I like the way even though the riders in obvious pain.. and he 'rushes' over to help
How the hell does he not realise as he's pulling out...I can kind of understand it if he pullled out really quickly....but it's really slow.

Unfortunately as much as the driver is an utter blind moron and shouldnt be on the road the rider didnt exactly make himself easy to be seen.
Right side of the road, too close to the car in front. The car that hit him wouldnt have seen him until they had already started pulling out.
In those situations I always; when I spy a car waiting to pull out of a left junction, move over to the left of the road. This way the car will see me just like they'd see the left side of a car normally. When I get to the junction I move back out to the right (to give myself some leeway)
It's little things like this that make it easier for you to be seen and make things safer for yourself.
I'm not saying the car has any excuse at all for not seeing the biker; I'm just saying as bikers we cant trust anyone and must do what we can to make our presence as known as possible. (I'm talking road positioning here, I'm not one of the hi-viz brigade ) ____________________ CBR954RR - Daily toy

I was taught to move to towards the middle of the road at junctions....so his road position was fine.
Was just like the driver didnt look infront of him when he pulled out  |

Doesn't look too close to me. He also had his lights on and high viz vest. Not to mention he on a big bloody motorbike in the middle of the road doing the speed limit.
I don't think he looked right after the blue/black car went past.

Well, did I do wrong?
No, I don't think I did. Strange but neither the police, the magistrates nor the lawyers who looked at the CCTV footage think I had done anything wrong at all, maybe that's why the driver was charged with and found guilty of careless driving.
I've not long passed my test (August 2008) and I was riding the way I was taught, in other words just to the right of the middle of the lane until you move over to the side depending upon the way you are turning at a junction. If I had moved over to the left to be 'more visible' and then moved back to the right I would probably have been accused of erratic driving! Besides, I was able to clearly watch the car as I approached the junction and believed that the driver had seen me, I then moved my attention to the car next to him and then it happened and I just did not have time to react or do anything to avoid being hit.
As the posting by Luke shows I was about 2 seconds behind the driver in front and in the correct position in the road for turning right at the next junction, just after the pub. The car driver just wasn't paying attention which is probably why his brake lights don't even go on until well after he's hit me. He then slowly sauntered across, but never made any apology to me for hitting me. In fact his mother came along later demanding to know where I had come from!
I could also show you a clip of the footage shortly afterwards which shows the car driver having a smoke and a laugh at the side of the road, still obviously not interested in what he's just done to me, but I think that would be against his rights to have his face shown!
Thank you to all those who agree that I did nothing wrong. I mean I had an ultrabright headlamp bulb fitted, reflective hi-vis vest on, reflective wheel stripes and reflective stickers on the bike ... what more could I do?
Oh, and for my troubles I "walked away" (so to speak) with my tibia fractured in 1 place, my fibula fractured in 2 places and my heel bone fractured. That was on March 6th and I went back to work on September 2nd. All I can say to that is thank God that I was wearing bike boots and not trainers!
Oh, and yes, I have bought myself another bike, I wasn't going to let that swine put me off biking!

It's good to hear that you walked away from it and the guy got what he deserved. It says something about a person if they hit someone and after that have a laugh about it..weird.
It's a good thing you had a CCTV footage to back you up as it's clearly visible on it that you've done everything as expected.
I don't think if you could've made yourself more visible by swinging to the left then back to the right. |

It's strange how the only people who seemed interested in helping were the blokes from the pub who came running out. The driver wandered over, his passenger walked the opposite direction and the other cars look like they had a good look then drove off.
I can't be the only one who would have jumped out of their car to help the biker as quickly as possible. Maybe it's because I'm a biker as well...who knows... ____________________ MKGaming.com

So many sentences are doled out to bikers, on the basis of "what if". What if there were kids in the road, what if you crashed, what if there was a fresh placenta covered litter of fucking kittens sitting between the cat's eyes? This time, someone has actually been seriously hurt, and they give him 5 points? The same justice system that gave a man 2 years for doing 144mph and not hurting anyone?
