A woman who drove out in front of a biker on A36 near Southampton has just been found guilty and has lost her licence for 3 years and has been given 120hrs community service.

I guess she has been let off lightly because she rang the police and told them she had pulled out in front of the biker, causing the accident and in court was remorseful and saying she has regular flash backs and doesn't think she ever wants to drive again.

Fortunately I figured this out years ago. Honesty is seldom the bes policy, especially where the law is concerned.

Agreed.

You can't hold her responsible for sentencing guidelines.

Thumbs Up

She didn't murder him. Murder is pre-meditated.

It was manslaughter.

Degrees of manslaughter vary, but it's usually by accident of self defence.

Very vital difference between the two.

Murder? Manslaughter? Where does it say she did it with intent?

Quote:
When a person is killed on the road one of the following offences may have been committed:

* Careless driving or inconsiderate driving
* Causing death by careless driving while under the influence of drink or drugs
* Causing death by careless driving
* Causing death by driving unlicensed, uninsured or disqualified
* Causing death by dangerous driving
*Manslaughter (used mainly where a person intends to cause some harm, e.g. by deliberately driving into someone)

Sentencing varies wildly and never makes any sense. I remember a young asian bloke with no insurance ran over a girl on a pedestrian crossing a few years ago and killed her in Birmingham and got a 12month ban and a fine, that was all, it was late at night and he was just doing some crazy speed down a city road.

You only have to watch a few episodes of road wars or traffic cops to see what a farce the whole system is, "this trouble maker recieved a 2 month ban and a £60 fine for his 30minute high speed police chase, destruction of property, narrowly missing pedestrians and being high on drugs and booze with no licence or insurance".

I never knew that bits of paper make the difference between driving and driving people and killing them.

@Phoenix, yeah for such paltry sentences its almost worth it for the fun of a police chase. Or the thieving chav kids who get a "warning" for nicking a car then ragging it about on public roads.

I remember that. He had been bought a Porsche for his 18th burthday. I therefore suspect the fine was no real punishment and once the 12 month ban was over would have very littl eimpact on his lifestyle.

It sounds as though this woman feels real remose and will probably never really get over what has happened. That's more than enough punishment for anyone... and she probably won't get behind the wheel of a car again either.
