That's nothing new. Since the Highways Act of 1835 at least (if not before) that situation has existed. If you own land and people move over it without you objecting, it will eventually become public highway (20 years under the Act, less under common law). You are deemed to have dedicated it by not objecting. That means the highway authority own as much of the top surface as they need to maintain it. Traditionally the top two spits (spade depths).

That's why if you go through some private developments you will see signs saying that there is no intention to dedicate the way and they close it every so often.

If it were me. I'd go right out and put a fence round my bit.

I would also write to the council informing them that I was wirthdrawing their implied right of access to my land and would deem any council officials, employees or agents on said land to be committing tresspass. Should they be found trespassing, they would be asked to leave once before being forcibly removed.

See how they like them apples.

I believe they have to issue some sort of document at the start of that 20 year period before this is legally enforceable?

There is a "cut through" on the corner of our local rugby club playing fields which has been used as a footpath since the late 1950's. The council tried, unsucessfully to make it a public footpath recently. It has since been fenced off.

I'm pretty sure that him having marked the boundary (with flower pots in this case) is significant although that may be just under Scottish law. I know there are several places in Edinburgh where part of the pavement is actually owned by the building owner (especially over pub cellars), they mark the boundry with little brass insets. You can park in them and the council can do fuck-all about it.

No documents required, just use by the public at large without asking permission, sneaking through at night or using it to access their workplace. The dedication is presumed. If the dedication is given without presumption then lots of paperwork is involved, i.e. the section 38 dedications you get on new build housing estates by the likes of Barratt and Wimpey. These are constructed to the highway authority standards and usually adopted as public after a year.

If it wasn't for presumed dedication most roads in England wouldn't be in existence. Fencing as someone said, or as you said brass studs, is evidence of the land owner not dedicating it so it couldn't become highway.

When I was at the University of Kent at Canterbury I have a vague recollection they had to close the road across campus for 1 day a year or something to stop it losing its status as a private road.

That sounds like the sort of thing.

Some public highways are maintained privately. In the days before tarmac when the road got muddy, say across an open common, people would just walk, ride or drive around it. When land was enclosed the roads would get hedged by the new landowners to keep the oiks off it. As the new landowners benefitted from the enclosure and the public could no longer go round the cack and mud, the enclosure award would state that a particular landowner would be responsible for keeping the road in good order.

Since when is £50k a lot of money. You can earn about £16k being a till oeprator in a shop. Are you saying that training for a minimum of 7 years, self financed, and being responsible for other people's lives not worth more than double that of a brainless till oeprator?
