My money would be on a ban. Are you on a CBT or A2?

If on an A2, 6 points or means your licence will be revoked, which is better than a ban, as you can retake the CBT and test, and get it straight back (with the points still on it btw).

That's what makes me think you'll get a ban. Points + a revoke would be too easy to get around. 3x the limit is really taking the piss!

Where was it, what time of day (or night)? Copper or camera?

And why? Confused Why do that speed in a 30? 50~60 in a 30 is pushing your luck enough as it is! Keep 70+ for open roads!

You are facing an iminent need for good, professional legal advice.

That far over the limit, they might go for a Dangerous Driving charge.

People have been sucessfully prosecuted for DD for doing 120 in a 60 limit and I'd say 90 in a 30 is the same ballpark (60 over the posted limit) if not worse.

This is bad because DD is a CRIMINAL offence. If sucessfully prosecuted you get a criminal record.

A guy caught doing 120mph by a roadside camera on his Blackbird on an A road was jailed for 6 months and got an 18 moth ban earlier this year. His case was complicated by having a minor riding pillion but a custodial sentence could still be on the cards. LINK

So. If they prosecute for the speeding offence only, take your ban, 6 points and hefty fine and thank your lucky stars!

Think the main reason that guy got jail time was because apart from the excessive speed, he had a young pillion riding without full kit, in the rain!

Also, it was a 'busa, not a 'bird.

The torque of the Blackbird would have reversed the earths rotation, making the camera register -122mph and result in him being knighted, and sent a large cheque in the post. His son would have got a happy meal and an umbrella. He would also have won a Noble Epic Win award. They all lived happily ever after.

I only work on the Scottish legal system, however its not that much different in these cases.

Personally, doing 90 in a 30 probably means you were speeding through a built up area, in which case I would want to prosecute you for dangerous driving, impose a ban and a custodial sentence that may be suspended on terms.

However thats worst case, but better looking at worst case and being thankful for anything better.

60mph above the limit is bad enough in most cases however doing it in a 30 is the worst possible speeding offence you can get next to being under the influence.

you're gonna get bum raped Shocked

how were you caught? what was the road like? was it outside a school, a quiet residential road, any parked cars/pedestrians/kittens, or was it a 30 at the end of a dual carriage way where its a 30 limit for a while before the road goes through a village?

pepipoo will be helpful, but tbh you're probably wanting help in choosing a good lawyer rather than anything else. Neutral

Forget pepipoo, the only thing that will help you is the cop who stopped you drops dead of a heart attack before he does the report or he makes a procedural error which is more likely going to require a solicitor to pick up on.

This is not about a justice issue which pepipoo helps with, its a simple "you broke the law".

It was about 3am in the morning. Nobody about. Down a high street. Not sure on the speed but after the flash I braked and looked down after about 2 seconds and I was doing 60 so I'm guessing it's around 90 the speed.

Just waiting for the post now.

The problem with it being reported stolen so you can say "Oh no Mr. Gatso man, it wasn't me, someone had stolen it!" is proof.

You'll need witnesses as to where it was at the time of the incident which is quite difficult if it was at 3am and also do you know anyone that'd be willing to lie to a court facing the risk that if they DID find out it was you would be willing to go down for perverting the court of justice?

Just about the only plead you could make is conditions, 3am, no-one around and you were in a rush as you needed the bog (Laughing). Could hope it reduces the verdict slightly (Only the prison bitch of one bubba, not two Wink). But as previously said, 60mph over the limit could well be done as dangerous driving which is a lot more serious.

Good luck, I hope it turns out better than we expect. Sad

When the speed is in excess of 40% of the limit, there is a risk of an instant driving ban.

I would not even think about saying the bike was nicked.... If the pic shows the rider and your gear, and the police check your house and gear. Oh dear attempting to pervert the course of justice...

They don't change the films on those fixed speed camera's everyday, so you may have time to go in and drill a hole in the side of it, get self expanding foam that builders use and destroy it before the police come and check for criminals.

Going off what Clarkson said on top gear, the expanding foam will totally destroy the camera.

https://www.toolstation.com/shop/Adhesives+Sealants/Expanding+Foam/d180/sd2857

£4.22 a can. Laughing Thumbs Up

Granted though you may get done for criminal damage on top of you speeding charge. But it's a choice.

Ha ha, really? Mad one... how about magnets? Don't know how it would work but magnets tend to screw with digital and wipe everything. Or just tie a big ass chain around the camera and rip it out of the ground.

Job done, bish bash bosh

As far as I'm aware, they don't store the data in the cameras, they are all hooked upto a big network...

The whole idea being to stop people bothering destroying cameras, or at the least, catch them regardless.
