letter from a debt collection agency about a week ago saying I will be subject to immediate legal action if I don't pay them £80 within three days. I got another one today politely asking if I would like to contact them to arrange a mutual agreement as to how I'm going to repay the £80 debt which they have kindly put on hold for me for the time being.

I've had nothing that's been signed by a real person yet so I'm ignoring it like I've ignored every SORN fine I've had to date. At this point all they can do is chase me for the £80 because the date of the alleged offence is time expired for taking me to court, their threat of a £1000 fine is meaningless.

I'm pretty sure they are on shaky legal ground with this £80. They call it an out of court settlement but I have at no time agreed to settle out of court.

I'm actually wondering if I ought to stir the hornets nest and write to the debt collection agency informing them that as far as I'm concerned, I owe the DVLA nothing and if they can show documentary evidence of goods or services delivered or an agreement entered into, I will be glad to send them a cheque by return of post.

That said, my current policy of throwing all correspondance in the bin seems to be a winner so far.

Gets half tempting to just knock up a template to post to them once a month listing X vehicles to have SORN declared. Let them sort it out if they want it on their actual form.

Flip, just to let you know, I have an outstanding 80 quid charge from them that I have no intention of paying, they threaten court action and all sorts that never amount to anything other than just threats. They have been chasing me for over a year now, even promised to send me some bailiffs round who sadly never arrived (I guess they got lost?).

IMO I wouldn't worry too much about paying it. The amount of people that have moved house with the vehicle still registered at their old address is probably in the thousands, do you really think the DVLA have time to chace them all for a 80 quid SORN fine?

I'm thinking of just paying the the £40. That's a lot of money for me at the moment in all honesty. Confused I fuckin' hate owing money. Especially when it feels like you're being robbed.

Yeah I got the same in feb and mine was a month out of date and I forgot to sworn it as I was to busy giving birth. Just paid the half of it. They wasted no time anyway.

They are very careful never to referr to it as a fine.

They started off calling it an "out of court settlement" and are now calling it a "debt".

This will be the main thrust of my argument if I am taken to court. ie. I will ask why they think I owe them £80. They are not legally allowed to impose a fine under the Bill of Rights, I have not agreed to settle out of court and they have not provided me with goods or services for which I could have incurred a debt.
