Makes a change the criminal being the one to get stabbed and not the victim(unfortunately he survived),little fvcker might think twice before damaging property again though.

Much as it pains me to defend the cops, but they've done the correct thing.
It's not up to the cops to decide 'guilt', that's for the courts - an offence was committed (someone was stabbed), they've arrested the person responsible for the offence.
The court will decide as to whether the circumstances mitigate the offence - i.e. he was defending himself/son/property, reasonable force etc.

agree with you Hetz and mistergixer,

@Hetz, this man was doing a good job of protecting his family from a gang of human flith. People should be given a medal, not a murder charge Rolling Eyes

@ Yes the police are right to investigate a stabbing by detaining those suspected, however they should have also arrested all the vermin for assualt/battery.....

They did arrest the vermin.

What they should have done with the father is said "We'll be back later to take a statement under caution. Now go indoors and have a cup of tea."

Like he was a major criminal figure who would have had it away with a false passport. Rolling Eyes

In reality I doubt you would, I'd say the guy probably didn't even know he'd stabbed the one he did, was no doubt pumped on adrenaline trying to get to his son and acted on instinct so was unlikely to know exactly what he had done.

I agree with Hetzer, if all is as it is reported and the family looked respectable and what had occured was fairly obvious then I don't think they should have cuffed him and dragged him off, surely they could just go inside with him and take statements in his own home.
How was a 50 year old bloke going to get 5 yobs off his son quickly bearing in mind they were kicking him in the head on the floor. Talking wasn't going to work, can't exactly call 999 and wait and he wasn't Jackie Chan so the knife was a good bet, that or a baseball bat/metal pole.

Sounds like there is a bit of history to this story

I think Tony Martin's mistake was to shoot his thieves while they were running away. However, that was tried in 2000 and as society has gone even more downhill I wonder if a jury would convict today?

Tricky one.

Easy to judge with hindsight, and I know that I'd cheerfully run out there and stab as many as necessary to protect me and mine too.

At the scene it was probably far more confused, and far less clear cut than it is now; so it isn't surprising that Dad got nicked. He's been bailed, not remanded, so it looks like the plod took the first opportunity to let him go.

If the story is as reported, I'd be sickened if he was charged with anything - sounds like a text book case of instant-arming and the use of force to protect life and limb.

I agree wholeheartedly here, I don't really like to praise the police but as a devils advocate I'm trying to think about what it would be like for any parties potentially involved, and based on the circumstances:
Arrow Disturbance late at night in a residential area
Arrow 8 people involved (They need to determine who's the aggressor(s), defendant(S), attacker(S), vandal(S), victim(S), and witness(es). Not to mention the inflicted and inflicter in the stabbing.
Now in a article it may all seem quite straightforward but on the scene I'd imagine it's quite chaotic, what with a guy in a pool of blood, people still probably fighting and or people fleeing the scene, another guy lying beaten on the floor with a mother next to him in tears.

It sounds ultimately though that rough justice has so far been served, and the scum what he deserved.
But I hope no charges were brought to the man as there should be a full length investigation beforehand, I don't think it should even necessarily go to court if evidence to suggest otherwise is not brought up.

You get charged BEFORE court - for a simple matter where you bubble up to the plod or there is plenty of evidence you get nicked, interviewed and then charged all in one go.

For something complicated or serious like this you'd get nicked, interviewed, and then most likely bailed to return or remanded in custody while the CPS works out if it's worth charging you - and for what.

It's this stage where you end up with ludicrous decisions made by bargain basement rookie lawyers with polytechnic law degrees - stuff like taking a man's eye is only ABH, because the scrote has made a plea-bargain - something that isn't really supposed to exist in our legal system, but does because the CPS have targets to hit.

I know you get charged before court... I've been myself, but the police could still release him without charge and then pending the outcome of their investigations arrest and charge him at a later date, no?
