2 week insurance clause.

Got my post forwarded to me today, after two months of begging, and my insurance has automatically renewed itself.

Got off the phone with them, and I've been told not only are they keeping my first payment, but they also want a £40 cancellation fee, I also can't cancel in any easy manner, but have to send a sent recorded signed letter along with my certificate. Since I'm scraping by on about £8 a week for food with no spending money, that alone is a bit of a kick in the teeth. Anyway, I'm sure I've heard that if you cancel an insurance policy within the first two weeks it's free. Is there any element of truth to this, or just me being a mental.

(also found out my tax and MOT expired a month ago. This is not a good day)

Cancel the direct debit, issue a summons in the small claims court for the first instalment.

They can't sign you up for a credit agreement without your consent, which is what they've done.

Distance selling regs is what you are thinking of. And while it does cover insurance. Once the policy has started, the company are entitled to take payment for the time the cover is active.
So if you took the policy out 3 weeks before it was due to start and canclled it after 10 days, they would have to refund ALL monies paid. But if its a simple renewall, then they have you.

Time to get the policy out and look at the T/C to see just what they can charge you for.
Sending the cert back is std ins co policy now, and recorded delivery is a good way to ensure its recived... Tis only 75p extra.

In reality its your fault for trying to avoid having to pay the charge for changing address. Had you of informed them. Which you should have done, as it is a major change of the policy and may effect the price of the policy, you would not be in this situation....

You really should be keeping a note of when things like ins, tax and mot are due....
Had you have been riding and were stopped, you could be looking at a very heafty fine and points.....

Saying you forgot, or you have moved is not going to help you.... In fact if they check and your details have not been updated, it could add to the list....

Multijoy, by not contacting them, it will be written that he is agreeing to a new term of ins and the previous credit agreement will simply roll over.
Cancel the DD yep, as he has now advised them he no longer wants the policy, but he cannot claim back for something that has been used.

Yes they can - when you've signed the consent under the T&C at inception of the arrangement

You have a 14 day cooling off period where you're entitled to withdraw from the policy and be charged a pro-rata premium for the time on risk, subject to a "reasonable" cancellation fee.

You cannot 'roll over' a credit agreement in that manner.

Furthermore, the distant selling act applies as it is a new contract so the OP still has the 14 days to cancel.

Ahh cool, I was expecting around a fiver, (it's what my mum shouted at me when I called to tell her about the insurance thing)

Just for the record, I have two addresses registered on my insurance, the one I live at is the primary one, but stuff gets sent to my secondary address as it's the billing address

Agreed, though no points as the bike I'm riding is insured, the MOT and tax situation is on a different bike, the insurance situation is on a bike I'm not using. Annoyingly I definatly checked my tax disk about a week ago, when I had to stop to sort my fuel tap, but in the streetlight I read the 6 as an 8

I think I've seen you mention that you work in insurance Iooi, any advice on the £40 cancellation fee. I was planning on cancelling the DD, sending the letter, waiting for them to request the £40 and then questioning the legallity. At worst it'll delay it till I get student loan, cos as said, I'm living on a shoestring for the newt few months.

I also just sawed a huge gash in my finger, while sorting a baffle for tomorows MOT Thumbs Up

They can roll it over because they will have stated in the old contract tht they reserve the right to continue the cover blah blah; it also mentions something about your safety being the reason why -_-

Haha, ok, it gets a bit easier, and a bit more complicated.

Been through the small print and there are two sections, cancelling within 14 days, and cancelling normally.

as said by various posters, within 14 days there's no cancellation charge just a charge for the number of days you where insured.

outside of the 14 days it's £40 on top.

So thats pretty clear cut. Now for the complicated bit;

The policy started on the 15th of July Laughing

So, if I date the letter today, and get it sent, today, will that count as today?

As long as you call them today to advise of your intention to cancel the policy from it's inception at renewal. They will then log that and go through their spiel on returning the certificate.

When i sent my cancellation letter off, even tho i phoned they asked for the cert back and a cover letter, they would only refund me from the day they recieved the letter.

I would have opened a complaint and gone to the Omsbudsmen and the FSA.

You should not be left liable for outside forces like the Royal Mail.

What if they lost it? What then? Ask the insurance company to send you another so you can return that one too, all whilst paying for cover you don't require?

Ugh called again, much more helpful chap, today as cancellation logged so no cancellation fee. I was already logged cos of my earlier call, but the lady I spoke too was pretty adamant there was going to be a £40 charge, despite the fact she must of logged the call.

Oh well, thread sorted Thumbs Up I'd say the insurer is fair in this situation, just a bit miffed about the phone operator I spoke to earlier, had me thinking I was down £40 all morning.

Insurer is Devitt, I'll happily use them again.

Glad it's worked out ok in the end for you. Thumbs Up

One question, I know they can renew your policy without any go ahead from yourself (mine tried, but luckily my card has changed and I ended up paying £50 less than they were going to take), but as I understand it, you cannot cancel Direct Debits without their consent, can you?

Ages ago I signed up for a free music deal (emusic, I think) and forgot to cancel by the end of the trial period. After no response from emusic for two weeks trying to cancel, I tried to stop the next payment going out from my bank, but they said it takes the other party to agree as well, before they have the authority to stop it.

They recommended that in future, I should do as much as possible using standing orders, as you can cancel that on your own.

Managed to avoid doing anything requiring DD since then.

15th = Day one.... So 14 days later is 28th..

Nice to see you got it sorted. Seems some people will listen and take the common sense approach.

I don't work in Ins, but i do deal with a lot of this type of complaint, when people simply ignore a letter, thinking that if they ignore it, they will not get billed.... Instead of reading it and then doing as asked and ringing the company.

Remember with ins, simply stopping the DD could lead to the ins co revoking your ins.... Even though you don't want it. And as we all know that a std question they have is.. "Have you had any insurance revoked or declined".... When they check all your details and find that you have failed to pay a previous ins, and its marked as revoked. It could lead to them upping the price, or not taking you on.

Yes he has 14 days, but they have the right to charge for the days the ins was in force... Which would be 14 days if you cancelled on the 14th day... As its a renewall.
It could also be argued that it is not a new contract, but simply a renewall of the old one.

That is a continuous authority, not a Direct Debit...

DD can be cancelled by you, but remember to inform the company when you do... Or they may reset it up, or simply chase you for the money.

If you ever sign up for a free trial and have to provide your card details. I will lay money on them taking more each month. Unless you cancel it with the retailer....

Think.... If its a FREE trail, why do they need you card details....

No, it was a free deal, in that you trialled it for a month, and in that time you could download a max of 50 tracks, but.... if you didn't cancel, they would then continue to take out the monthly fee after the trial expiry date.

I'd done it before, using a different card, but that time remembered to cancel before the expiry period, and they didn't take any money out. This time I'd completely forgotten about it, so they took their money. I expect a lot of other people forget too, which is why it's worth it to them to offer the free trial period.

You could have done what I did when Adrian Flux renewed my car insurance without my consent while i was in Iraq.

Go to your bank and tell them that the two charges are unauthorised and you do not recognise them. Tell the bank that you did not ask for an insurance renewal, and they have taken your money.

Natwest returned my money within two days. As automatic renewals are frowned upon by the FSA.
