When i was knocked off my bike in december i was giving a solicitor for a firm called new law. Should of been a simple case, car pulled out from side road and i go over the bonnet. It took them 4 months to arrange an assement of the bikes damage and now 7 months on, despite numerous phone calls and emails from me badgering them i still dont know if its a write off, she just says she will have to write to the other guys insurance who arranged the assement.
Then i get an offer for just the clothing they are offering me less then what i paid for the leathers and boots, for some reason my dickhead solicitor thinks its a good offer because they were about 6 months old Surly age doesnt matter and as i need new leathers and boots i should get the full cost They havent made even mentioned the bike in the offer.

Are they solicitors you went to yourself or were you passed onto them by your insurance 'legal cover'? If they're ones you were passed onto by your insurance then IMO drop them, the only reason you were passed to them is so your insurance company can make money from the referral.
In Reading, Boyes Turner Claims are very good. If the ones you're with are pissing you around then speaking to other solicitors would seem a good idea. |

They were passed onto me by insurance, i will try boyes turner and see what he thinks about the case, i just want it sorted so i can get another bike.

Clanger how much did you get if you dont mind me asking? I know your injuries were serious and mine were not but im curious.
I rang my solicitors supervisor on friday and literally said shes taking the piss. apparently the guy who assessed the bike hasnt submitted the report.....This is now 5 months since he came out I cant believe they are not pushing harder tbh.
Emailed a couple of other solicitors now but i dont want to start it all again really.
Been without transport for 7 months now yet they say i can only claim for around 3 months loss of use, is that a piss take or not anyone know?

It can be a very long and depressing wait !
As for your gear, they won't pay out much for 'used' boots and leathers - even ifs its a few months. But I got told by my solicitor they have to give you the full amount back for your helmet, no matter how old that is, but i pressume that hasent been claimed for ?
Looking at your dates now i spose that is a bit of a piss take, i take it that their insurance is refusing to cough up ? Have you tried chasing your solicitor up regulary ? I used to call mine at least once a week, to find out what the situation was.
Mine took 5 months to become completely solved. But the guy who hit me, admitted it was his fault the whole time (which should of sped the process up )
Oh and i also had a hire bike, so the longer they waited to pay out, the more it cost them. Did you not apply for a hire bike ? Even if you don't ride it, it should speed the process up. ____________________ Rides: '05 Yammy WR290-F |

Im claiming for the helmet which is as you said the one thing they offer full price for. Wasnt sure about other gear but at least i know its not just me. Been chasing them up yeah.
Its the usual story guy knocked me off accpeted blame at the scene even told the copper it was his fault then when it comes to insurance time apparently i was speeding, doing illegal manuevers ect.

I didnt have any problems with new law.

The fact that his insurance assessed the bike rather than yours tells me liablity has already been decided in your favour. Now the arguing is simply about payout.
The longer they drag it out, the more likely you are to accept a miserly offer.
Its time for you to get off your arse and force them into an offer.
1 Contact your finance company, seeing as they actually own the bike ATM I am sure they will be able to put pressure on the insurers.
2 Insist on a hire bike. Do not take no for an answer.
3 I assume the bike is at your house, and is unusable. Therefore it is only fair you charge them for storage. £12 per day is about the going rate.
4.Call your insurance 3 times a day, and your solicitor. They are paid to advise you and work on your behalf. Make them earn that money.
5 Call his insurance 3 times a day. Ask for updates, be a pain in the arse. The first time they refuse to give info "due to the data protection act" turn it back on them. You are entitled to copies of all info they hold on you, at an admin cost (usually £10). They must reply with this info by law, and within 40 days of request. It is a major pain in the ass for them to do (all phonecalls you make to them will be recorded and thus must be transcribed and sent to you) and comes with a 5k fine if they do not comply.
6 Boots/Leathers, I believe you are justified in wanting new if they were less than 6 months old. Simply point out you should not be out of pocket from the accident and you require boots/leathers of the same safety standard. Hard to get cheaper which they can prove are as good.
7. What was your personal injuries? If none, then its about time you started dropping hints that your back/shoulders are starting to play up. You might want to say its getting bad enough that you may have to get it assessed by the doctor. Funny how a lot of claims are settled in full quickly when there is a possibility of ongoing health problems.
In summary, if its taking too long, YOU do something about it, make it easier to settle now than put up with you indefinately.

1. Contacted finance company they just said i have to keep paying it till other guys insurance do.
2 Going to give that a go in the morning, who am i best off calling? his insurance company?
3. Is that possible?

5. Ill give that a go as well
6.Boots and leathers were straight on the 6month dot when the accident happend so ill keep pushing.
7. Been checked over for personal injuries already and the claim for that has been agreed.
