I purchased a quote online from one of those comparison websites for nearly £550. Put all my info in correctly but the insurance company requested copies of my license and proof of no claims. They later emailed me saying they recieved my proof of no claims and that my license was valid so I thought it was all sorted. Now I recieved another email from them telling me there were discrepencies. These were the SP30 and the fact that I only had my license for 1 year, even though I still have my test pass certificate which says 04/05/06 so in fact its nearly 4 years I have had my license. (even longer if you include provisional). My previous insurers had no issue with the SP30 (3 points in total on my license) or with the license itself. My current insurers are now telling me that if I dont pay an additional premium they will cancel my cover. However they would also charge me various fees for cancelation too!

I know I have rights so where do I stand legaly? im not spending another penny on these wankas so I replied to them telling em im not going to pay any more and for them to check the details again. I also told them I will be seeking legal advice should they proceed with the cancelation but have not yet recieved a reply from them.

If you've provided them with a copy of your license then they can see when you got that license category as it's on your license.

When getting the quote and taking out the policy did you tell them about your SP30?

+1 to what Ste said, if you didn't tell them, then you are in the wrong, and they can increase your policy if they perceive that your points increase your risk of claiming.

To be honest I have 3 points and it doesn't make a difference, which is all the more reason to make sure they know.

They'll use any excuse to not pay out in the event of a claim.

Also pretty sure you can cancel the policy within 14 days and get your entire premium back. (Check their T&Cs)

Did you declare your SP30 when you got the quote. You need to do that.

With regards to your license, phone them up, some numpty wont have read it correctly, you've had your license nearly 4 years.

Keep a copy of their letter.

What i'd do being in IT, would be to scan my driving license, scan their letter. Put the 2 together on one sheet, highlighting your test pass date and their letter saying you have had a license for 1 year.

I'd also draw a very big ? on it.

I would then phone them and say, what is going on.

Honestly cant remember about the sp30 when I got the quote, but in any case i was upfront about it and they knew when I sent them the documents. What bothers me is the blackmail attempt to try to extort more money from me. I can scan my test pass certificate and send that in an email but I already payed the penalty for speeding so theres no way im gonna let myself get penalised again. Even if I have to risk fraud, screw em!. They screw us.

I wouldn't desribe that as extorting money at all.

If you didn't tell them about your points that's non-disclosure and can void your policy. (Well in this case they'll cancel it).

It's the insurance company's ball, and if you want cover you'll need to play by their rules.

If you didn't tell them when you got the quote or when you took the policy out then you weren't upfront about it. Rolling Eyes

If you told them or not is crucial; if you did them then they can't later decide to increase your premium because of the SP30, but if you didn't tell them then it is quite expected that they will increase your premium now that they do know.

"Have you ever had insurance cancelled or refused?"

Every time you take out insurance of any type, they ask that question.

Recommend you sort this out as if you don't, you may well have to say "yes" to that question for the rest of your life (or be committing insurance fraud to every future insurer by lying). I'm under the impression that it creates a problem for getting any future insurances, of any type.

If you were asked about convictions / points and didn't declare at the time (Note: If they didn't word it correctly and asked you "whether you had any convictions" - verbatim - you could argue against this as an FPN is not a formal "conviction".) and they now expect more cash it's fair cop (i'd be very surprised if they didn't ask or even if they asked it that wrong way - and you "not remembering" is no excuse to get out of this one - if you don't remember then you must assume they did, and did it right tbh). Although regarding the license dates you really need to spell it out to them, that's their error.

When you say scan your test certificate, did you apply for a license?
You state you passed in 2006, but you must send your test certificate off to get your license, so i'm not too sure as to how you have it.

With regards to you've already payed the penalty for speeding, i've practically always had points on my license for the last 10 years, you've got to declare them, it affects your insurance, its as simple as that. When you have points you are seen as someone who is more of a risk.

A test pass certificate is given to you when the examiner takes your licence to send off. If you are then asked to produce your documents, you can produce that until your new licence arrives.

I have mine filed away.

If you get points while a policy is already running and you tell them they cannot demand an extra premium until renewal so if you did that then that is why it didn't go up, presumably it did at renewal or you'd be with your old insurance company still.

What makes you so special that because you paid your endorsement fine you shouldn't have to pay any more via increased premiums? Everyone else does, so do you. Saying you can't remember if you put the SP30 into your go compare form is such a bad lie, pretty obvious that you didn't. Take the extra premium or cancel the policy, you're the one at fault and not them.

What makes you think that I think im special. I actually think of myself as quite a c***t lol. Seriously tho I saved my details on one of the price comparison websites a while ago and simply re-used those. So most likey the SP30 wasnt in the search itself, but the SP30 was disclosed when I took out the policy along with other license details. My argument is not so much the SP30, but their attempt to blackmail me for more money on the basis I only had my license for 1 year (plus failure of disclosure) even tho its nearly 4 years now. I think the date they were looking at must have been the date I purchased a new photocard because my other got stolen.

as i found out last year.. my step dad took out my insurance for me while i was away and didnt bother to mention to them i had a sp30 so when he sent of my documents and they saw i had one they basically wanted another £60 . these days a sp30 does not really affect your premium as long as theres only 1 as its seen as a common offence.. but if you are caught lieing its basically really fraud so they will clobber you a admin charge according to 1st quote who did it to me

It is blackmail, but you set yourself up for it.

I bet if you declared the points it would've added maybe a couple of quid onto the premium but because your having to do it retrospectively, you've given the insurance company carte blanche to help themselves.

I hate insurance companies possibly more than the next person, never ever give them an excuse.

If it's a geniune mistake (you declared them) and the date thing is their mistake then it would be extortion, not blackmail.
