So my younger brother hit a mirror of a car over the white lines whilst overtaking in traffic, said he took it right off hanging on the door, but he kept going as he didn't want an angry man chasing him around his bike.

Law stands on this? \ It happened last week, nothing yet - all clear? Doubt the bloke sat in his car got the plate either.

Probably got away with it if he didnt hang around long enough to get his details taken down.......but "do unto others as you would have done to yourself".
He should`ve pulled up,apologised...and bought the guy a new mirror.

He hit another vehicle = an RTC = legal obligation to stop and exchange details, regardless of whether he was committing another offence (on his mobile, drink driving, etc) or not.

If there is an injury to another as a result of the accident or if you don't stop at the scene then you must report the accident to police within 24hrs.

Basically by not stopping or reporting it to the plod he's committed an offence in itself.

Thats leaving the scene of an accident if the car driver reports it to the police.

knocking mirrors off, deliberately or accidentally, along with any other way of damaging cars/vans (kicking doors, breaking windows, and all the other stuff people show off about) is just as acceptable as a driver driving into a biker, knocking them off and then doing a runner.

so no one should complain about SMIDSY because they did see you, they just thought that you looked like a bit of a twat so decided to knock you off. Mr. Green

This is what i found, but was thinking if it only applied to hitting a person and running off.

well in my car i accidentally got too close to another car, took my own mirror off, little to no damage to his, phoned police because i didnt want to get in shit with his insurance or mine..

Police basically said decide between yourselves, its such a minor offence. So basically if i accidentally take a car one off on my bike, i dont care.. dont hog the white lines..bastards..

Should have stopped and either swapped details or paid for it etc. How's this any diff to some one knocking your bike over and say oh well feck it and driving off. Leaving you with mirrors smashed etc.

MY car mirrors cost a small fortune as they are electric, heated and body coloured. I would be livid if a biker had knocked it off.

And not ALL car drivers hog the lane, I always watch out for bikers and move well over to let them past. But this is not always possible if your tootling along at 3 mph and some idiot filters at 40+mph

If someone is willing to take the chance to squeeze through then they should be willing to pay for any damage they do trying to. I Know I would report anyone that damaged my car through reckless riding or driving if they didn't stop.

Exchanging details after a collision is a legal requirement. The police told you to sort it out yourselves because you'd stopped and swapped details - thus no cause for police action.

Knocking someone's mirror off because you're a shit judge of distance - then fucking off - is not only illegal, it's the sign of a massive cunt.

@OP Your brother isn't in the clear yet - if the other driver got his plate/description and completed a self-reporting collision form at the nick, he gets seven days to hand it in, then it gets sent to a Traffic CJU who will decide what to do about it. It could be weeks or months before they take any action.

FYI we didnt exchange details, the police didnt care. The other guy only stopped cos he was picking up my mirror.
Im not a massive cunt, but if the prick decides to move to the middle of the road to block me getting past, just to be arrogant, fuck his wing mirror..

reckless..i understand that, but i wasnt reckless, if i was just happily filtering and a guy purposefully moved to the middle to stop me, i'd have a bash at getting through anyway... especially as im queued at the dartford crossing every week..im not sitting in 3 miles of tail backs.. its a risk im taking shooting through the middle, not recklessly, but sensibly, if someone gets in the way its not really my fault is it?

IMHO getting mirrors clipped is just part of driving, it is a no fault incident and not worth the grief of stopping. Sometimes your mirror breaks sometimes it is theirs. I have lost a few with Gypsy type flat-backs that are used for pulling caravans and have extended mirrors. No way am I going to stop and argue with a pikey over a 50/50 liability.

i took out a mirror whilst in scotland,
it was almost 2 months before the police turned up at my door,

deny deny deny, is the very best thing, it becomes their word against his, and with out a 3rd party witness they have to let it go,

tell him to be nice if the police turn up, and say that he doesnt remember hitting a mirror but it may be possible.

How can you take a sensible risk? It is your fault as your overtaking them and you should be waiting until it is safe to do so and it's not going to take 3miles until there is a space to pass safely. If you don't know the width of your bike then dont risk it wait for the gap to appear. Your way you are alienating car drivers and also anyone that witnesses your reckless act. Thanks for giving biking a good reputation.

Although I'd like to hope the people taking the morla highground in this case are the same ones condemning the 'mirror removal specialists' in the other thread.

I can't believe the ignorance of some people. I dont think your impatience to pass makes it ok to carry out a manouvre incorrectly, cause damage to someone else vehicle and then ride away thinking you're in the right. If I was sat in my car and someone clipped my mirror without an apology I wouldnt give two shits to see them picking their bike off the deck ten yards down the road.

im not on about maliciously doing it, i could be cruising along down the middle, i suppose you dont see it the way i do..if hes PURPOSELY moved to the white line, and happily sits on it, im more than happy to attempt to go round him..its not being an arse its getting to where i want to be in the time frame i want Sad

Im just stating, if I hit one, it comes off...if i KNOW i was in the wrong and purposely rode too close, i guess i would stop, but ive "clipped" loads of mirrors with my mirrors or my head.. only because they have moved whilst im going through the middle.. bearing in mind this is pretty much standstill traffic..
