Righto where to start

Had a contract phone for 18 months, and finished on the 31st december.

Now, the phoned me at the start of december asking me if i wanted an upgrade at the end of the month when i renewed my contract, and i told them i didn't want to renew the contract, i wanted to terminate it.

The dude said that's fine, and made his escape from the telephone.

So, there's me thinking all is well till of a sudden last week i get a letter stating that if i don't pay the outstanding balance from the last few months, it would be collected by a debt collection agency.

So i've emailed them stating that i TOLD THE GUY ON THE BLOODY PHONE i wanted the contract terminated, and even took the number off my account on the t-mobile website, and am awaiting a reply....

The phone was binned after december, and checking the bills on the website says that it's not been used at all since december so they are taking the piss.

Surely it can't be my fault some spanner can't follow instructions.

So

where do i stand with this issue?

Ask if calls are recorded, and if yes then request a copy of all data stored on you under freedom of information / data protection act. If not, then it's their job to prove you agreed to renew rather than yours to prove you didn't. Thumbs Up

Every phone contract I've had to cancel has needed to be done in writing with a months notice regardless of if it was due to finish or not. Probably a good idea to check your old contract if you still have it and see what it says about terminations/renewals.

Im with T Mobile and always have problems when i phone them.

Email there customer relations/compaints department. It takes a while for them to get back (up to a week in some cases) but all my problems have always been resolved this way.

Ive managed to get upgrades when they were not due, repayment plans i was not allowed etc etc.

On the phone i always just get straight "No"'s so just kick up a fuss with a complaint e-mail and all will be sorted. Thumbs Up

Well i've emailed and mentioned the bike crash, and recieved the reply:

On a side note i also complained to Quinn after taking a policy out which i decided i didnt want.

Complained about their service etc and managed to cancel it after 6 weeks only having to pay for 4 Laughing

Expect that when they phoned to ask you if you wanted to upgrade, they took your answer as no thanks but ignored the bit about wanting to terminate the contract, normally they require you to phone them or write to them saying you wish to end the contract. The sort of shitty thing phone companies do to take your money, taking your wish to end the contract as extra 'anecdotal' information on why you don't want to upgrade, rather than in instruction to terminate!

You say you cancelled in Dec. Binned the phone and never used it.

Start a nasty thread about them chasing you for £92.88

Yet when they send a email saying that as a GOGW they are refundng £25, but still leave you to pay £67.88 you are happy to pay it......

Sorry but from that YOU KNOW you didn't say cancel the contract, or follow the procedure as laid out in the T/C of the contract.

I would be sending them a letter stating you told them on the phone on whatever date it was that you wanted to cancel, the guy said OK and made no mention of putting it in writing. So as far as you were concerned that was the end of the matter. Hence no further usage after the contract ended. And that you have no intention of paying them a penny as they should have done as instructed.
Tell them to pull the call and give you a transcript, might cost you £10 under the DPA. If they can't then you will see them in court, as they are unable to prove you did not cancel or that you were advised of the process to do so.
Don't just roll over at the first hurdle. If this guy can offer £25 then the next level can offer even more.
