Let’s say I’m riding unrestricted bike, on my A2 licence, and I get pulled off my police, and they really want to take my bike for a test…

And it turns out that it has not been restricted. I have valid insurance, and tax though.

What is the actual penalty for it?

I think it would just be driving otherwise than in accordance with a licence which is 3-6 points. Thinking Not sure if it invalidates the insurance though as in an accident the insurance company would pay out and then screw you for it ( it has been covered a few times by people more knowledgable than I )

If I remember correctly they tend to prosecute for one offence and issue no further action on the second anyway.

This could all be wrong as it's from memory of what I have read as opposed to personal experiance.

They could take you to court and it could be custodial

You would need to be a Grade A cock or have previous record with the police for similar crimes / motor crimes


Most likely 6 points and a fine for no insurance or no licence (riding outside of license invalidates insurance)

Could be a ban.


Not sure if the court process would effect current / future job prospects, depends on your current / future career choices. Smile
It would effect most public sector careers in one way or another

At a guess, the two offences that would affect you would be:

code:LC20
offence:Driving otherwise than in accordance with a licence
points:3-6

and possibly (since your not driving in accordance with your license, your insurance becomes invalid):

code:IN10
offence:Using a vehicle uninsured against third party risks.
points:6-8

as you can see, (if these are indeed the two that affect you) you could lose your license on just one of those offences, with a chance of a fine and a ban.

ofcourse they are quite unlikely to find out. but this is probably the worst case scenario

Of course there is also the fact your bike will be impounded, and incure all the lovely charges that they impose for storing your bike...

Best case scenario: Nobody notices even if you do get pulled over (dont do silly speeds) and you enjoy your bike more for these two years and nothing goes wrong. You also save money on the restriction business.

The only real way you 'might' get caught is if your nailed for speeding doing over 110ish . .

i've got a year to go on my restriction, been pulled 3 times, twice they did a license check and not once did the copper over the radio mention any restricton.

i also did a trackday at cadwell park a few weeks ago, i had previously done one at Donington where you can sign on the form 'you forgot your license' but here they were checking them, so i told them i forgot my license, they phoned the dvla up and checked, and it came back i had a full license and i was on my way Thumbs Up

even if a copper did ask me, they probably wouldn't know where to look or anything anyway. fuckit, enjoy your bike, properly

i was also under the impression that, if your on an a2 license, its only valid if your on a bike less than 33bhp for 2 years, then anything.

if you go about cruising on something over 33bhp within those 2 years, your license is invalid, and thus, so is your insurance (since you technically have no license to drive what you would be driving).

edit: i think i just twigged on with what you was trying to say. while they are obliged to cover 3rd party, i believe (im not 100%) they can refuse to pay out, and leave it all on you, if they find you was riding without a restrictor kit.

Driving and or riding something which doesn't have an entitlement on your licence (greater than 33bhp on a restricted licence for example) will invalidate your insurance.

As somone as said, I prefer to think about the 'best case scenario'. Smile.

Why if they didn't asked about type of licence? There only choise I had while insuring bike was provisional or full UK.

Nothing mentioned about restrictions or specific type of license...

If you check your insurance document it will say that you have to hold a valid licence that allows you to drive/ ride the vehicle. If your licence is restricted it will mean the bike has to be.

You can insure a big bike with a provisional licence but you would still have to conform to the riding rules ie: accompanied and the rest for it to be legal. They put the onus on you to comply with legality.

They are obliged to cover you even if you have tpft. They will just have an excuse to come after you to reclaim their expenses though.

This. People keep saying that your insurance is invalid if you commit various other offences. It's bollocks. The insurance company may say your policy is invalid. They will definitely anally penetrate you next time you're due for renewal.

However, if you have a policy, in your name, for that bike, they are obliged to offer the statutory minimum insurance - i.e. third party.

In practice, this means they will pay out to the third party, and might send you a bill for whatever they had to pay out. If they do, then as far as your wallet is concerned it's the same as not having insurance. As far as the police are concerned though, you are insured.
