Need to reject faulty bike please help.

Hi everyone, my name is Becky, I have signed in on my husbands name as he is the user of this site.
We are having a major problem with rejecting a brand new motorbike. He bought a new bike from a dealer on the 1st october this year. Brought it home, drove it to and from work. Kept it covered when not in use. On the 11th october my husband was checking over the bike and noticed loads of areas starting to rust.... these areas are

Fork brace rusting fork underside on o/s
Frame - between yolk and tank. Bottom of bearing casing that contacts fork brace.
Tank- both lower seams.
All foot pegs
Exhaust pipes- all over various places.
N/s frame support bracket under tank.
Front discs rusting.
Handle bars where it meets yolk.
Now this was enough for my husband to become very concerned that the bike was no fit for purpose and was of unsatisfactory quality.
He was going to contact the dealer the next day (Monday) and reject the bike.
He rode the bike to work the following day and upon pulling into his workplace he lost the gears on the bike. The gear linkage has broken. The radiator is leaking and the choke is inoperative.
My husband rang the dealer that day and the dealer was abusive to him over the phone. He will not hear of us rejecting the bike. We have contacted the motorcycle finance company with whom we have the bike loan and they told us the dealer needs to cancel the agreement.
The dealer is ignoring our calls and emails.. we have contacted consumer direct, who advised us to contact dealer, but he is ignoring us what do we do...please please help...

Yes I have to admit it is a chinese bike.....hadn't heard any bad reviews until now.....AJS Nac 12....

Go to Trading standards, Citizens Advice Bureau. Whatever you do, DO NOT use the bike anymore. Take loads of photo's of all the issues, list all attempts to contact the sellers, write everything down.
Write a letter to the dealers and send it recordered delivery stating the bike is unfit and you want a full refund and they are welcome to come and take the bike back once a full refund has been received. They have a certain time frame in which to reply before you can start court proceedings.

Another thing to do if they are being abusive on the phone is to call and record the conversation.

Good luck and yes, it sounds like every other cheapo Chinese piece of junk...

Edit: Just seen that it is Chinese... and you say you haven't heard any bad things about them!? Where have you been all these years!

I agree, trading standards and citizens advice bureau is your best bet. However, chinese bikes are like that. That's how these dealers make their money. I hope you didn't pay too much for it. And tell all your friends to stay away from them in the future too

We 're 'pissy' too because we thought the name 'AJS' was a name to trust, obviously not anymore.....thanks guys for your help...I have a lot of emails, letters and phone calls to make.

They're actually still the same company (according to Wikipedia) but the bikes are made in china.

The finance thing complicates matters, and simplifies them at the same time.

Technically it is the HP companies bike and they are renting it to you. As such it ought to fall under the consumewr credit act (in the same way as if you'd bought it with a credit card).

How you go about dealing with the situation however is not something I'm familiar with. Your local trading standards are the people to speak to for advice. They'll tell you what to say to who and the piece of legislation you are working by.

One piece of advice I can give you is stop phoning people. Put everything in writing from here on in, keep a copy, send it recorded delivery, staple the recorded delivery chit to the copy. If they insist on responding by phone, write down what was discussed and by whom and send them a copy in the form of a memo in the same way.

I think the best advice we can give here is:

Don't buy a chinese bike.

The dealers aren't real dealers as such, they are merely people who buy the chinese junk in bulk from containers. There is no real manufacturer backup like there is with a known manufacturer such as BMW Honda Kawasaki Suzuki Yamaha Ducati etc etc.

The Bike mags have said that a couple of manufacturers are OK, and they are Superbyke and Megelli. And By OK I mean they only break after three months rather than three days I guess.

In short, the Chinese have no background in engineering like the Japanese did when they got into the bike market. All they do is copy stuff. As in the case of Megelli British engineers design the bikes, and then they are made in China with substandard materials.

AJS is merely (afaik) a branding of chinese copies of copies of 1970's and 1980's Japanese bikes.

Based on advice from trading standards when we have had problems in the past- you need to write a formal letter to where you got the bike from, explaining everything and all the problems with it. Also ask for a response within, for example, 7 working days or whatever. The bike is not fit for purpose etc
Make sure you have proof of doing this ie recorded delivery.
Yep chinese bikes are crap, but they should last a little bit longer! the more fuss you kick up, the further you will get.

I would also be copying them into every letter you send. I would advise special delivery at the moment as best understanding is if the PO workers strike they will still be delivered.

They will be trying to make you do all the work to get the bike rejected. Which is fair enough, but if the dealer won't play ball then they have more clout to get him to act.
