Guys,

Some silly bint in an Audi A2 rear ended my DR-Z400 the other night, and I've told my insurance about it.

Being a DR-Z400E, the bike isn't road legal from the factory, I've added an Acerbis rear tail/stop unit to the bike.

A local garage have been given the work by the insurer to assess/replace the damaged parts.

Will they replace my aftermarket bits with stock items

i.e. will I end up with a knobbly tyre, a standard tail light with no stop signal on it?

Do I have a leg to stand on for forgetting to actually declare the exact differences my bike has to the stock DR-Z400E?

Theyll repair it to stock,
so id keep quiet, if you do happen to bring it up with insurance with modifications not declared there is a small possibility they couldvoid the policy.

They seem to me to not scream out as the type of modifications to upset a insurer to be honest, more making it roadworthy.

I would be more inclined they would quote to repair / replace like for like and I would certainly expect them to put similar tyres to what you had.

Why would they void the policy if it will be the 3rd party picking up the bill?

I was under the impression that undeclared "performance" mods were the only things that would void insurance claims.

Cant see a different tail end being a problem but i could be wrong.

I was under the impression although it may not be his claim, when you take out a insurance policy and it asks for "any" mods. that if you say no your agreeing into a contract saying it has well no mods. so youve broken your end of the contract so they could void it?

My experience is that they may ask for a additional premium from you for non disclosed mods. But my history is car insurance - maybe motorcycle insurers are different. Insurers are not always the 'cancel at the easiest opportunity' companies some people would have you think.

If the motorcycle in question comes, as standard, not fit for UK roads and they are providing insurance, then wouldnt their expectation be that the bike has been made fit for UK roads. I.E adding a brake light and suitable road tyres.

If you're claiming off your insurance who are then trying to claim off the other driver, then there may be an issue.
If you're claiming straight from the other driver, there shouldn't be an issue.

When my bike was assessed, at my house I went through all the mods and they where included in the value.

Going back a few years now so goalposts may have changed bit...

Had a smash in the car which had aftermarket fogs. They'd been on since I bought the car so as far as I was concerned came with it.
I contacted the insurance company and after asking was assured that the car would be fixed as it was before the accident.
Lo and behold car came back without fogs.
So sent it back (well dropped it off) cancelled the excess payment and complained to the garage and the insurance.
This was easier as steering wheel was daubed with paint, so obviously not a very professional job.

Comeback was an angry phone call from the garage manager demanding the payment.
So complained again to the MD of the company about being asked for money with menaces and letter to insurance for employing such cowboys in the first place.

Got an apology from the garage MD and car back with fogs as promised.

Not saying you'll have the hassle but if I was you I'd insist bike back as it was before accident. Obviously the wirings there so if they're not fitting what should be on it then you can ask why?

I got rear ended by some woman in 2006, at the time i had a scorpion can fitted that my insurance company didnt know about. Since i was claiming off of her i just rang the place that had my bike and asked them to replace the can with a scorpion, they said no problem. No issues what so ever, might be if i was claiming off of my own though. Wink
