Here is the story

Sold my trusty pedda in January.
Sent off V5.

Never heard anything back from them until today.
Letter asking for £80 for not SORNing it. £40 if I pay sooner.

Is there anything I can do?

The letter makes it sound like no matter what I do, it's my fault and I must pay the fine.

Hi

Seems to depend on how much you are prepared to push it.

From what Sickpup says you are legally deemed to have complied by posting it, whether they receive it or lose it is irrelevant.

However getting the DVLA to admit this will be difficult.

See sickpup's thread about his case, if you are lucky he will share the rest of his case with you and you can shit all over them.

TBH, £40 versus the epic hassle doesn't seem worth it.

Besides, if I lost then it would cost more and I only work 10 hours a week due to college so money is tight.

I might give them a ring tomorrow and see what they say.

This happens a lot, the DVLA can be a bit of a black hole for documents.

Write them a letter acknowledging their letter and explaining that you sold the vehicle on X date to X person of X address, and that you sent the V5 at the time in to notify them.

Usually they don't pursue the matter with you and will write to the new keeper, as far as I'm aware, but this doesn't happen in all cases. It is unfair for you to have to pay a pointless fine when you've done your duty and sent the V5 in, and it's the new keeper who has failed to SORN/tax the bike.

Tell the low-life extorting scum you'll see them in court. On the day take details of Sickpup's case, tell the court you sent the paperwork, job done.

ha! they quite promptly replied to me confirming receipt of my license after my seizure! Two faced scum bags they are!

Sweet?

I deal with the DVLA virtually every day and the above is what I advise my customers to do when the DVLA loses a document. If you can give them all the information they wanted in the first place, they will often accept the explanation.

I do understand that this is also the agency who decided to renew many licences with entitlements missing and pretend they never existed in the first place. Which is why my first post said "usually"... they don't always play the game.
