Suspended for doing my job?????

Ok, this is my first auntie post and felt the need to get this off my chest as its now 5.55am and i've been up all night thinking about it.

On 19/08/2009 i was called into the operations managers office (I am currently a prison officer in a privately run cat b male jail), in the office was the unit manager, ops manager and a union rep. Whats all this about thinks I??

Turns out that mooserx is now suspended from work indefinately, pending investigation into an accusation of, assault and excessive force used in the spontanious removal of a prisoner.

What this basically means is that, I have to give statements to the prison investigations officer as does the inmate, and my 2 colleagues (who by the way, are not suspended). If after the investigation i am found to be guilty of the said accusations, then i could be facing disciplinary action (which means i will be fired) and criminal charges!

WTF!!!!111!!111

So as it stands i'm looking at sitting around for god knows how long fretting and worrying about a)possibly losing my job, and b) earning myself a nice assault charge for doing my job properly.

Unless you were jumping on his head I'd be amazed if anything gets done against you, and the guy is just trying to get some leverage.

Not in the slightest, what occured is thus. Said inmate was intoxicated and had physically attacked a colleague of mine, who then pressed his alarm button on his radio, being one of the first on the scene (as i was a first responder) meant, for the safety of inmate and staff member i had to use physical force to restrain said inmate.

Looking at this without knowing the people or exact circumstances....
I would think if your Control and Restraint is up to date and you, within the circumstances of the situation, demonstrated following such then there should be no comeback.
Oh and I agree with the suggestion to PM Mr. James. When not trying to fit into his black uniform with those 2 lightning stripes on the collar and skull on the cap badge he does actually make sense

Might be worth having a chat with the union rep as there will no doubt be a history of such accusations. Should be able to give you an insight into the workings and current thinking.

In honesty sounds to me like a Saturday night on the town incident, i.e. drunk person being violent accuses officer of excessive force when restrained. How many of those have you heard about the officer being sacked?

You CANNOT be called into a disciplinary hearing without being given notice, and you MUST be given the chance to bring an independant witness. Obviously this is usually the Union Rep, however they invited him there, not you. They are breaching their own disciplinary procedures, so either they have already decided there is no case to answer so are going through the motions, or they have fucked up and the case will collapse at appeal.

sounds like they're following procedure, nothing more, and if no-one backs up what the inmate claims, you'll be ok. the truth should prevail. did the inmate have any injuries?

Just one question, are you a member of your union?

I'm pretty sure HM prisons are covered by PCS. If you are a member then get in touch with them as soon as you can and they will fight this for you!!

They will give you free advice, legal counsel, and represent you in court.
