Just wondering...

Went to a petrol station today, and there were a few things i picked up on...

1, the area beside the pump was covered in diesel, told the lass beside the pump (yes, she did work there), and she said 'ok' and walked away...

2, the surface was pretty crap, there was holes all over the place

I put the CG on it's centre stand, and it nearly went over.

Luckily it didn't *cough*blindweezy*cough*

If it did, due to their lack of upkeep of the road and the diesel spills which i nearly slipped on (boots don't like slippy surfaces Laughing), would i be able to claim money for damage caused to the bike?

Or would it be my own fault for putting the bike on it's stand in the first place?

On a side note, mr broon, did you pass myself and blindweezy on that yellow beemer of yours? just down from the royal...

Also...

Do you ever get asked to take your lid off when you go to pay?

Always expect it to be slippery around pumps.........

Yes, you would. They owe you a duty of care under the Property Owners Liability Act 1972.

The garage will have a Public Liability policy that you would be able to claim against.

Yes, you would. They owe you a duty of care under the Property Owners Liability Act 1972.

The garage will have a Public Liability policy that you would be able to claim against.

3 options really:
1) If you have Legal Expenses cover bolted onto your own bike policy then you can use this to instruct solicitors to make the claim on your behalf
2) If you don't have L/E then you can write to the manager of the garage and present the claim direct. They will forward this notification to their insurers who will then contact you for full info and most likely a bit of a bish bash aiming towards repudiation which you'll have to be a bit smart to avoid happening
3) You can take your claim to an Uninsured Loss Recovery "expert" solicitors firm on the ol' no win no fee basis and let them do the work again.

don't use legal expenses cover if for some reason you have it. all it does is earn the insurance company money from the no win no fee solicitors they refer you to. so you pay extra, for them to refer you to solicitors who pay them for the referral.

instead, choose the solicitors yourself looking for ones that are good at what you need.

so don't bother taking out legal expenses cover because you don't gain anything by it, all it gets you is the services of a solicitor you could get the same service from by approaching them yourself.

not really sure what to do, i have legal cover but i'm only 3rd party as well but i could just try to source the parts my self but i think its going to be expensive ish

you having tpo is irrelevant if claiming from someone elses insurance, as it would be their insurance paying and nothing to do with yours

I agree, but its hard to not have legal cover nowadays. Most insurance companies provide it in with their cover and claim they give you it free.
Of course we all know that the cost of this legal cover is incorporated into their premiums.

erm my mirror frame was bent badly, broke brake lever, a big crack down my front visor fairing and snapped where it bent as well on the mirror

Agree on not buying it (indeed I never have) but he's already paid for it so it makes things very straight forward for him. There's no extra to pay, the only person that'll have to pay is the garage's insurer who'll have to pick up all the legal "fees"

personally, i'd rather use a solicitor who is choosen because they're good, rather than one choosen because they pay your insurance company for making the referral.

legal expenses cover is an easy way to get a solicitor taking your case, but on the same logic you could just choose the first one listed in yellow pages. that would be just as clever as using the one from legal expenses cover, it might actually be a better idea cos that way your insurance company don't make money for referring you

it still won't cost anything as you'll be able to get solicitors on a no win no fee basis and the bill would be paid by the insurance company you're claiming from.
