Some of you may remember my thread about a dangerous driving/speeding charge.

I was convicted on the 25 on janurary and given 5 points. 3 days ago (24th) the sentence was reconsidered and it was changed to 3 points (and the fine lowered).

Prior to this conviction I had no points on my licence. I am ALSO out of the two year licence probation period.
On the day I received notice of the new fine/points I also received THIS atrocity.

I'd remove that scan from the post - it has your full name and address on it. Either that or blank the bits out.

Also I am supposed to be doing a bikesafe course tomorrow, do I just declare my points to insurance and then everything is fine until the 29th when my revocation is in effect (as the letter seems to imply).

Ulthar, My answer can only be in the form of 'DVLA are retards'


I am under the impression that if one is given more than 6 points 'in one go' then their license is revoked (different to the totting up ban).
DVLA aren't quite clever enough to realise that when a new sentence is given for the SAME offence one month later, it is safe to say the previous sentence was overturned...

I have letters from the court which tell me the previous sentence and conviction were set aside. I just want to be able to contact the DVLA to yell at them and tell them to actually LOOK at their records before taking away peoples licences.


I am hoping someone has advice concerning what I can do about tomorrow; I am under the impression I still have a license for two more days, but not sure what to do about insurance.

well for one your out of the two year period this means you have 12 points to "play with"

you have only been given 3 so far... so still have 9, unless the court have told you you are banned for X amount of time then you shouldnt be looseing your lisence.

Ring the DVLA and talk to someone.

If you have to sent off the court papers PHOTO COPY them and send them the dupilacate.

I believe there is a different system by which a license is revoked when 6 points or more are received 'in one go'. This seems a likely explanation but they have still made a dumb mistake.


The number on my letter is closed on saturday, I have been spending the last 40 mins trying to get through to another DVLA number which is open on saturdays.

I have scanned copies of all the papers which I can email them immediately if only I can talk to someone.
Anyone with any experience on the matter know if I can still drive for 2 days?

I would say don't do anything, certainly don't send your license back. But make sure you keep all relevant documents/letters in a safe place & to hand in case they take proceedings against you. Thumbs Up

Just a thought, could DVLA have thought the reduction to 3 was to be added on to the original instead of replacing them - making 8 for the single offence.

Again, retards if that's true. Perhaps get some advice from CAB (not sure if they deal with driving offences but worth a shot)

yup CBTblack that is what the lady on the phone said when I finally got through.


But supposedly I need to send them a letter asking them to check with the court how many points they ACTUALLY gave me for that offence.

Me asking them on the phone after answering their 100 security questions isnt enough, nor is me emailing them. They want me to return the letter they sent me about disqualification but supposedly a email containing this letter is not enough. Eugh.

My revocation is not in effect until the 29th and I have declared my points all fine. Didnt mention anything else to insurance.

I will send an email to the people who only work mon-fri (as they are also the only useful people it seems) telling them to check their damn records.

nope as you could be given 11 points in one go ( then drive for a saint for a few years)

personally i would still drive if they have asked for the letter back. ( rememeber to send it recorded DVLA has a habbit of looseing things Rolling Eyes

DVLA lady on the phone seems to think that this '6 points in one go' thing causes a revocation (not ban or disqualification). Then again the date of the offence puts me and just under 1 months before having a licence for 2 years. This was 5 months ago.


So it just seems they think I am a new driver with more than 6 points.

well thast differnt i seem to rememeber that its classed form the date of the offence, not the court date, so in that case you still where a new driver... so you woulod have to be returning your lecense BUT you got lucky and it was reduced

as they are wrong and you have proof, you will be fine to continue riding/dirving without much worry.

Just write to them and send them copies of the evidence.. pretty simple really.

The 5 points wouldn't revoke my licence, because 5 is less than 6 Smile

Yes the date they are going by is my car test, in about 6 months I will have my bike license for two years. But the first test I did is counted for the purposes of the new driver act.


I am going to drive until the 1st of march at least, and I think I should be ok to drive after aswell seeing as far as the courts are concerned I have a ordinary licence. Only the DVLA think it's revoked. I think at least. Might contact someone on monday just to check.

Well sounds fairly straightfoward. For the purpose of punishment your offence was within your 2year probation period, it doesn't matter than the court date was after you are dealt with as it was committed within the 2 years so 6 points would be a loss of licence.

However as you got 5 points unless you already had some points you wouldn't have lost your licence, because the court has written back saying they're reducing it to 3 DVLA have clearly mistaken it as adding an extra 3, send them copies of court paperwork and all should be sorted, don't drive until it's sorted as you'll just have more problems if police stop you, why invite trouble.

Curious as to why you went to court and got given 5 points and a fine and then are written to later on and told they're reducing the points and fine? I've never heard of that, why would they do it?
