PostPosted: 16:15 - 02 Feb 2010    Post subject: A2 Module 2 test unfair decision Reply with quote

Well lets start the story,in november I did my module 2 test and I failed because I was under the speed all the times,(fair enough, the speedo was way out).In the meantime I sold my NSR125.I did today my module 2 test again,on a hired Yamaha YBR125 and failed again, because the examiner said I parked on a solid white line. What I actually did is I parked in a car park, with no lines whatsoever ,did the lifesavers ,indicators, mirrors and all that(thats one major).
I have a picture on my phone to prove. Also he said I lost balance during 2 lifesavers but I didn`t,it was bloody windy today, very wet and freezing, and the poor ybr 125 struggled to reach 55 mph.(2 majors)
He also said that I haven`t done 2 lifesavers when chaning lanes,(fair enough I may forget sometimes)(2 minors)
He advised me not to do so many lifesavers, which I actually did when it was necessary.
After the test i went to that place where i parked and took a picture to show him, came back to the test centre told him and he said"it was a solid white line"anyway I don`t discuss tests.
Went to take the bike to the people i`ve hired it from, they do cbt and training. They asked me if I passed or Failed ,told them I failed and they asked me why,I showed them the green paper with the mistakes and they told me they don`t know where I parked.I showed them the picture and they were amazed, and said "that is the safest and the most legal place in the world to park a vehicle and you should have passed".After that they told me about the wobbles and one of the instructors asked me if it was windy,I said yes,he said "It looks like the examiner didn`t really like you or your riding style".
What should I do about this unfair decission?
Sorry for my english but I`m shaking because I`m cold and I`m really pissed off.

Book another test if you've got the funds?

I know it's possible to appeal the results of a driving test, but the way I see it is, is that the examiner will find something to fail you on if they don't think you're ready to have a full license. It sucks, but to pass the test you've got to impress the examiner by not wobbling around and not stopping in places that they could say you shouldn't have stopped.

I`ve searched a bit on the net and found out that even I make a complaint I won`t sort out anything.
No funds,I`m gutted,I have to sell my 400 to get a push bike to go to college.
Also IMO i do not wobble around(it was just bloody windy and i was shaking) ,few people told my i really have balance and know what to do in a dangerous positions.
I`ll upload a picture tomorrow with the car park, you will laugh exactly like my dad did.He said"why on earth that car park is not safe, you could have parked a lorry with no problem".
Anyway I can`t change his decision he didn`t like me.
Thanks for your answers.

Crap, sorry to hear that. Try and re-take the test as soon as you can. Some examiners really enjoy their power trips unfortunately... Neutral

That's unlucky to say the least.

Unfortunately there's not much you can do about it - could file a complaint, but meh - so just try to save up some money and do it again.
If you say/know you're up to the standards, then there's not much to worry about as you could easily pass next time.

Seems like the examiner got pissed off due to the rainy/windy day and didn't like something about you.

Have a beer and book another test. Thumbs Up

They're only human and they don't get paid that well I guess.

Tho people who take it out on others shouldn't be examiners/teachers.

Saying that you've failed due to doing too many lifesavers sounds like they didn't like your riding style and had to fail for something.

Also, don't forget that if you do a lifesaver when there's a hazard ahead of you, they can easily fail you as you didn't pay attention to the events ahead. So don't just do lifesavers every second, apply a bit of common sense.

They want you to convince them you can ride safely on your own. If all they see is you're looking left and right over your shoulders all the time..well that can look weird Very Happy.

Just stick with it and get it done. If you're concerned about the examiner try to book a day he doesn't normally work (the training school usually knows stuff like that), or book it elsewhere if you can.

You'll regret it if you give up.

https://www.dft.gov.uk/dvla/contactus/if_things_go_wrong.aspx

Maybe if you complain you can put the instructor in trouble with the DVLA. He might lose his certification (or what ever it's called), you never know. You could just give them a call and see if they have a procedure for people who think their instructor was of a poor standard.

Sorry to hear you had such a harsh examiner, I dont personally think you can ever do too many life savers though!

Some examiners just have bad days where they are so picky. I remember my other half failed his first module 2 for being too cautious on roundabouts- if he went, it might have been a fail too so you cant win with them.

On my module 2, I went around a roundabout- slightly going on the outside of the 40% line- got a minor for this, but he admitted that he didnt have to give me a minor for it wtf!! Was my only fault as well Rolling Eyes

Definitely rebook and try to get a different examiner or different test centre if you live near another one.

Stories like this always makes me wonder about the old rumour about them having to fail a certain amount of people Confused

Good luck with whatever you decide! Thumbs Up

Somewhere on Eastern Avenue, so quite likely to be opposite a driveway? You're not meant to stop opposite a dropped kerb so that might be it. Where ever you stopped, right click on the map, then select "What's here?" as that will put a marker on the map. Smile

"the examiner said I parked on a solid white line. What I actually did is I parked in a car park, with no lines whatsoever"

There aren't any car parks or solid white lines there, it's just a street. Smile

WTF? Why try and make his instructor lose his job? But the DVLA don't really come into it at all, it's nothing to do with them. Tests are done by the DSA and driving instructors are also licensed by the DSA, it's nothing to with the DVLA. Wink

You know what I meant Razz and anyway, I'm sure they'd simply examine him again and if he really was unprofessional he would rightly lose his job. That is, if he's being made out to be as unfair as he is. Otherwise no harm done. Just giving options you know!

I failed quite a few mod2, being young and fool hardy, i thought everytime was unfair, but i genuinly see that some of the faults were geniuine in being serious and needing more work.

a appeal won't solve anything, the only thing a appeal provides is another retest at their descretion, so if you end up with same examiner again and i guess they get made aware, it may dampen your chances indirectly.

You can indeed fail/marked down for too many lifesavers,
Sitting in traffic upto a roundabout, as everytime you move off your sposed to be doing lifesavers, so in stop start traffic for 2 mins or so, im doing loads, got back and was told it was too many Laughing wasnt undue hesitation, still passed Wink

Lifesavers are a necessary evil, weighing the benefits of looking in your blind spot against looking where you are going - it's perfectly possible to do too many.

That said, some people are just cunts so good luck with your next test buddy.

I find the best thing to do is turn up with a couple of proper bikers. i passed on thursday and turned up with my dad on his Rat Trike so it sort of intimidates the examiner to make sure he has good reasons for failing you. but obviously this may just have been in my head Razz but i felt more confident with him waiting for me at the end.
Also are there any other test centres about.
and its unusual for an examiner to ask you to pull over in a carpark, normally its on the side of the road.
