So as most of you will know, my bike was written off in november and i've been working with the solicitor to sort things out.

Now that i've had my injuries checked out and reported, and all the reciepts etc have been sent away, and i know what's happening with the bike, the solicitor is now trying to get in touch with the insurance company of the guy that hit me.

Now there's a problem.

I got an email this morning from the solicitor:

The problem that I am experiencing at the moment is correspondence from the third party insurer as they have failed to reply any of my letters. I note from your compensation questionnaire that you wrote the other driver’s insurers were NIG/Zurich. I have carried out a search on this vehicle registration and the insurers are showing as KGM Motor Policies.



I have tried to contact them but have been unsuccessful. I have written to the other driver for confirmation of his insurers and await his reply. Should there be no response I will need to raise a court action.


Now, seeing as the third party insurers have ignored the solicitor, and i've been given different details from MY insurer, the guy that hit me, and HIS insurance regarding who he's actually insured with (could possibly be a mix up with the reg. plate)... Where do i stand right now?

I'll make a point of noting that I received a letter from the insurance company of the other party, and that stated that he had admitted full liability and that i could have settled this through them, rather than with the solicitor.

I'm sure many of you have been through this...

i'm also looking at a timescale, as because of my injuries, i've been unable to drive since november, and a courtesy bike would be pointless seeing as i wouldn't be able to ride. (I'm also getting councelling for the psychological trauma.)

Basically, my questions are:

Where do i stand with the insurance, what can i possibly do to speed this along?

And, How long do you reckon this will take, as i'm struggling with work and college regarding travel as 2 busses everywhere is getting VERY expensive and a right hassle.

They could have changed insurance company between now and the accident.

I think your solicitor will offer better advice than anyone on here Laughing

If there is no reply, you either leave it or go to court. If you threaten to go to court then I am sure the insurers will try and sort it out beforehand as costs are another thing they will end up paying if you win.

Hi

Chris is probably right that they have changed insurer. Who insures them now is quite possibly different to who insured them in November.

However it is the other driver who is mainly liable, the insurance company is merely covering his liability. Without the cover he should be fully liable for the claim. Send a letter saying that proceedings will be started against him and I bet he will get onto his insurer VERY quickly.

EDIT - claims can and do take a long time. 6 months is nothing.

Righto. thought i'd update this for sme more advice.

So i've seen 2 specialists for my injuries, i've had physio, i've had x-rays i've seen psychologists (2, i'd like to point out how crazy i am), and most recently, i had an MRI scan.

So...

The last surgeon i went to see in march had a look at my hip, as i'm in constant pain and living on painkillers at the moment... it's a bit of a nightmare as i can't do much due to the pain... putting on a tonne of weight and not being able to get rid of it properly is a nightmare.

Anyway.

He recommended i go for the MRI scan, so my solicitor told the insurer to cough up for it, which they did.

So i went for the scan last week, and they didn't give me the results there and then, told me i'd have to wait. So i've got the letter here from them which says:

there is increase in the alpha angle on the axial oblique view consistent with bony configuration which would preispose to femoral acetabular impingement. In the coronal plant the configuration of the femoral head is that of the so-called 'pistol grip' variety again associated with femoral and acetabular impingement. subtle loss of the overlying femoral articular cartlage


Doesn't look good, does it?

Shall update when i hear more.

Long as i get something.

That's the CBR now up for sale because it's getting uncomfy to ride. need something a bit more upright, and something i know how to work on. looking now for a GPZ500s to swap/px for.

Hopefully they say i can have surgery to try to repair it now, rather than just leave it and see what happens.

It's getting worse every day, and i'm trying to not take the painkillers i have but some days it's just too much.

What a life eh.

A wee update.

I've been going through the loops and finally got an offer i was happy with.

I accepted the offer, and the solicitor said she'd let them know and get the cheque out to me.

2 weeks on, i receive a letter stating the insurance company are 'no longer agreeing to the terms of acceptance'.

So now she wants to raise court action.

I'm well aware that i may not get as much as the offer said if it goes through court, and i'm also well aware that i may end up with the costs for the court action.

Anyone been through this before?

Would be a great help if I could get some advise on this.

Already speaking to my solicitor about it, but just wanted to see if anyone's been through the same thing.

Bit of a bummer as i was relying on this to go to the BCF BBQ, but i'm probably just gonna be using my bonus from work next month to get the bike.
