Got reveresed into while riding, now what?

As my ER5 won't start my Dad very kindly allowed me to borrow his suzuki SV650. I'm covered on any insured bike with my policy so its all legit and everything, plus I have the full license to ride it.

On my way to work this morning I pulled onto the industrial estate as usual. Up ahead I see a black van, I catch up on it slightly but hold a fairly long distance from it, about 2-3 car lengths at least if not more.

Suddenly he stops and I stop too unsure of what he is going to do next. His reverse lights come on, I again hesitate as I'm unsure what he is planning on doing. I'm still about 3 car lengths behind him and can see both of his mirrors, with my headlight on. Suddenly he starts reversing, I think feck so I put the horn on. He keeps reversing and is going at some pace. I realise there is no way he is going to stop so I attempt to move out of the way but there isn't enough time and crash he hits me straight into the front wheel. He stopped before he totally flattened me. I also managed to hold the bike up and I am not hurt at all luckily.

The damage to the bike is bent forks, damaged fairing and destroyed mud guard. Apart from that it looks ok but I am no expert in this.

The guy admitted it was his fault and said that he would pay for everything but he thought that it may have to go through insurance.

My question is what do I do now, do I have to contact my insurers or does my dad have to contact his? Or do neither need to be involved and could I just go straight to the van drivers insurers. Also can I get it to a garage now or do I need to wait for an assessor?

Were there any witnesses and did you get their details?

It's possible that he will claim you rode into the back of him.

contact him first to ask if he wants ti settle it privately or through insurance.

if insurance then you'll either need to contact his insurance or you'll need to instruct solicitors to act for you. you do not need to contact your own insurance since it isn't your insurance that you'll be claiming from.

no point taking it to a garage for assessment cos it'll have to be taken to one the insurance company use.

I did sound the horn when he started reversing all the way up to the point that he hit me and after he had hit me. I did say that in my post but all the same.

I tried calling my insurance but they are closed at the moment which isn't much help. I was also hit by a company van so I can't get through to them at the moment but I will deal with that tomorrow.

Hoping he will just pay for the repairs himself.

you need to contact your insurance and log a notification only claim, which means basically you are making them aware of the accident but not claiming.

otherwise he can claim you hit him and your insurance will settle it as your fault if they dont have your side of the story(that what my insurance told me when i had a bump earlier this year)

Then contact him and find out whether he want to go through the insurance or not, then you can either start a claim against him or start pricing up the cost of the repair

The bike is an SV650, and the van was going pretty fast in reverse when he hit me. I'm not that big a guy so I'm not sure. It looks like its just the one fork that is damaged.

I will have to get them out of the bike to see what the actual damage is too them, its possible they might be able to be bent back into shape.

Either way I've just spoken to the guy on the phone and he said as long as the cost isn't massive he will be willing to pay for it himself otherwise he says he'll put it through his insurance. So it should get sorted out quickly with any joy.

As an aside my dad gets back tonight, I'm wondering how he will kill me .

I had the exact same thing happen to me in 2005. I stopped and some fat arsed woman reversed over me.

Your story sounds very familiar, admission of guilt, no witnesses etc etc.

3 years later and it was a witness statement saying 'I saw the red honda motorcycle enter the road and hit the back of the vehicle, I can only assume he didnt see the car in front of him'.

Ended up going 50/50, to say I was totally blazing is an understatement. Going from a clear cut accident with me being all nicey nicey to her statement saying I was abusaive at the scene. Direct Line are not stupid, they played me like a fiddle.

I hope yours can go better but assume nothing.

If anyone is interested the guy finally paid up in full for the repairs, only came to about £400 for it all. Which was fortunate as I was starting to go through insurance to get the money back. My dad's decided he isn't keeping the bike and is going to swap it in for an Aprilia Dorsoduro.
